PIONEER AVIC-F910BT, AVIC­F710BT, AVIC-F9110BT
THIS IS A LEGAL AGREEMENT BETWEEN YOU, AS THE END USER, AND PIONEER CORP. (JAPAN) (PIONEER). PLEASE READ THE TERMS AND CONDITIONS OF THIS AGREEMENT CAREFULLY BEFORE USING THE SOFTWARE INSTALLED ON THE PIONEER PRODUCTS. BY USING THE SOFT­WARE INSTALLED ON THE PIONEER PRO­DUCTS, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. THE SOFT­WARE INCLUDES A DATABASE LICENSED BY THIRD PARTY SUPPLIER(S) (SUPPLIERS), AND YOUR USE OF THE DATABASE IS COV­ERED BY THE SUPPLIERSSEPARATE TERMS, WHICH ARE ATTACHED TO THIS AGREEMENT (refer to page 12). IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, PLEASE RETURN THE PIONEER PRODUCTS (INCLUDING THE SOFTWARE, AND ANY WRITTEN MATERIALS) WITHIN FIVE (5) DAYS OF RECEIPT OF THE PRODUCTS, TO THE AUTHORISED PIONEER DEALER FROM WHICH YOU PURCHASED THEM.
1 GRANT OF LICENCE
Pioneer grants to you a non-transferable, non­exclusive licence to use the software installed on the Pioneer products (the Software) and the related documentation solely for your own personal use or for internal use by your busi­ness, only on such Pioneer products. You shall not copy, reverse engineer, translate, port, modify or make derivative works of the Software. You shall not loan, rent, disclose, publish, sell, assign, lease, sublicence, market or other wise transfer the Software or use it in any manner not expressly authorised by this agreement. You shall not derive or attempt to derive the source code or structure of all or any portion of the Software by reverse engi­neering, disassembly, decompilation, or any other means. You shall not use the Software to operate a service bureau or for any other use
involving the processing of data for other per­sons or entities. Pioneer and its licensor(s) shall retain all copy­right, trade secret, patent and other proprie­tary ownership rights in the Software. The Software is copyrighted and may not be cop­ied, even if modified or merged with other pro­ducts. You shall not alter or remove any copyright notice or proprietary legend con­tained in or on the Software. You may transfer all of your licence rights in the Software, the related documentation and a copy of this Licence Agreement to another party, provided that the party reads and agrees to accept the terms and conditions of this Li­cence Agreement.
2 DISCLAIMER OF WARRANTY
The Software and related documentation are provided to you AS IS. PIONEER AND ITS LI­CENSOR(S) (for the purpose of provisions 2 and 3, Pioneer and its licensor(s) shall be col­lectively referred to as Pioneer) MAKES AND YOU RECEIVE NO WARRANTY, WHETHER EX­PRESS OR IMPLIED, AND ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE ARE EX­PRESSLY EXCLUDED. SOME COUNTRIES DO NOT ALLOW EXCLUSION OF IMPLIED WAR­RANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. The Software is complex and may contain some non-conformities, de­fects or errors. 3 LIMITATION OF LIABILITY
IN NO EVENT SHALL PIONEER BE LIABLE FOR ANY DAMAGES, CLAIM OR LOSS IN­CURRED BY YOU (INCLUDING, WITHOUT LIM­ITATION, COMPENSATORY, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, LOST PROFITS, LOST SALES OR BUSINESS, EXPENDITURES, IN­VESTMENTS, OR COMMITMENTS IN CON­NECTION WITH ANY BUSINESS, LOSS OF ANY GOODWILL, OR DAMAGES) RESULTING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF PIONEER HAS BEEN INFORMED OF, KNEW OF, OR SHOULD HAVE KNOWN OF THE LIKELIHOOD OF SUCH DAMAGES. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGRE­GATE, INCLUDING WITHOUT LIMITATION BREACH OF CONTRACT, BREACH OF WAR­RANTY, NEGLIGENCE, STRICT LIABILITY, MIS­REPRESENTATION, AND OTHER TORTS. This warranty disclaimer and limitation of liability shall not be applic­able to the extent that any provision of this warranty is prohibited by any country or local law which cannot be pre-empted.

5 TERMINATION
This Agreement is effective until terminated. You may terminate it at any time by destroying the Software. The Agreement also will termi­nate if you do not comply with any terms or conditions of this Agreement. Upon such ter­mination, you agree to destroy the Software.
6 MISCELLANEOUS
This is the entire Agreement between Pioneer and you regarding its subject matter. No change in this Agreement shall be effective unless agreed to in writing by Pioneer. If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions of this Agreement shall remain in full force and effect.
4 EXPORT LAW ASSURANCES
You agree and certify that neither the Software nor any other technical data received from Pioneer, nor the direct product thereof, will be exported outside the country or district (the Country) governed by the government having jurisdiction over you (the Government) ex­cept as authorised and as permitted by the

Tele Atlas End User Licensing Terms
THIS IS A LEGAL AGREEMENT (THE AGREE­MENT) BETWEEN YOU, THE END USER, AND PIONEER and its licensors of Data product (sometimes collectively Licensors). BY USING YOUR COPY OF THE LICENSED DATA, YOU AGREE TO THE TERMS AND CONDI­TIONS OF THIS AGREEMENT.

Grant of License.
Licensors grant you a non-transferable, nonex­clusive license to use the map data and busi­ness points of interest information (the POIs), (together, the Data) contained on these discs, solely for personal, non-commer­cial use and not to operate a service bureau or for any other use involving the processing of data of other persons or entities. You may make one (1) copy of the Data for archival or backup purposes only but you may not other­wise copy, reproduce, modify, make derivative works, derive the structure of or reverse engi­neer the Data. The Data is restricted for use with the PIONEER Product(s). The Data con­tains confidential and proprietary information and materials, and may contain trade secrets, so you agree to hold the Data in confidence and in trust and not to disclose the Data or any portions in any form, including by renting, leasing, publishing, leasing, sublicensing or transferring the Data to any third party. You are explicitly prohibited from downloading the digital maps and programmes contained in the Data or from transferring these to another data carrier or computer. You are prohibited from using the POIs (i) to create mailing lists or (ii) for other such similar uses.

Limitation of Liability.
IN NO EVENT SHALL PIONEER, ITS LICEN­SORSOR SUPPLIERAGGREGATE LIABILITY FOR ALL MATTERS ARISING OUT OF THE SUBJECT MATTER OF THIS AGREEMENT, WHETHER IN CONTRACT, TORT OR OTHER­WISE, EXCEED THE AMOUNT PAID BY YOU FOR YOUR COPY OF THE PIONEER DATA. PIONEER, ITS LICENSORS AND SUPPLIERS SHALL NOT BE LIABLE IN ANY MATTER TO YOU FOR ANY SPECIAL, INDIRECT, CONSE­QUENTIAL OR INCIDENTAL DAMAGES (IN­CLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUP­TION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE DATA, EVEN IF PIONEER, ITS LI­CENSORS OR SUPPLIERS HAVE BEEN AD -
VISED OF THE POSSIBILITY OF SUCH DAMAGES.

Termination.
This Agreement will terminate immediately and automatically, without notice, if you breach any term of this Agreement. You agree that in the event of termination of the Agree­ment, you shall return the Data (including all documentation and all copies) to PIONEER and its suppliers.

Indemnity.
You agree to indemnify, defend and hold PIONEER, its Licensors, and its suppliers (in­cluding their respective licensors, suppliers, assignees, subsidiaries, affiliated companies, and the respective officers, directors, employ­ees, shareholders, agents and representatives) free and harmless from and against any liabili­ty, loss, injury (including injuries resulting in death), demand, action, cost, expense, or claim of any kind or character, including but not limited to attorneys fees, arising out of or in connection with any use or possession by you of the Data.

11 Miscellaneous.
This is the exclusive and complete Agreement between the Licensors and you regarding its subject matter. Nothing in this Agreement shall create a joint venture, partnership or principal-agent relationship between the Li­censors and you. Sections 2 - 4 and 6 - 11 shall survive the expiration or termination of this Agreement. This Agreement may be amended, altered, or modified only by PIONEER. You may not assign any part of this Agreement without PIONEERprior written consent. You acknowledge and understand that the Data may be subject to restrictions on exportation and agree to comply with any applicable ex­port laws. In the event that any provision or part of a provision of this Agreement is deter­mined to be invalid, illegal, or unenforceable, such provision or part thereof shall be stricken from this Agreement and the remainder of this Agreement shall be valid, legal, and enforce­able to the maximum extent possible. Any no­tice under this Agreement shall be delivered by courier to PIONEER, Attention Legal Department.

gation system by yourself. Installation or servi­cing of the navigation system by persons without training and experience in electronic equipment and automotive accessories may be dangerous and could expose you to the risk of electric shock or other hazards.

this navigation system, park your vehicle to safe place and turn the ignition switch off (ACC OFF) immediately and consult your deal­er or the nearest authorised Pioneer Service Station. voice guidance for the route are automatically set. Also, for day or time traffic regulations, only information about traffic regulations at the time when the route was calculated is shown. One-way streets and street closures may not be taken into consideration. For ex­ample, if a street is open during the morning only, but you arrive later, it would be against
the traffic regulations so you cannot drive along the set route. When driving, please fol­low the actual traffic signs. Also, the system may not know some traffic regulations.

Therefore Pioneer strongly advices you to check: your local legislation and to use warning function for safety cameras only if this is al­lowed. when travelling abroad please make check in advance that the speed warning systemin the countries you are driving in is allowed.
About speed limit indication
The speed limit is based on the map database. The speed limit in the database may not match the actual speed limit of the current road. This is not a definite value. Be sure to drive according to the actual speed limit.

Additional Safety Information
Handbrake interlock
Certain functions (such as viewing of DVD­Video and certain touch panel key operations) offered by this navigation system could be dangerous and/or unlawful if used while driv­ing. To prevent such functions from being used while the vehicle is in motion, there is an interlock system that senses when the hand­brake is set and when the vehicle is moving. If you attempt to use the functions described above while driving, they will become disabled until you stop the vehicle in a safe place, and apply the handbrake. Please keep the brake pedal pushed down before releasing the hand­brake.

4 COMPROMISO CON LAS LEYES SOBRE LA EXPORTACIÓN
Usted acuerda y certifica que ni el Software ni ningún otro dato técnico recibido de Pioneer, ni el mismo producto, serán exportados fuera del país o distrito (en adelante, el País) que se rija por las leyes del gobierno que tenga ju­risdicción sobre usted (en adelante, el Gobier­no) excepto si está autorizado por las leyes y regulaciones de dicho Gobierno. Si usted ha adquirido el Software legalmente fuera del País, se compromete a no reexportar el Soft­ware ni ningún otro dato técnico recibido de Pioneer, ni el mismo producto, con excepción de lo que permitan las leyes y regulaciones del Gobierno y las leyes y regulaciones de la juris­dicción en la que usted obtuvo el Software.

5 EXTINCIÓN DEL CONTRATO
Este Contrato será efectivo hasta la fecha de su extinción. Usted podrá terminarlo en cual­quier momento destruyendo el Software. El Contrato también se extinguirá si no cumple alguno de los términos y condiciones de este Contrato. En caso de tal extinción, usted está de acuerdo en destruir el Software.
6 VARIOS
Este es el Contrato completo entre Pioneer y usted con relación a este asunto. Ningún cam­bio de este Contrato entrará en vigor a menos que lo acuerde por escrito Pioneer. Aunque al­guna disposición de este Contrato se declare inválida o inaplicable, las restantes permane­cerán con pleno vigor y validez.

EL PRESENTE ES UN CONTRATO LEGAL (EL CONTRATO) ENTRE USTED, EL USUARIO FINAL, Y PIONEER y sus cedentes de licencias de datos (en ocasiones referidos conjunta­mente como Cedentes de licencias). HA­CIENDO USO DE SU COPIA DE DATOS AUTORIZADOS ACEPTA LOS TÉRMINOS Y CONDICIONES DEL PRESENTE CONTRATO.

Concesión de la Licencia.
Los cedentes de licencias le conceden una li­cencia no transferible y no exclusiva para utili­zar los datos de los mapas y la información sobre puntos de interés empresarial (POI,en conjunto referidos como los Datos) incluidos en estos discos únicamente para uso personal y no comercial, en ningún caso para gestionar una oficina de servicios o para cualquier otro uso que implique el procesamiento de datos de otras personas o entidades. Podrá realizar una (1) copia de los Datos únicamente como archivo o para conservar una copia de seguri­dad, pero no podrá copiar, reproducir, modifi­car, realizar tareas derivadas o modificar la estructura de los Datos. Los Datos sólo pue­den ser utilizados con el(los) Producto(s) PIONEER. Los Datos contienen información y materiales confidenciales y patentados y pue­den contener secretos comerciales así que de­berá mantener la confidencialidad de los Datos y no revelarlos total ni parcialmente de ningún modo, ya sea mediante el alquiler, lea­sing, publicación, sub-licencia o transferencia de los Datos a terceros. Queda terminante­mente prohibido descargar los programas y mapas digitales incluidos en los Datos o trans­ferirlos a otro ordenador o soporte de datos. No podrá utilizar los POI (i) para crear listas de correo ni (ii) para otros usos similares.

Contrato de licencia
2 Propiedad.
Los Cedentes de licencias son propietarios de los derechos de reproducción de los Datos y dichos cedentes poseen todos los derechos de propiedad sobre los mismos. Por el presen­te contrato se compromete a no alterar, elimi­nar, borrar u ocultar ninguna notificación sobre derechos de reproducción (copyrights) o notas de patente incluida en los Datos. LOS DATOS SE SUMINISTRAN TAL COMO SON Y CON SUS POSIBLES FALLOS Y PIONEER Y SUS CEDENTES DE LICENCIAS, ASÍ COMO SUS DISTRIBUIDORES Y PROVEE­DORES AUTORIZADOS (EN CONJUNTO, PROVEEDORES) RENUNCIAN EXPRESA­MENTE A OTRAS GARANTÍAS, EXPLÍCITAS O IMPLÍCITAS, ENTRE LAS QUE SE INCLUYEN, NO LIMITÁNDOSE A ELLAS, LAS GARANTÍAS IMPLÍCITAS DE NO INCUMPLIMIENTO, CO­MERCIABILIDAD, EFECTIVIDAD, TOTALIDAD, PRECISIÓN, TÍTULO Y ADECUACIÓN PARA
UN FIN CONCRETO. PIONEER, SUS CEDEN­TES DE LICENCIAS Y PROVEEDORES NO GA­RANTIZAN QUE LOS DATOS CUMPLAN SUS REQUISITOS O QUE EL FUNCIONAMIENTO DE LOS DATOS SEA CONTINUO O ESTÉ LIBRE DE ERRORES. NINGÚN AVISO ORAL O ESCRITO REALIZADO POR PIONEER, SUS CEDENTES DE LICENCIAS, PROVEEDORES O CUALQUIER OTRO EMPLEADO SUYO CONS­TITUIRÁ GARANTÍA ALGUNA NI AUMENTARÁ LA RESPONSABILIDAD DE PIONEER, SUS CEDENTES DE LICENCIAS O PROVEEDORES Y USTED NO PODRÁ BASAR ACTUACIÓN AL­GUNA EN DICHA INFORMACIÓN O AVISO. LA PRESENTE RENUNCIA ES UNA CONDI­CIÓN FUNDAMENTAL DEL PRESENTE CON­TRATO Y USTED ACEPTA LOS DATOS DE CONFORMIDAD CON LA MISMA.

Limitación de la responsabilidad.
BAJO NINGÚN CONCEPTO, LA RESPONSABI­LIDAD TOTAL DE PIONEER, SUS CEDENTES DE LICENCIAS O PROVEEDORES CON RES­PECTO A TODOS LOS ASUNTOS RELACIONA­DOS CON EL ASUNTO DEL PRESENTE CONTRATO, YA SEA DE FORMA CONTRA­CTUAL, EXTRACONTRACTUAL O DE OTRO MODO, SUPERARÁ LA CANTIDAD ABONA­DA POR USTED A CAMBIO DE LA COPIA DE LOS DATOS DE PIONEER. PIONEER, SUS CE­DENTES DE LICENCIAS Y PROVEEDORES NO SE RESPONSABILIZARÁN DE NINGÚN DAÑO ESPECIAL, INDIRECTO, RESULTANTE O SE­CUNDARIO (INCLUIDOS LOS DAÑOS POR PÉRDIDA DE BENEFICIOS EMPRESARIALES, CIERRE DEL NEGOCIO, PÉRDIDA DE INFOR­MACIÓN EMPRESARIAL Y SIMILAR) RELA­CIONADO CON EL PRESENTE CONTRATO O CON EL USO O INCAPACIDAD PARA USAR LOS DATOS, INCLUSO AUNQUE PIONEER, SUS CEDENTES DE LICENCIAS O PROVEE­DORES HAYAN SIDO AVISADOS SOBRE LA POSIBILIDAD DE QUE SE PRODUZCAN DI­CHOS DAÑOS.

5 Terminación.
El presente Contrato terminará inmediata y automáticamente, sin previo aviso, si Usted in­cumple cualquier cláusula del mismo. Por el presente Contrato acepta que, en caso de ter­minación del mismo usted devolverá los Datos (incluida toda la documentación y todas las copias) a PIONEER y sus proveedo­res.

Indemnización.
Usted acepta indemnizar, defender o liberar a PIONEER, sus cedentes de licencias y sus pro­veedores (incluidos sus respectivos cedentes de licencias, proveedores, cesionarios, compa­ñías filiales y sus respectivos jefes, directores, empleados, accionistas, agentes y represen­tantes) de toda responsabilidad, pérdida, daño (incluidos los daños personales que provo­quen el fallecimiento del sujeto), demanda, acción, coste, gasto o reclamación de cual­quier tipo, incluidos, sin limitarse a ellos, los honorarios de los abogados, derivada de o re­lativa a la utilización o posesión de los Datos por su parte.

a No podrá eliminar ni ocultar ningún dere-
cho de reproducción, marca comercial o nota restrictiva que pertenezca a Ordenan­ce Survey.
b Los Datos pueden incluir los datos de los
cedentes de licencias, incluido Ordenance Survey. Dichos Datos se suministran TAL COMO SON Y CON SUS POSIBLES FALLOS y los cedentes de licencias RENUNCIAN EXPRESAMENTE A TODAS LAS GARAN­TíAS, EXPLíCITAS O IMPLíCITAS, ENTRE LAS QUE SE INCLUYEN, NO LIMITÁNDOSE A ELLAS, LAS GARANTíAS IMPLíCITAS DE NO INCUMPLIMIENTO, COMERCIABILI­DAD, CALIDAD, EFECTIVIDAD, TOTALI­DAD, PRECISIÓN, TíTULO Y ADECUACIÓN PARA UN FIN CONCRETO. USTED ASUMI­RÁ TODOS LOS RIESGOS RELATIVOS A LA
CALIDAD Y FUNCIONAMIENTO DE LOS DATOS. ORDENANCE SURVEY NO GARAN­TIZA QUE LOS DATOS CUMPLAN SUS RE­QUISITOS, O QUE SEAN COMPLETOS, PRECISOS O ACTUALIZADOS, O QUE EL FUNCIONAMIENTO DE LOS DATOS SEA CONTINUO O ESTÉ LIBRE DE ERRORES. NINGÚN AVISO ORAL O ESCRITO REALI­ZADO POR ORDENANCE SURVEY, PIONEER O SUS CEDENTES DE LICEN­CIAS Y EMPLEADOS CONSTITUIRÁ GA­RANTíA ALGUNA NI AUMENTARÁ DE NINGÚN MODO LA RESPONSABILIDAD DE ORDENANCE SURVEY Y USTED NO PODRÁ BASARSE EN DICHA INFORMA­CIÓN O AVISO PARA ACTUACIÓN ALGU­NA. La presente es una condición fundamental del presente contrato y usted acepta los datos de conformidad con la misma.
c BAJO NINGÚN CONCEPTO ORDENANCE
SURVEY SERÁ RESPONSABLE ANTE USTED POR CUESTIONES RELACIONA­DAS CON EL ASUNTO DE LOS CONTRA­TOS, YA SEA DE FORMA CONTRACTUAL, EXTRACONTRACTUAL O DE OTRO MODO. LOS CEDENTES DE LICENCIAS NO SE RES­PONSABILIZARÁN DE NINGÚN DAÑO ES­PECIAL, INDIRECTO, RESULTANTE O SECUNDARIO (INCLUIDOS LOS DAÑOS POR PÉRDIDA DE BENEFICIOS EMPRESA­RIALES, INTERRUPCIÓN DEL NEGOCIO, PÉRDIDA DE INFORMACIÓN EMPRESA­RIAL Y SIMILAR) RELACIONADO CON EL PRESENTE CONTRATO O CON EL USO O INCAPACIDAD PARA USAR LOS DATOS, INCLUSO AUNQUE HAYAN SIDO AVISA­DOS SOBRE LA POSIBILIDAD DE QUE SE PRODUZCAN DICHOS DAÑOS.
d Usted no podrá utilizar los Datos de ningu-
na forma impresa o publicada que dé lugar a productos derivados que se distribuyan li­bremente o se vendan al público sin el pre­vio consentimiento de Ordenance Survey.

e Usted indemnizará o liberará de toda res-
ponsabilidad a Ordenance Survey con rela­ción a cualquier demanda o actuación de cualquier tipo, o demanda o acción en la que se alegue una pérdida, costes, daños materiales, gastos o daños personales (in­cluidos los daños personales que provo­quen el fallecimiento del sujeto) derivada de uso autorizado o no autorizado, pose­sión, modificación o alteración de los datos por su parte.
f El Usuario Final acepta la obligación de fa-
cilitar a Ordenance Survey, en caso de que ésta se lo pida, información sobre los pro­ductos y/o servicios que contienen y/o que se deriven de los Productos Autorizados que ésta produce.
g Usted será responsable ante Ordenance
Survey si se certifica incumplimiento, por su parte, de alguno de los términos contra­ctuales anteriormente mencionados.
8 Disposiciones adicionales referentes únicamente a los Datos de Dinamarca.
No podrá utilizar los Datos para crear mapas en guías telefónicas, guías telefónicas u otros productos similares a dichas guías (p. ej. di­rectorios), incluidos aquellos en formato digi­tal.

únicamente a los Datos de Noruega.
No podrá utilizar los Datos para crear mapas digitales o impresos de uso general que sean similares a los productos nacionales básicos de la Autoridad Cartográfica Noruega. (Todo producto derivado de los Datos de Noruega será considerado similar a los productos na­cionales básicos de la Autoridad Cartográfica Noruega si dicho producto derivado tiene un alcance regional o nacional y, además, incluye un contenido, escalas y formato similares a los productos básicos nacionales de la Autori­dad Cartográfica Noruega.)

Miscelánea.

El presente es un Contrato exclusivo y comple­to entre los Cedentes de licencias y Usted con relación al objeto principal del mismo. Ningu­na disposición del presente Contrato implica la creación de una empresa conjunta, asocia­ción o relación director-agente entre los Ce­dentes de licencias y Usted. Los artículos 2 - 4 y 6 - 11 seguirán vigentes una vez vencido o terminado el presente Contrato. El presente Contrato sólo puede ser enmendado, alterado o modificado por PIONEER. Usted no podrá ceder ninguna parte del presente Contrato sin el consentimiento previo y escrito de PIONEER. Usted reconoce y comprende que los Datos podrán estar sujetos a restricciones de exportación y acepta el cumplimiento de toda ley de exportación aplicable. Si se deter­mina que una disposición, o parte de ella, del presente Contrato no es válida, es ilegal o no se puede hacer cumplir, dicha disposición o parte de la misma será eliminada del presente Contrato y el resto del Contrato será válido, legal y deberá cumplirse en la medida de lo posible. Cualquier notificación relativa a este Contrato se enviará por mensajero al Departa­mento de Asesoría Jurídica de PIONEER.
