1.3 SOFTWARE LICENSE AGREEMENT

Printing Software, Font Program and Host Software

This package contains the following materials provided by KONICA MINOLTA, INC. (KMI): software included as part of the printing system ("Printing Software"), the digitally-encoded machine-readable outline data en­coded in the special format and in the encrypted form ("Font Programs"), other software which runs on a computer system for use in conjunction with the Printing Software ("Host Software"), and related explanatory written materials ("Documentation"). The term "Software" shall be used to describe Printing Software, Font Programs and/or Host Software and also include any upgrades, modified versions, additions, and copies of the Software.
KMI grants to you a non-exclusive license to use the Software and Documentation, provided that you agree to the following:
This package may contain a software program or module owned by a third party. The provisions in this SOFT­WARE LICENSE AGREEMENT always take precedence if a license for the software program or module is provided in a document, such as a "User's Guide" separately from this SOFTWARE LICENSE AGREEMENT.
1. You may use this Software solely for your own internal business purposes.
2. You may make one backup copy of the Host Software, provided your backup copy is not installed or used on any computer. Notwithstanding the above restrictions, you may install the on any number of computers solely for use with one or more printing systems running the Printing Software.
3. You may assign its rights under this Agreement to an assignee of all of Licensee's right and interest to such Software and Documentation ("Assignee") provided you transfer to Assignee all copies of such Software and Documentation Assignee agrees to be bound by all of the terms and conditions of this Agreement.
4. You may not give, rent, lease or sublicense the "Software" or "Documentation" in all cases, unless oth­erwise set forth in Section 3 above.
5. You agree not to modify, adapt or translate the Software and Documentation.
6. You agree that you will not attempt to alter, disassemble, decrypt, reverse engineer or decompile the Software.
7. Title to and ownership of the Software and Documentation and any reproductions thereof shall remain with KMI and its licensor.
8. IN NO EVENT WILL KMI OR ITS LICENSOR BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCI­DENTAL INDIRECT, PUNITIVE OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVING, EVEN IF KMI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. KMI OR ITS LICENSOR DISCLAIMS ALL WARRANTIES WITH REGARD TO THE SOFTWARE, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION IMPLIED WAR­RANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-IN­FRINGEMENT OF THIRD PARTY RIGHTS. SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTIAL, CONSEQUENTIAL OR SPECIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
9. Notice to Government End Users: The Software is a "commercial item," as that term is defined at 48 C.F.R.2.101, consisting of "commercial computer software" and "commercial computer software doc­umentation," as such terms are used in 48 C.F.R. 12.212. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4, all U.S. Government End Users acquire the Software with only those rights set forth herein.
10. You agree that you will not export the Software in any form in violation of any applicable laws and reg­ulations regarding export control of any countries.

The softwares installed in this product comprise various independent software modules and components.
Each software module or component is copyrighted by the author, i.e. the one we wrote will be copywrited by us, and others will also be copywrited by each author.
This product uses some free softwares as a part of software components.
The following is information on the end user license agreement provided to the software components includ­ed in this product.

About License Granted to Each Software Component

The GPL, LGPL, OpenSSL, or Free Type Project (http://www.freetype.org/) license is granted to some of the software components included in this product. Grateful acknowledgements are due to the authors of those softwares, and to members of the community being engaged in data management and other activities con­cerning the softwares.
The GPL/LGPL is, as mentioned below, designed to guarantee (or even responsible for) the users that they can receive the source code whenever they want. For details, please refer to our homepage.

Printing Software, Font Program and Host Software

This package contains the following materials provided by KONICA MINOLTA, INC. (KMI): software included as part of the printing system ("Printing Software"), the digitally-encoded machine-readable outline data en­coded in the special format and in the encrypted form ("Font Programs"), other software which runs on a computer system for use in conjunction with the Printing Software ("Host Software"), and related explanatory written materials ("Documentation").
The term "Software" shall be used to describe Printing Software, Font Programs and/or Host Software and also include any upgrades, modified versions, additions, and copies of the Software.
This is a license agreement and not an agreement for sale. The Software is being licensed to you (either a private person or a corporate entity): under the terms of this Agreement. KMI grants to you a non-exclusive sublicense to use the Software and Documentation, provided that you agree to the following:
1. You may use the Software and accompanying Font Programs solely for your own internal business pur­poses.
2. In addition to the license for Font Programs set forth in Section 1 above, you may use Roman Font Pro­grams to reproduce weights, styles, and versions of letters, numerals, characters and symbols ("Type­faces") on the display or monitor for your own internal business purposes.
3. You may make one backup copy of the Host Software, provided your backup copy is not installed or used on any computer. Notwithstanding the above restrictions, you may install the Host Software on any number of computers solely for use with one or more printing systems running the Printing Soft­ware.
4. Systems Incorporated, a Delaware corporation, located at 345 Park Avenue, San Jose, CA 95110-2704 is a third-party beneficiary to this License Agreement to the extent that this agreement contains provisions which relate to your use of the Software, Font Programs and Typefaces. Such provisions are made expressly for the benefit of Adobe and are enforceable by Adobe in addition to KMI.

About This Software

PLEASE READ CAREFULLY THE LICENSE AGREEMENT BELOW BEFORE OPENING THE PACKAGE OF THIS SOFTWARE ("SOFTWARE"), DOWNLOADING, INSTALLING OR USING THE SOFTWARE. OPENING THE PACKAGE, OR DOWNLOADING, INSTALLING OR USING THE SOFTWARE SHALL BE DEEMED YOUR LAWFUL ACCEPTANCE OF THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT AGREE TO THEM, DO NOT DOWNLOAD, INSTALL, USE THE SOFTWARE, NOR OPEN THE PACKAGE.

1. COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS This is a license agreement and not an agreement for sale. KONICA MINOLTA, INC. ("Konica Minolta") owns, or has been licensed from other owners ("Konica Minolta Licensor"), copyrights and other intel­lectual property rights of the Software, and any and all rights and title to the Software and any copy made from it are retained by Konica Minolta or Konica Minolta Licensor. In no event, this Agreement shall be deemed to assign any copyright and/or any intellectual property rights of the Software from Konica Minolta or Konica Minolta Licensor to you. The Software is protected by copyright laws and in­ternational treaty provisions.
2. LICENSE Konica Minolta hereby grant to you a non-exclusive and limited license, and you may: (1) install and use the Software only on your computer(s) connected with Konica Minolta product for which this Software is designed; (2) allow users of the computers described above to use the Software, provided that you assure that all such users comply with the terms of this Agreement; (3) use the Software only for your own customary business or personal purpose; (4) make one copy of the Software only for backup purpose in the support of the normal and intended use of the Software. (5) transfer the Software to other party by transferring a copy of this Agreement and all documentation along with the Software, provided that (a) you must, at the same time, either transfer to such other party or destroy all your other copies of the Software, (b) such transfer of passession terminates your license from Konica Minolta, and (c) you must assure that such other party has agreed to accept the terms and conditions of this Agree­ment. If such other party does not accept such terms and conditions then you shall not transfer any copy of the Software.
3. RESTRICTIONS (1) You shall not without the written consent of KONICA MINOLTA: (i) use, copy, modify, merge or transfer copies of the Software except as provided herein; (ii) reverse engineer, reverse assemble, reverse compile or any other way analyze the Software; (iii) sublicense, rent, lease or distribute the Software or any copy thereof; or (iv) remove, use, or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in the Software.

(2) You agree that you will not export the Software in any form in violation of any applicable laws and regulations regarding export control of any country.
4. DISCLAIMER OF WARRANTIES (1) If the Software is furnished on CD-ROM(s) or other tangible object that is used for storage of digital data (hereinafter collectively "Storage Medium"), , Konica Minolta warrants the Storage Medium to be free from the defects in material and workmanship under normal use, for a period of ninety (90) days from the date of delivery to you. WITH THE EXCEPTION OF THE FOREGOING EXPRESS WARRANTIES APPLICABLE TO STORAGE MEDIUM ONLY, THE SOFTWARE IS PROVIDED TO YOU "AS IS" WITH­OUT ANY WARRANTIES WHATSOEVER. KONICA MINOLTA, ITS AFFILIATE COMPANIES AND KON­ICA MINOLTA LICENSOR DISCLAIM ALL WARRANTIES WITH REGARD TO THE SOFTWARE, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MER­CHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. (2) IN NO EVENT WILL KONICA MINOLTA, ITS AFFILIATE COMPANIES NOR KONICA MINOLTA LI­CENSOR BE LIABLE FOR ANY LOST PROFITS, LOST DATA, OR ANY OTHER INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM USE OR INABILITY TO USE THE SOFTWARE INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION OR ANY AND ALL OTHER COMMERCIAL OR OTHER DAMAGES OR LOSSES, EVEN IF KONICA MINOLTA, ITS AFFILIATE COMPANIES OR KONICA MI­NOLTA LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY YOU BASED ON A THIRD SUCH DAMAGES OR FOR ANY CLAIM BY YOU BASED ON A THIRD SUCH DAMAGES OR FOR ANY CLAIM BY YOU BASED ON A THIRD PARTY CLAIM. (3) The disclaimer of warranty hereunder does not affect your statutory rights. In case of the disclaimer is not allowed by applicable law, the disclaimer shall only apply to you to the maximum extent permitted by the law.
5. TERMINATION You may terminate this license at any time by destroying the Software and all your copies of it. This Agreement shall also terminate if you fail to comply with any terms hereof. Upon such termination, you must immediately destroy all copies of the Software in your possession.
6. GOVERNING LAW This Agreement shall be governed by the laws of Japan.
7. SEVERABILITY In the event that any part or parts of this agreement shall be held illegal or null and void by any court or administrative body of competent jurisdiction, such determination shall not effect the remaining parts of this agreement and they shall remain in full force and effect as if such part or parts determined illegal or void had not been included.

NOTICE TO US GOVERNMENT END USERS The Software is a "commercial item," as that term is defi ned at 48 C.F.R. 2.101 (October 1995), con­sisting of "commercial computer software" and "commercial computer software documentation," as such terms are used in 48 C.F.R. 12.212 (September 1995). Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995), all U.S. Government End Users shall acquire the Software with only those rights set forth herein. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. NEITHER PARTY SHALL BE BOUND BY ANY OTHER STATEMENTS OR REPRESENTATIONS THAT ARE INCONSISTENT WITH THE TERMS AND CONDI­TIONS OF THIS AGREEMENT. NO AMENDMENT TO THIS AGREEMENT IS EFFECTIVE UNLESS WRITTEN AND SIGNED BY PROPERLY AUTHORIZED REPRESENTATIVES OF EACH PARTY. NOTICE TO USER: PLEASE READ THIS CONTRACT CAREFULLY. BY USING ALL OR ANY PORTION OF THE SOFTWARE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE WITH THE TERMS OF THIS AGREEMENT, DO NOT USE THE SOFTWARE.
1. DEFINITIONS In this Agreement, "Adobe" means Adobe Systems Incorporated, a Delaware corporation,
located at 345 Park Avenue, San Jose, California 95110. "Software" means the software and related items with which this Agreement is provided.

1.3 SOFTWARE LICENSE AGREEMENT
2. LICENSE Subject to the terms of this Agreement, Adobe hereby grants you the worldwide, non-exclusive,
nontransferable, royalty-free license to use, reproduce and publicly display the Software. Adobe also grants you the rights to distribute the Software only (a) as embedded within digital image files and (b) on a stan­dalone basis. No other distribution of the Software is allowed; including, without limitation, distribution of the Software when incorporated into or bundled with any application software. All individual profiles must be ref­erenced by their ICC Profile description string. You may not modify the Software. Adobe is under no obliga­tion to provide any support under this Agreement, including upgrades or future versions of the Software or other items. No title to the intellectual property in the Software is transferred to you under the terms of this Agreement. You do not acquire any rights to the Software except as expressly set forth in this Agreement.
3. DISTRIBUTION If you choose to distribute the Software, you do so with the understanding that you agree
to defend, indemnify and hold harmless Adobe against any losses, damages or costs arising from any claims, lawsuits or other legal actions arising out of such distribution, including without limitation, your failure to com­ply with this Section 3. If you distribute the Software on a standalone basis, you will do so under the terms of this Agreement or your own license agreement which (a) complies with the terms and conditions of this Agreement; (b) effectively disclaims all warranties and conditions, express or implied, on behalf of Adobe; (c) effectively excludes all liability for damages on behalf of Adobe; (d) states that any provisions that differ from this Agreement are offered by you alone and not Adobe and (e) states that the Software is available from you or Adobe and informs licensees how to obtain it in a reasonable manner on or through a medium customarily used for software exchange. Any distributed Software will include the Adobe copyright notices as included in the Software provided to you by Adobe.

4. DISCLAIMER OF WARRANTY Adobe licenses the Software to you on an "AS IS" basis. Adobe makes no
representation as to the adequacy of the Software for any particular purpose or to produce any particular result. Adobe shall not be liable for loss or damage arising out of this Agreement or from the distribution or use of the Software or any other materials. ADOBE AND ITS SUPPLIERS DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE SOFTWARE, EXCEPT FOR ANY WARRANTY, CONDITION, REPRESENTATION OR TERM TO THE EXTENT TO WHICH THE SAME CANNOT OR MAY NOT BE EXCLUDED OR LIMITED BY LAW APPLICABLE TO YOU IN YOUR JURISDICTION, ADOBE AND ITS SUPPLIERS MAKE NO WARRANTIES, CONDITIONS, REPRESENTATIONS OR TERMS, EXPRESS OR IMPLIED, WHETHER BY STATUTE, COMMON LAW, CUSTOM, USAGE OR OTHERWISE AS TO ANY OTHER MATTERS, INCLUDING BUT NOT LIMITED TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS, INTEGRATION, SATISFACTORY QUALITY OR FITNESS FOR ANY PARTICULAR PURPOSE. 5. LIMITATION OF LIABILITY IN NO EVENT WILL ADOBE OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY
DAMAGES, CLAIMS OR COSTS WHATSOEVER OR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL DAM­AGES, OR ANY LOST PROFITS OR LOST SAVINGS, EVEN IF AN ADOBE REPRESENTATIVE HAS BEEN AD­VISED OF THE POSSIBILITY OF SUCH LOSS, DAMAGES, CLAIMS OR COSTS OR FOR ANY CLAIM BY ANY THIRD PARTY. THE FOREGOING LIMITATIONS AND EXCLUSIONS APPLY TO THE EXTENT PERMIT­TED BY APPLICABLE LAW IN YOUR JURISDICTION. ADOBE'S AGGREGATE LIABILITY AND THAT OF ITS SUPPLIERS UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT PAID FOR THE SOFTWARE. Nothing contained in this Agreement limits Adobe's liability to you in the event of death or personal injury resulting from Adobe's negligence or for the tort of deceit (fraud). Adobe is acting on behalf of its suppliers for the purpose of disclaiming, excluding and/or limiting obligations, warranties and liability as provided in this Agreement, but in no other respects and for no other purpose.
6. TRADEMARKS Adobe and the Adobe logo are the registered trademarks or trademarks of Adobe in the
United States and other countries. With the exception of referential use, you will not use such trademarks or any other Adobe trademark or logo without separate prior written permission granted by Adobe.
7. TERM This Agreement is effective until terminated. Adobe has the right to terminate this Agreement imme-

All rights to use the Software are granted on condition that such rights are forfeited if you fail to comply with the terms of this Agreement.
9. GOVERNING LAW This Agreement will be governed by and construed in accordance with the substantive
laws in force in the State of California as such laws are applied to agreements entered into and to be per­formed entirely within California between California residents. This Agreement will not be governed by the conflict of law rules of any jurisdiction or the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. All disputes arising out of, under or related to this Agreement will be brought exclusively in the state Santa Clara County, California, USA.
10. GENERAL You may not assign your rights or obligations granted under this Agreement without the prior
written consent of Adobe. None of the provisions of this Agreement shall be deemed to have been waived by any act or acquiescence on the part of Adobe, its agents, or employees, but only by an instrument in writing signed by an authorized signatory of Adobe. When conflicting language exists between this Agreement and any other agreement included in the Software, the terms of such included agreement shall apply. If either you or Adobe employs attorneys to enforce any rights arising out of or relating to this Agreement, the prevailing party shall be entitled to recover reasonable attorneys' fees. You acknowledge that you have read this Agree­ment, understand it, and that it is the complete and exclusive statement of your agreement with Adobe which supersedes any prior agreement, oral or written, between Adobe and you with respect to the licensing to you of the Software. No variation of the terms of this Agreement will be enforceable against Adobe unless Adobe gives its express consent, in writing, signed by an authorized signatory of Adobe.

The ICC profiles used in the Altona Test Suite Application Kit were created on the basis of the Characterisa­tion Data (11.2) with the profile software "Print Open" of Heidelberger Druckmaschinen AG. The following li­cense conditions must be observed for the use of the profiles.

1 Definition
1.1 For generic ICC profiles for the profiling of standard printing conditions which have been produced with
software of Heidelberger Druckmaschinen AG ("HEIDELBERG") ("PROFILES"), HEIDELBERG agrees to a free distribution and use of the PROFILES, on condition that the distributor and/or user ("LICENSEE") agrees to the following terms.
1.2 Standard printing conditions within the meaning of this LICENSE are standards defined by international
or national standardisation bodies such as ISO 12647 and the respective parts thereof or are a de facto standards in certain regions of the world.
2 Scope of the Right of Use
2.1 HEIDELBERG grants the LICENSEE a non-exclusive right to use the PROFILES.
2.2 The LICENSEE is allowed to redistribute the PROFILES and to transfer this Right of Use to a third party

3 Exclusion of other Use
3.1 It is explicitly prohibited to charge any kind of remuneration for the distribution of these PROFILES.
3.2 It is not allowed to edit these PROFILES or to change the entries in the profile tags or to use the inherent
technical solutions for any purpose other than the actual purpose of an ICC profile. If the PROFILES will be sold bundled together with commercial software, then it is not allowed to charge an extra price for the PRO­FILES.

2. Ownership

All rights not specifically granted in this License Agreement, including all copyrights, are reserved by DIC.
3. Term
a. This License Agreement is effective until terminated.B
b. You may terminate this License Agreement by notifying DICG in writing of your intention to terminate this License Agreement and by destroying, all copies of the Profile in your possession or control.

c. In such event, you must immediately stop using the Profile and destroy all copies of the Profile in your possession or control.
d. All provisions in this License Agreement relating to warranty disclaimers (Section 5) and the limitation of liability (Section 6) shall survive any termination of this License Agreement.
4. License Method and Restrictions
a. You may install and use the Profile on a single desktop computer; provided, however, that, notwithstanding anything contrary contained herein, you may not use the Profile on any network system or share, install or use the Profile concurrently on different computers, or electronically transfer the Profile from one computer to another or over a network.
b. You may not make or distribute copies, fix, alter, merge, modify, adapt, sublicense, transfer, sell, rent, lease, gift or distribute all or a portion of the Profile, or modify the Profile or create derivative works based upon the Profile.
c. You acknowledge that the Profile is not intended for any usage which may cause death or physical injury or environmental damage and agree not to use the Profile for such usage.
d. You shall not use the Profile to develop any software or other technology having the same primary function as the Profile, including but not limited to using the Profile in any development or test procedure that seeks to develop like software or other technology, or to determine if such software or other technology performs in a similar manner as the Profile.
e. DIC, DICG and other trademarks contained in the Profile are trademarks or registered trademarks of DIC and DICG in Japan and/or other countries. You may not remove or alter any trademark, trade names, product names, logo, copyright or other proprietary notices, legends, symbols or labels in the Profile. This License Agreement does not authorize you to use DIC, DICG or their licensors' names or any of their respective trade­marks.

5. WARRANTY DISCLAIMER
a. THE PROFILE IS PROVIDED TO YOU FREE OF CHARGE, AND ON AN "AS-IS" BASIS, IN ACCORDANCE WITH THE TERMS AND COONDITIONS OF THIS LICENSE AGREEMENT. DIC AND DICG PROVIDE NO TECHNICAL SUPPORT, WARRANTIES OR REMEDIES FOR THE PROFILE.
b. DIC AND DICG DISCLAIM ALL WARRANTIES AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY OR FIT­NESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE AND QUIET ENJOYMENT. You agree that any varying or additional terms contained in any written notification or document is­sued by you in relation to the Profile licensed hereunder shall be of no effect.
c. The failure or delay of DIC or DICG to exercise any of its rights under this License Agreement or upon any breach of this License Agreement shall not be deemed a waiver of those rights or of the breach.

The use of Software in systems and solutions that provide dedicated functionality (other than as mentioned above) or designed for use in embedded or function-specific software applications, for example but not limited to: Software embedded in or bundled with industrial control systems, wireless mobile telephones, wireless handheld devices, netbooks, kiosks, TV/STB, Blu-ray Disc devices, telematics and network control switching equipment, printers and storage management systems, and other related systems are excluded from this definition and not licensed under this Agreement. "Programs" means (a) Java technology applets and applications intended to run on the Java Platform Standard Edition (Java SE) platform on Java-enabled General Purpose Desktop Computers and Servers, and (b) JavaFX technology applications intended to run on the JavaFX Runtime on JavaFX-enabled General Purpose Desktop Computers and Servers.

2. LICENSE TO USE. Subject to the terms and conditions of this Agreement, including, but not limited to
the Java Technology Restrictions of the Supplemental License Terms, Sun grants you a non-exclusive, non­transferable, limited license without license fees to reproduce and use internally Software complete and unmodified for the sole purpose of running Programs. Additional licenses for developers and/or publishers are granted in the Supplemental License Terms.
3. RESTRICTIONS. Software is confidential and copyrighted. Title to Software and all associated intellectual
property rights is retained by Sun and/or its licensors. Unless enforcement is prohibited by applicable law, you may not modify, decompile, or reverse engineer Software. You acknowledge that Licensed Software is not designed or intended for use in the design, construction, operation or maintenance of any nuclear facility. Sun Microsystems, Inc. disclaims any express or implied warranty of fitness for such uses. No right, title or interest in or to any trademark, service mark, logo or trade name of Sun or its licensors is granted under this Agreement. Additional restrictions for developers and/or publishers licenses are set forth in the Supplemental License Terms.
4. LIMITED WARRANTY. Sun warrants to you that for a period of ninety (90) days from the date of purchase,
as evidenced by a copy of the receipt, the media on which Software is furnished (if any) will be free of defects in materials and workmanship under normal use. Except for the foregoing, Software is provided "AS IS". Your exclusive remedy and Sun's entire liability under this limited warranty will be at Sun's option to replace Software media or refund the fee paid for Software. Any implied warranties on the Software are limited to 90 days. Some states do not allow limitations on duration of an implied warranty, so the above may not apply to you. This limited warranty gives you specific legal rights. You may have others, which vary from state to state.
5. DISCLAIMER OF WARRANTY. UNLESS SPECIFIED IN THIS AGREEMENT, ALL EXPRESS OR IMPLIED

1.3 SOFTWARE LICENSE AGREEMENT
The foregoing limitations will apply even if the above stated warranty fails of its essential purpose. Some states do not allow the exclusion of incidental or consequential damages, so some of the terms above may not be applicable to you.
7. TERMINATION. This Agreement is effective until terminated. You may terminate this Agreement at any
time by destroying all copies of Software. This Agreement will terminate immediately without notice from Sun if you fail to comply with any provision of this Agreement. Either party may terminate this Agreement immediately should any Software become, or in either party's opinion be likely to become, the subject of a claim of infringement of any intellectual property right. Upon Termination, you must destroy all copies of Software.
8. EXPORT REGULATIONS. All Software and technical data delivered under this Agreement are subject to
US export control laws and may be subject to export or import regulations in other countries. You agree to comply strictly with all such laws and regulations and acknowledge that you have the responsibility to obtain such licenses to export, re-export, or import as may be required after delivery to you.
9. TRADEMARKS AND LOGOS. You acknowledge and agree as between you and Sun that Sun owns the
SUN, SOLARIS, JAVA, JINI, FORTE, and iPLANET trademarks and all SUN, SOLARIS, JAVA, JINI, FORTE, and iPLANET-related trademarks, service marks, logos and other brand designations ("Sun Marks"), and you agree to comply with the Sun Trademark and Logo Usage Requirements currently located at http://www.sun.com/policies/trademarks. Any use you make of the Sun Marks inures to Sun's benefit.
10. U.S. GOVERNMENT RESTRICTED RIGHTS. If Software is being acquired by or on behalf of the U.S.
Government or by a U.S. Government prime contractor or subcontractor (at any tier), then the Government's rights in Software and accompanying documentation will be only as set forth in this Agreement; this is in accordance with 48 CFR 227.7201 through 227.7202-4 (for Department of Defense (DOD) acquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD acquisitions).

11. GOVERNING LAW. Any action related to this Agreement will be governed by California law and
controlling U.S. federal law. No choice of law rules of any jurisdiction will apply.
12. SEVERABILITY. If any provision of this Agreement is held to be unenforceable, this Agreement will
remain in effect with the provision omitted, unless omission would frustrate the intent of the parties, in which case this Agreement will immediately terminate.
13. INTEGRATION. This Agreement is the entire agreement between you and Sun relating to its subject
matter. It supersedes all prior or contemporaneous oral or written communications, proposals, representations and warranties and prevails over any conflicting or additional terms of any quote, order, acknowledgment, or other communication between the parties relating to its subject matter during the term of this Agreement. No modification of this Agreement will be binding, unless in writing and signed by an authorized representative of each party.
SUPPLEMENTAL LICENSE TERMS
These Supplemental License Terms add to or modify the terms of the Binary Code License Agreement. Capitalized terms not defined in these Supplemental Terms shall have the same meanings ascribed to them in the Binary Code License Agreement . These Supplemental Terms shall supersede any inconsistent or conflicting terms in the Binary Code License Agreement, or in any license contained within the Software.
A. Software Internal Use and Development License Grant. Subject to the terms and conditions of this Agreement and restrictions and exceptions set forth in the Software "README" file incorporated herein by reference, including, but not limited to the Java Technology Restrictions of these Supplemental Terms, Sun grants you a non-exclusive, non-transferable, limited license without fees to reproduce internally and use internally the Software complete and unmodified for the purpose of designing, developing, and testing your Programs.
B. License to Distribute Software. Subject to the terms and conditions of this Agreement and restrictions and exceptions set forth in the Software README file, including, but not limited to the Java Technology Restrictions of these Supplemental Terms, Sun grants you a non-exclusive, non-transferable, limited license without fees to reproduce and distribute the Software (except for the JavaFX Runtime), provided that (i) you distribute the Software complete and unmodified and only bundled as part of, and for the sole purpose of running, your Programs, (ii) the Programs add significant and primary functionality to the Software, (iii) you do not distribute additional software intended to replace any component(s) of the Software, (iv) you do not remove or alter any proprietary legends or notices contained in the Software, (v) you only distribute the Software subject to a license agreement that protects Sun's interests consistent with the terms contained in this Agreement, and (vi) you agree to defend and indemnify Sun and its licensors from and against any damages, costs, liabilities, settlement amounts and/or expenses (including attorneys' fees) incurred in connection with any claim, lawsuit or action by any third party that arises or results from the use or distribution of any and all Programs and/or Software.

1.3 SOFTWARE LICENSE AGREEMENT
C. Java Technology Restrictions. You may not create, modify, or change the behavior of, or authorize your licensees to create, modify, or change the behavior of, classes, interfaces, or subpackages that are in any way identified as "java", "javax", "sun" or similar convention as specified by Sun in any naming convention designation.
D. Source Code. Software may contain source code that, unless expressly licensed for other purposes, is provided solely for reference purposes pursuant to the terms of this Agreement. Source code may not be redistributed unless expressly provided for in this Agreement.
E. Third Party Code. Additional copyright notices and license terms applicable to portions of the Software are set forth in the THIRDPARTYLICENSEREADME.txt file. In addition to any terms and conditions of any third party opensource/freeware license identified in the THIRDPARTYLICENSEREADME.txt file, the disclaimer of warranty and limitation of liability provisions in paragraphs 5 and 6 of the Binary Code License Agreement shall apply to all Software in this distribution.

jre/lib/audio/soundbank.gm This MIDI soundbank is present in the JDK, but it has been removed from the Java SE Runtime Environment in order to reduce the size of the Runtime Environment's download bundle. However, a soundbank file is necessary for MIDI playback, and therefore the JDK's soundbank.gm file may be included in redistributions of the Runtime Environment at the vendor's discretion. Provided that Recipient is in compliance with the terms of this License, Recipient may, so long as without derogation of any of SGI's rights in and to the Original Code, distribute the source code and/or executable version(s) of Covered Code under (1) this License; (2) a license identical to this License but for only such changes as are necessary in order to clarify Recipient's role as licensor of Modifications; and/or (3) a license of Recipient's choosing, containing terms different from this License, provided that the license terms include this Section 3 and Sections 4, 6, 7, 10, 12, and 13, which terms may not be modified or superseded by any other terms of such license. If Recipient elects to use any license other than this License, Recipient must make it absolutely clear that any of its terms which differ from this License are offered by Recipient alone, and not by SGI. It is emphasized that this License is a limited license, and, regardless of the license form employed by Recipient in accordance with this Section 3.2, Recipient may relicense only such rights, in Original Code and Modifications by SGI, as it has actually been granted by SGI in this License.
3.3 Indemnity. Recipient hereby agrees to indemnify SGI for any liability incurred by SGI as a result of any such alternative license terms Recipient offers.
4. Termination. This License and the rights granted hereunder will terminate automatically if Recipient breaches any term herein and fails to cure such breach within 30 days thereof. Any sublicense to the Covered Code that is properly granted shall survive any termination of this License, absent termination by the terms of such sublicense. Provisions that, by their nature, must remain in effect beyond the termination of this License, shall survive.
5. No Trademark Or Other Rights. This License does not grant any rights to: (i) any software apart from the Covered Code, nor shall any other rights or licenses not expressly granted hereunder arise by implication, estoppel or otherwise with respect to the Covered Code; (ii) any trade name, trademark or service mark whatsoever, including without limitation any related right for purposes of endorsement or promotion of products derived from the Covered Code, without prior written permission of SGI; or (iii) any title to or ownership of the Original Code, which shall at all times remains with SGI. All rights in the Original Code not expressly granted under this License are reserved.
6. Compliance with Laws; Non-Infringement. There are various worldwide laws, regulations, and executive orders applicable to dispositions of Covered Code, including without limitation export, re-export, and import control laws, regulations, and executive orders, of the U.S. government and other countries, and Recipient is reminded it is obliged to obey such laws, regulations, and executive orders. Recipient may not distribute Covered Code that (i) in any way infringes (directly or contributorily) any intellectual property rights of any kind of any other person or entity
