3 LIMITATION OF LIABILITY

IN NO EVENT SHALL PIONEER BE LIABLE FOR ANY DAMAGES, CLAIM OR LOSS INCURRED BY YOU (INCLUDING, WITHOUT LIMITATION, COMPENSATORY, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, LOST PROFITS, LOST SALES OR BUSINESS, EXPENDITURES, INVESTMENTS, OR COMMITMENTS IN CONNECTION WITH ANY BUSINESS, LOSS OF ANY GOODWILL, OR DAMAGES) RESULTING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF PIONEER HAS BEEN INFORMED OF, KNEW OF, OR SHOULD HAVE KNOWN OF THE LIKELIHOOD OF SUCH DAMAGES. This warranty disclaimer and limitation of liability shall not be applicable to the extent that any provision of this warranty is prohibited by any country or local law which cannot be pre-empted.

4 EXPORT LAW ASSURANCES

You agree and certify that neither the Software nor any other technical data received from Pioneer, nor the direct product thereof, will be exported outside the country or district (the “Country”) governed by the government having jurisdiction over you (the “Government”) except as authorised and as permitted by the

laws and regulations of the Government. If the Software has been rightfully obtained by you outside of the Country, you agree that you will not re-export the Software nor any other technical data received from Pioneer, nor the direct product thereof, except as permitted by the laws and regulations of the Government and the laws and regulations of the jurisdiction in which you obtained the Software.

5 TERMINATION

This Agreement is effective until terminated. You may terminate it at any time by destroying the Software. The Agreement also will terminate if you do not comply with any terms or conditions of this Agreement. Upon such termination, you agree to destroy the Software.

6 MISCELLANEOUS

This is the entire Agreement between Pioneer and you regarding its subject matter. No change in this Agreement shall be effective unless agreed to in writing by Pioneer. If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions of this Agreement shall remain in full force and effect.

4 Limitation of Liability.

IN NO EVENT SHALL PIONEER, ITS LICENSORS’ OR SUPPLIER’ AGGREGATE LIABILITY FOR ALL MATTERS ARISING OUT OF THE SUBJECT MATTER OF THIS AGREEMENT, WHETHER IN CONTRACT, TORT OR OTHERWISE, EXCEED THE AMOUNT PAID BY YOU FOR YOUR COPY OF THE PIONEER DATA. PIONEER, ITS LICENSORS AND SUPPLIERS SHALL NOT BE LIABLE IN ANY MATTER TO YOU FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE DATA, EVEN IF PIONEER, ITS LICENSORS OR SUPPLIERS HAVE BEEN AD-

5 Termination.

This Agreement will terminate immediately and automatically, without notice, if you breach any term of this Agreement. You agree that in the event of termination of the Agreement, you shall return the Data (including all documentation and all copies) to PIONEER and its suppliers.

6 Indemnity.

You agree to indemnify, defend and hold PIONEER, its Licensors, and its suppliers (including their respective licensors, suppliers, assignees, subsidiaries, affiliated companies, and the respective officers, directors, employees, shareholders, agents and representatives) free and harmless from and against any liability, loss, injury (including injuries resulting in death), demand, action, cost, expense, or claim of any kind or character, including but not limited to attorney’s fees, arising out of or in connection with any use or possession by you of the Data.

7 Additional Provisions with respect to the Great Britain Data and Northern Ireland data only.

Such Data is provided on an “AS IS” AND “WITH ALL FAULTS BASIS” and the licensors EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF NON-INFRINGE-MENT, MERCHANTABILITY, QUALITY, EFFECTIVENESS, COMPLETENESS, ACCURACY, TITLE AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE DATA PRODUCT RESTS WITH YOU. ORDNANCE SURVEY DOES NOT WARRANT THAT THE DATA WILL MEET YOUR REQUIREMENTS, OR COMPLETE OR ACCURATE OR UP TO DATE OR ACCURATE OR THAT THE OPERATION OF THE DATA WILL BE UNINTERRUPTED OR ERROR FREE. Licence Agreement

11 Miscellaneous.

This is the exclusive and complete Agreement between the Licensors and you regarding its subject matter. Nothing in this Agreement shall create a joint venture, partnership or principal-agent relationship between the Licensors and you. Sections 2 - 4 and 6 - 11 shall survive the expiration or termination of this Agreement. This Agreement may be amended, altered, or modified only by PIONEER. You may not assign any part of this Agreement without PIONEER’ prior written consent. You acknowledge and understand that the Data may be subject to restrictions on exportation and agree to comply with any applicable export laws. In the event that any provision or part of a provision of this Agreement is determined to be invalid, illegal, or unenforceable, such provision or part thereof shall be stricken from this Agreement and the remainder of this Agreement shall be valid, legal, and enforceable to the maximum extent possible. Any notice under this Agreement shall be delivered by courier to PIONEER, Attention Legal Department.

!When a route is calculated, the route and voice guidance for the route are automatically set. Also, for day or time traffic regulations, only information about traffic regulations applicable at the time when the route was calculated is shown. One-way streets and street closures may not be taken into consideration. For example, if a street is open during the morning only, but you arrive later, it would be

against the traffic regulations so you cannot drive along the set route. When driving, please follow the actual traffic signs. Also, the system may not know some traffic regulations.

pFailure to set correct information about the local time may result in the navigation sys-

tem providing improper routing and guidance instructions.

pNever set the volume of your navigation system so high that you cannot hear outside traffic and emergency vehicles.

pTo promote safety, certain functions are disabled unless the vehicle is stopped and/or

the handbrake is applied.

pThe data encoded in the built-in memory is the intellectual property of the provider, and the provider is responsible for such content.

pKeep this manual handy as a reference for operating procedures and safety information.

pPay close attention to all warnings in this manual and follow the instructions care-

fully.

pDo not install this navigation system where it may (i) obstruct the driver’s vision, (ii) impair the performance of any of the vehicle’s operating systems or safety features, including air bags or hazard lamp buttons or (iii) impair the driver’s ability to safely operate the vehicle.

pPlease remember to fasten your seat belt at all times while operating your vehicle. If you are ever in an accident, your injuries

can be considerably more severe if your seat belt is not properly buckled.

pBe sure to attach the detachable device to the head unit during in-car use. Use of this detachable device when not firmly attached

to the head unit, could result in damage to it in the event of a sudden stop.

p Never use headphones while driving.

Cautions for the detachable device

CAUTION

!Do not leave the detachable device in places where it may become subject to high temperatures or humidity, such as:

Cautions for the battery pack

In the event of battery leakage, wipe the battery pack completely clean and replace it with a new battery.

Speed limit indication

The speed limit is based on the map database. The speed limit in the database may not match the actual speed limit of the current road. This is not a definite value. Be sure to drive according to the actual speed limit.

p The operating temperature range of the battery is from 0 °C to +55 °C.

pThe charging temperature range of the battery is from –20 °C to +60 °C.

Charging cannot be done when the temperature is outside of the charging tem-

perature range.

pThe battery lifetime is limited. Charged battery duration will decrease with repetitive charging. If the battery duration is extremely short, it may be near the end of bat-

tery life span. Consult your dealer or the nearest authorized Pioneer Service Station and replace it with a new battery pack.

05 Additional Safety Information

Handbrake interlock

Certain functions (such as certain touch panel key operations) offered by this navigation system could be dangerous and/or unlawful if used while driving. To prevent such functions from being used while the vehicle is in motion, there is an interlock system that senses when the handbrake is set and when the vehicle is moving. If you attempt to use the functions described above while driving, they will become disabled until you stop the vehicle in a safe place, and apply the handbrake. Please keep the brake pedal pushed down before releasing the handbrake.

WARNING

!LIGHT GREEN LEAD AT POWER CONNECTOR IS DESIGNED TO DETECT PARKED STATUS AND MUST BE CONNECTED TO THE POWER SUPPLY SIDE OF THE HANDBRAKE SWITCH. IMPROPER CONNECTION OR USE OF THIS LEAD MAY VIOLATE APPLICABLE LAW AND MAY RESULT IN SERIOUS INJURY OR DAMAGE.

!When applying the handbrake in order to enable other functions offered by the navigation system, park your vehicle in a safe place, and keep the brake pedal pushed down before releasing the handbrake if the vehicle is parked

on a hill or otherwise might move when releasing the handbrake.

Handling the SD card slot

CAUTION

!Keep the dummy SD card out of the reach of small children to prevent them from accidentally swallowing it.

2 Propiedad.

Los Cedentes de licencias son propietarios de los derechos de reproducción de los Datos y dichos cedentes poseen todos los derechos de propiedad sobre los mismos. Por el presente contrato se compromete a no alterar, eliminar, borrar u ocultar ninguna notificación sobre derechos de reproducción (copyrights) o notas de patente incluida en los Datos. 4 Limitación de la responsabilidad.

BAJO NINGÚN CONCEPTO, LA RESPONSABILIDAD TOTAL DE PIONEER, SUS CEDENTES DE LICENCIAS O PROVEEDORES CON RESPECTO A TODOS LOS ASUNTOS RELACIONADOS CON EL ASUNTO DEL PRESENTE CONTRATO, YA SEA DE FORMA CONTRACTUAL, EXTRACONTRACTUAL O DE OTRO MODO, SUPERARÁ LA CANTIDAD ABONADA POR USTED A CAMBIO DE LA COPIA DE LOS DATOS DE PIONEER. 5 Terminación.

El presente Contrato terminará inmediata y automáticamente, sin previo aviso, si Usted incumple cualquier cláusula del mismo. Por el presente Contrato acepta que, en caso de terminación del mismo usted devolverá los Datos (incluida toda la documentación y todas las copias) a PIONEER y sus proveedores.

6 Indemnización.

Usted acepta indemnizar, defender o liberar a PIONEER, sus cedentes de licencias y sus proveedores (incluidos sus respectivos cedentes de licencias, proveedores, cesionarios, compañías filiales y sus respectivos jefes, directores, empleados, accionistas, agentes y representantes) de toda responsabilidad, pérdida, daño (incluidos los daños personales que provoquen el fallecimiento del sujeto), demanda, acción, coste, gasto o reclamación de cualquier tipo, incluidos, sin limitarse a ellos, los honorarios de los abogados, derivada de o relativa a la utilización o posesión de los Datos por su parte.

LOS CEDENTES DE LICENCIAS NO SE RESPONSABILIZARÁN DE NINGÚN DAÑO ESPECIAL, INDIRECTO, RESULTANTE O SECUNDARIO (INCLUIDOS LOS DAÑOS POR PÉRDIDA DE BENEFICIOS EMPRESARIALES, INTERRUPCIÓN DEL NEGOCIO, PÉRDIDA DE INFORMACIÓN EMPRESARIAL Y SIMILAR) RELACIONADO CON EL PRESENTE CONTRATO O CON EL USO O INCAPACIDAD PARA USAR LOS DATOS, INCLUSO AUNQUE HAYAN SIDO AVISADOS SOBRE LA POSIBILIDAD DE QUE SE PRODUZCAN DICHOS DAÑOS.

dUsted no podrá utilizar los Datos de ninguna forma impresa o publicada que dé lugar a productos derivados que se distribuyan libremente o se vendan al público sin el previo consentimiento de Ordenance Survey.

eUsted indemnizará o liberará de toda responsabilidad a Ordenance Survey con relación a cualquier demanda o actuación de cualquier tipo, o demanda o acción en la que se alegue una pérdida, costes, daños materiales, gastos o daños personales (incluidos los daños personales que provoquen el fallecimiento del sujeto) derivada de uso autorizado o no autorizado, posesión, modificación o alteración de los datos por su parte.

fEl Usuario Final acepta la obligación de facilitar a Ordenance Survey, en caso de que ésta se lo pida, información sobre los productos y/o servicios que contienen y/o que se deriven de los Productos Autorizados que ésta produce.

gUsted será responsable ante Ordenance Survey si se certifica incumplimiento, por su parte, de alguno de los términos contractuales anteriormente mencionados.

8Disposiciones adicionales referentes únicamente a los Datos de Dinamarca.

No podrá utilizar los Datos para crear mapas en guías telefónicas, guías telefónicas u otros productos similares a dichas guías (p. ej. directorios), incluidos aquellos en formato digital.

9Disposiciones adicionales referentes únicamente a los Datos de Noruega.

No podrá utilizar los Datos para crear mapas digitales o impresos de uso general que sean similares a los productos nacionales básicos de la Autoridad Cartográfica Noruega. (Todo producto derivado de los Datos de Noruega será considerado similar a los productos nacionales básicos de la Autoridad Cartográfica Noruega si dicho producto derivado tiene un alcance regional o nacional y, además, incluye un contenido, escalas y formato similares a los productos básicos nacionales de la Autoridad Cartográfica Noruega.)

10Disposiciones adicionales referentes únicamente a los Datos de Polonia.

No podrá utilizar los Datos para crear mapas impresos.

11Miscelánea.

El presente es un Contrato exclusivo y completo entre los Cedentes de licencias y Usted con relación al objeto principal del mismo. Ninguna disposición del presente Contrato implica la creación de una empresa conjunta, asociación o relación director-agente entre los Cedentes de licencias y Usted. Los artículos 2 - 4 y 6 - 11 seguirán vigentes una vez vencido o terminado el presente Contrato. El presente Contrato sólo puede ser enmendado, alterado o modificado por PIONEER. Usted no podrá ceder ninguna parte del presente Contrato sin el consentimiento previo y escrito de PIONEER. Usted reconoce y comprende que los Datos podrán estar sujetos a restricciones de exportación y acepta el cumplimiento de toda ley de exportación aplicable. Si se determina que una disposición, o parte de ella, del presente Contrato no es válida, es ilegal o no se puede hacer cumplir, dicha disposición o parte de la misma será eliminada del presente Contrato y el resto del Contrato será válido, legal y deberá cumplirse en la medida de lo posible. Cualquier notificación relativa a este Contrato se enviará por mensajero al Departamento de Asesoría Jurídica de PIONEER.

ADVERTENCIA

!No intente instalar o reparar el sistema de navegación usted mismo. La instalación o reparación del sistema de navegación por parte de personas sin la formación y la experiencia adecuadas en equipos y accesorios de automoción puede resultar peligrosa y podría exponerle al riesgo de sufrir descargas eléctricas u otros peligros.

!Si algún típico de líquido o cuerpo extraño entrara en el interior de este sistema de navegación, aparque su vehículo en un lugar seguro y desactive el interruptor de encendido (ACC OFF) inmediatamente y póngase en contacto con su distribuidor o con el centro de servicio Pioneer más autorizado. No utilice el sistema de navegación en este estado, ya que hacerlo podría derivar en un incendio, descargas eléctricas u otro tipo de fallos.

!Si sale humo, detecta olores o ruidos extraños en el sistema de navegación o cualquier otro indicio anómalo en la pantalla LCD, apague el producto inmediatamente y póngase en contacto con su concesionario o con el servicio técnico autorizado Pioneer más cercano. Si utiliza el producto en ese estado podría dañar de forma permanente el sistema.

!No desmonte o modifique el producto, ya que hay componentes de alta tensión en su interior que podrían provocar descargas eléctricas. Póngase en contacto con su concesionario o el servicio técnico autorizado Pioneer más cercano para efectuar cualquier ajuste, reparación o revisión del producto.

!Evite que este producto entre en contacto con cualquier tipo de líquido. Podrían producirse descargas eléctricas. En caso de que esto suceda, podría resultar dañado, salir humo de su interior y sobrecalentarse.

PRECAUCIÓN

!Cuando se calcula una ruta, se establecen automáticamente la ruta y la guía de voz de la misma. Del mismo modo, en el caso de regulaciones de tráfico en función del día o la hora, solo se muestra la información de tráfico acerca de regulaciones de tráfico disponibles en el momento en el que se calculó la

ruta. Es posible que no se tengan en cuenta las calles de un solo sentido y las calles cortadas. Por ejemplo, si hay una calle que solo está abierta por las mañanas, y llega tarde, incumpliría las regulaciones de tráfico, por lo que no podría circular por la ruta establecida. Respete las señales de tráfico mientras conduzca. Además, puede que el sistema no esté al tanto de determinadas regulaciones del tráfico.

Antes de utilizar el sistema de navegación, asegúrese de haber leído y entendido la siguiente información sobre seguridad:

pLea todo el manual antes de poner en funcionamiento el sistema de navegación.

pLas funciones de navegación del sistema son sólo una asistencia para la conducción del vehículo. No constituyen un sustituto

de la atención y el cuidado que usted debe prestar a las circunstancias de circulación.

pNo utilice el sistema de navegación si le puede distraer o impedir que conduzca de manera segura. Cumpla siempre las normas de seguridad para la conducción y respete todas las regulaciones de tráfico existentes. Si tiene problemas al manejar el sistema o al leer la pantalla, aparque el vehículo en un lugar seguro y ponga el freno

de mano antes de realizar los ajustes necesarios.

pNo permita nunca a nadie emplear el sistema a menos que hayan leído y entendido las instrucciones de operación.

pNo utilice nunca el sistema de navegación para dirigirse a un hospital, una comisaría de policía, ni centros similares en caso de emergencia. No utilice ninguna de las funciones de la telefonía manos libres y llame

al número de emergencia correspondiente.

pEste equipo muestra información de rutas y de guía simplemente como referencia. Es posible que no muestre la información sobre rutas permitidas, condiciones de la carretera, calles de un solo sentido, carreteras cortadas o restricciones de tráfico.

pLas restricciones del tráfico y los cambios provisionales vigentes siempre tendrán prioridad sobre la guía que ofrece el sistema de navegación. Respete las restricciones existentes del tráfico, aunque este

producto ofrezca un consejo contrario.

pSi no se introduce la información correcta sobre la hora local, es posible que el siste-

ma de navegación muestre rutas e instrucciones de guía inapropiadas.

pNo ponga el volumen del sistema de navegación tan alto como para que le impida oír el tráfico del exterior y los vehículos de

emergencia.

pPor cuestiones de seguridad, ciertas funciones estarán deshabilitadas hasta que se

detenga el vehículo y/o se utilice el freno de mano.

pLos datos codificados en la memoria integrada son propiedad intelectual del proveedor, quien será responsable de dicho

contenido.

pConserve este manual a mano para consultar los procedimientos de operación y

las consignas de seguridad cuando sea necesario.

pPreste atención a las advertencias del manual y siga las instrucciones atentamente.

pNo instale el sistema de navegación en un lugar que pueda (i) impedir la visión del conductor, (ii) interferir en el rendimiento de cualquier otro sistema del vehículo o función de seguridad, como airbags, botones de las luces de advertencia, o (iii) impe-

dir que se pueda conducir de forma segura.

pRecuerde abrocharse siempre el cinturón de seguridad cuando maneje su vehículo. En el caso de sufrir un accidente, sus lesio-

nes pueden ser mucho más graves si no tiene bien puesto su cinturón de seguridad.

pAsegúrese de conectar el dispositivo extraíble a la unidad principal mientras lo utiliza en el coche. El uso de este dispositivo extraíble sin estar firmemente conectado a la unidad principal podría derivar en daños,

en caso de detenerse de forma repentina.

pNo utilice nunca auriculares mientras conduce.

Precauciones en el uso del dispositivo extraíble

PRECAUCIÓN

!No deje el dispositivo extraíble en sitios donde pueda estar expuesto a altas temperaturas o a humedad, como por ejemplo:

—Lugares cercanos a un calefactor, conducto de ventilación o aire acondicionado.

—Lugares expuestos a la luz solar directa tales como el tablero de instrumentos o bandeja trasera del vehículo.

—Lugares donde pueda ser salpicada por la lluvia como, por ejemplo, cerca de la puerta.

!Ponga cuidado en no tocar los terminales del dispositivo extraíble ni la unidad principal. De lo contrario, podrían producirse fallos en la conexión. Si algún terminal se encuentra sucio, frótelo con un paño limpio seco.

!Cuando utilice este sistema de navegación en el vehículo, conecte el dispositivo extraíble a la unidad principal.

!Cuando abandone el vehículo, asegúrese de retirar el dispositivo extraíble de la unidad principal y llévelo con usted.

!Asegúrese de que el dispositivo extraíble esté apagado cuando se esté cargando la batería.

please wait” al iniciarse. Si así fuera, espere a que aparezca el mensaje “Ready to

start up system.”. Tras mostrarse el mensaje, se reiniciará el sistema.
