These Terms of Sale ("Agreement") apply to your purchase of products and/or services and
support ("Product") sold in the United States by Dell, including its affiliates or subsidiaries. By
placing your order for Product, you accept and are bound to the terms of this Agreement. If you
have placed an order but do not wish to be subject to these Terms of Sale, you must promptly
cancel your order before it enters production and becomes non-cancellable (see:
www.dell.com/ordersupport), or return your purchase in accordance with Dell’s Return Policy
(see: www.dell.com/returnpolicy) within 21 days of the invoice date for a refund of your purchase
price minus shipping, handling, and up to a 15% restocking fee.

2 Payment Terms; Orders; Quotes; Interest. Terms of payment are within Dell's sole
discretion, and unless otherwise agreed to by Dell, payment must be received by Dell prior
to Dell's acceptance of an order. Payment for the products will be made by credit card, wire
transfer, or some other prearranged payment method unless credit terms have been agreed
to by Dell. Invoices are due and payable within the time period noted on your invoice,
measured from the date of the invoice. Dell may invoice parts of an order separately. Your
order is subject to cancellation by Dell, in Dell's sole discretion. Unless you and Dell have
agreed to a different discount, Dell's standard pricing policy for Dell-branded systems,
which include both hardware and services in one discounted price, allocates the discount
off list price applicable to the service portion of the system to be equal to the overall
calculated percentage discount off list price on the entire system. Dell is not responsible
for pricing, typographical, or other errors in any offer by Dell and reserves the right to
cancel any orders arising from such errors. Invoices must be paid within 30 days of the
invoice date.
3 Shipping Charges; Taxes; Title; Risk of Loss. Shipping, handling and tax are additional
unless otherwise expressly indicated at the time of sale. Title to products passes from Dell
to Customer upon shipment to Customer. Loss or damage that occurs during shipping by
a carrier selected by Dell is Dell's responsibility. Loss or damage that occurs during
shipping by a carrier selected by you is your responsibility. You must notify Dell within
21 days of the date of your invoice or acknowledgement if you believe any part of your

Return Policies; Exchanges

relationships which result from this agreement, Dell's advertising, or any related purchase
SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS, WITHOUT
REGARD TO CONFLICTS OF LAW.
13 Dispute Resolution and Binding Arbitration
YOU AND DELL ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE
CLAIMS IN A COURT OR BEFORE A JURY OR TO PARTICIPATE IN A CLASS
ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER
RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS ACCESS
TO DISCOVERY, MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN
ARBITRATION.

are not signatories to this Agreement), Dell's advertising, or any related purchase SHALL BE
RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION
ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) or JAMS.
Arbitration proceedings shall be governed by this provision and the applicable procedures of

The arbitrator shall be empowered to grant whatever relief would be available in court under
law or in equity. This transaction shall be governed by the Federal Arbitration Act 9 U.S.C.

parties, and may be entered as a judgment in any court of competent jurisdiction. Dell will be
responsible for paying any individual consumer's arbitration fees. If you prevail on any claim
that affords the prevailing party attorneys' fees, the arbitrator may award reasonable fees to

Product, which may include technology and software, is subject to U.S. export laws as well
as the laws of the country where it is delivered or used. Product may not be sold, leased, or
transferred to restricted countries, restricted end-users, or for restricted end-uses. You
agree that Product will not to be used for activities related to weapons of mass destruction,
including activities related to the design, development, production or use of nuclear
materials, nuclear facilities, or nuclear weapons, or chemical or biological weapons. You
further agree that you will not sell, lease, or otherwise transfer Product to end-users
engaged in these activities.

9 Governing Law. THE PARTIES AGREE THAT THIS AGREEMENT, THE PURCHASE
AND USE OF THE PRODUCT, OR ANY CLAIM, DISPUTE OR CONTROVERSY
(WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING,
PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER
PROTECTION, COMMON LAW, AND EQUITABLE CLAIMS) BETWEEN
CUSTOMER AND DELL arising from or relating to this Agreement, its interpretation, or
the breach, termination or validity thereof, the relationships which result from this
Agreement, Customer's purchase or use of the Product, Dell's advertising, or any related
purchase SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS,
WITHOUT REGARD TO CONFLICTS OF LAW.
10 Dispute Resolution and Binding Arbitration.
YOU AND DELL ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE
CLAIMS IN A COURT OR BEFORE A JURY OR TO PARTICIPATE IN A CLASS
ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM.
OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH
AS ACCESS TO DISCOVERY, MAY ALSO BE UNAVAILABLE OR MAY BE
LIMITED IN ARBITRATION.
ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT,
OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND
INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW,
INTENTIONAL TORT, INJUNCTIVE, AND EQUITABLE CLAIMS) BETWEEN
CUSTOMER AND DELL, its agents, employees, principals, successors, assigns, affiliates
(collectively for purposes of this paragraph, "Dell") arising from or relating to this
Agreement, its interpretation, or the breach, termination or validity thereof, the
relationships which result from this Agreement (including, to the full extent permitted by
applicable law, relationships with third parties who are not signatories to this Agreement),
Customer's purchase or use of the Product, Dell's advertising, or any related purchase
SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION
ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) or
JAMS. Arbitration proceedings shall be governed by this provision and the applicable
procedures of the selected arbitration administrator, including any applicable procedures
for consumer-related disputes, in effect at the time the claim is filed. Consumer claimants
(individuals whose transaction is intended for personal, family, or household use) may
elect to pursue their claims in small-claims court rather than arbitration. The arbitration
or small-claims court proceeding will be limited solely to the individual dispute or
controversy between Customer and Dell.
You agree to an arbitration on an individual basis. In any dispute, NEITHER CUSTOMER
NOR DELL SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR
AGAINST OTHER CUSTOMERS, OR ARBITRATE ANY CLAIM AS A CLASS
REPRESENTATIVE, CLASS MEMBER, OR IN A PRIVATE ATTORNEY GENERAL
CAPACITY. If any provision of this arbitration agreement is found unenforceable, the
unenforceable provision shall be severed, and the remaining arbitration terms shall be
enforced (but in no case shall there be a class arbitration).

The arbitrator shall be empowered to grant whatever relief would be available in court
under law or in equity. This transaction shall be governed by the Federal Arbitration Act 9
U.S.C. sec. 1-16 (FAA). Any award of the arbitrator(s) shall be final and binding on each of
the parties, and may be entered as a judgment in any court of competent jurisdiction. Dell
will be responsible for paying any individual consumer’s arbitration fees. If you prevail on
any claim that affords the prevailing party attorneys' fees, the arbitrator may award you
reasonable fees under the standards for fee shifting provided by law. For information on

Limited Warranty for Dell-Branded Hardware Products (U.S. Only)
Dell-branded hardware products purchased in the U.S. come with either a 90-day, 1-year, 2-year,
3-year, 4-year, or 5-year limited hardware warranty. To determine which warranty came with your
hardware product(s), see your packing slip, invoice, receipt, or other sales documentation.
What is covered by this limited warranty?
This limited hardware warranty covers defects in materials and workmanship in your Dell-branded
hardware products, including Dell-branded peripheral products.
This limited hardware warranty does not cover:
•Software, including without limitation the operating system and software added to the
Dell-branded hardware products through our factory-integration system, third-party
software, or the reloading of software
•Non-Dell-branded products and accessories
•Problems that result from:
–External causes such as accident, abuse, misuse, or problems with electrical power
–Servicing not authorized by Dell
–Usage that is not in accordance with product instructions
–Failure to follow the product instructions or failure to perform preventive
maintenance
–Problems caused by using accessories, parts, or components not supplied by Dell
•Products with missing or altered Service Tags or serial numbers

How long does this limited warranty last?
This limited hardware warranty lasts for the time period indicated on your packing slip, invoice,
or receipt, except for the following Dell-branded hardware:
•The warranty for print head that is included as original equipment in the Dell mobile
printer is for parts only and is effective for a period of 1 year after the date of purchase of
the printer or 1000 prints of printer usage, whichever occurs first.
•Portable computer batteries carry the lesser of either a 1-year limited hardware warranty or
the length of the limited hardware warranty for the Dell computer with which the battery
is shipped.
•The limited hardware warranty for Power Adapters purchased independent of a system is
one year. Power Adapters purchased with a system are covered by the system limited
hardware warranty.
•Your Series 5, 6, or 7 PERC controller battery may provide up to 72 hours of controller
cache memory backup power when new. Under the 1-year limited hardware warranty, we
warrant that the battery will provide at least 24 hours of backup coverage during the 1-year
limited hardware warranty period.
•Projector lamps carry a 90-day limited hardware warranty.
•Dell-certified and Dell-branded memory purchased separately from a Dell system
("Dell-Certified Memory") carries a lifetime limited hardware warranty.
•Memory carries a limited hardware warranty of 3 years.
•The limited hardware warranty for monitors purchased independently of a system lasts for
the time period indicated on your packing slip or invoice. Monitors purchased
with a system are covered by the system limited hardware warranty.
•PDAs, earphones, and remote inline controls carry a 1-year limited hardware warranty.
•Other add-on hardware carries the longer of either a 1-year limited hardware warranty for
new parts and a 90-day limited hardware warranty for reconditioned parts or, for both new
and reconditioned parts, the remainder of the warranty for the Dell computer on which
such parts are installed.
•Headsets with Bluetooth
hardware warranty or the length of the limited hardware warranty for the Dell computer
with which the headset, as applicable, is shipped.

PowerEdge R510, PowerEdge R610, PowerEdge R710, PowerEdge M610, PowerEdge M710
and PowerVault NX300) carry the lesser of either a 1-year limited hardware warranty or the
length of the limited hardware warranty for the Dell system with which the SATA hard
drive is shipped. Service offerings may be available to extend the SATA hard drive warranty
period on these systems for an additional fee.
•All variants of ioDrive® NAND Flash devices carry the length of the limited hardware
warranty coverage for the Dell system with which the ioDrive® NAND Flash device is
shipped. ioDrive® NAND Flash devices are not eligible for purchase of extended warranty
coverage beyond a total of 5 years of coverage from the original shipment date.
Additionally, ioDrive NAND Flash devices uses as silicon technology which has a
maximum number of physical bytes which can be written to the device (the "Rated Life").
The applicable limited hardware warranty covers failures due to defects in workmanship
and/or materials, but does not cover problems related to the device reaching its maximum
Rated Life. ioDrive is a registered trademark of Fusion-io.
The limited hardware warranty on all Dell-branded products purchased directly from Dell begins
on the date of the packing slip, invoice, receipt, or other sales documentation. For products
purchased from third party retailers or resellers, the limited hardware warranty begins on the date
of your original sales receipt. The warranty period is not extended if we repair or replace a
warranted product or any parts. Dell may change the availability of limited hardware warranties,
at its discretion, but any changes will not be retroactive.
What do I do if I need warranty service?
Before the warranty expires, please contact us or our authorized representatives according to the
following table. Long distance telephone carrier charges may apply. Please also have your Dell
Service Tag or order number available.
If you purchased through a retailer (not directly from Dell), you may be required to provide Dell
with your original sales receipt from your purchase to receive any warranty service from Dell.
If you purchased through Best Buy, you must have all original sales receipts from your purchase to
receive any warranty service at a Best Buy store. Please also have your Dell Service Tag or order
number available.

What will Dell do?
Prior to contacting Dell, please consult your product documentation or http://dell.com/support
for troubleshooting advice and directions on running hardware diagnostics.
Upon contacting Dell technical support, you will be required to engage in a remote diagnosis
session with the tech support agent to help determine the cause of your issue. Remote diagnosis
may involve customer access to the inside of the product and multiple or extended sessions.
If the Dell technical support agent determines that your issue is the result of a defect in materials
or workmanship but the issue is not able to be resolved remotely, Dell, at its sole discretion, may
dispatch a replacement part to you, arrange for you to send your product or defective part back to
Dell’s repair depot, or replace the product with a comparable product that may be new or
refurbished. For Alienware customers only, Dell may also elect to dispatch a service technician to
your location to perform the repair (see Important Information about In-Home Service After
Remote Diagnosis).
If we determine that the problem is not covered under this limited hardware warranty, we may be
able to offer you service alternatives on a fee basis.
We use new and refurbished parts made by various manufacturers in performing warranty repairs
and in building replacement parts and products. Refurbished parts and products are parts or
products that have been returned to Dell, some of which were never used by a customer. All parts
and products are inspected and tested for quality. Replacement parts and products are covered
for the remaining period of the limited hardware warranty for the product you purchased. Dell
owns all parts removed from repaired products and, in most instances, you will be required to
return defective parts to Dell.
Dell may use authorized representatives to provide any of the technical support or repair services
under this limited hardware warranty.
Important Information about Returning Products to Dell for Repair or Replacement:
Upon a determination by a Dell technical support agent that your product should be returned to
Dell for repair or replacement, we will issue a Return Material Authorization Number which you
must include with your return. You must return the products to us in their original or equivalent
packaging, prepay shipping charges, and insure the shipment or accept the risk if the product is
lost or damaged in shipment. We will return the repaired or replacement products to you. We will
pay to ship the repaired or replaced products to you if you use an address in the United States
(excluding Puerto Rico and U.S. possessions and territories). Otherwise, we will ship the product
to you freight collect. When you contact us regarding certain products, such as smartphones or
tablet products, we may offer to ship you a replacement product prior to receiving your original
product back. In such instance, we may require a valid credit card number at the time you request
a replacement product. We will not charge or invoice you for the replacement product as long as
you return the original product to us within 10 days of your receipt of the replacement product
and we confirm that your product issue is covered under this limited hardware warranty. If we do
not receive your original product within 10 days, we will charge to your credit card or invoice you
for the then-current standard price for the product. If upon receipt of your original product, we
determine that your product issue is not covered under this limited hardware warranty, you will
be given the opportunity to return the replacement unit, at your sole expense, within ten (10)
days from the date we contact you regarding the lack of coverage for your issue or we will charge
to your credit card or invoice you the then current standard price for the product. In addition, if

you fail to pay Dell the amounts due in connection with such an invoice, Dell may suspend your
limited hardware warranty support until the invoice amount is paid. A suspension of your limited
hardware warranty for failure to properly return a product will not toll the term of your limited
hardware warranty, and the limited hardware warranty will still expire in accordance with its
original term.
NOTE: Before you ship the product(s) to us, make sure to back up the data on the hard
drive(s) and any other storage device(s) in the product(s). Remove any confidential,
proprietary, or personal information and removable media such as floppy disks, CDs, or PC
Cards. We are not responsible for any of your confidential, proprietary, or personal
information; lost or corrupted data; or damaged or lost removable media. Please only include
the product components requested by the phone technician.
Important Information about In-Home Service after Remote Diagnosis
(Alienware customers only):
If Dell determines that your issue is covered under this limited hardware warranty and the
technician cannot correct your problem over the phone or, if applicable, by dispatching a part or
replacement product to you, then Dell may dispatch a service technician to your location within
the United States (including Puerto Rico, but excluding the other U.S. possessions and
territories). Please tell the technician the full address of your system's location. Both the
performance of service and service response times depend upon the time of day your call is
received by Dell, the service alternative you purchased, parts availability, geographical
restrictions, weather conditions and the terms of this limited hardware warranty. An adult must
be present at all times during the service technician’s visit. You must grant the service technician
full access to the system and (at no cost to Dell) have working space, electricity, and a local
telephone line. If these requirements are lacking, Dell is not obligated to provide service. In
addition, Dell is not obligated to provide service if you fail to provide an environment that is
conducive to computer repair, including for example, if you insist on service to be provided at
varying locations, if you fail to properly restrain a pet, if you threaten our technician either
verbally or physically, if your location or the general area where the system is located is dangerous,
infested with insects, rodents pests, biohazards, human or animal excrement and/or chemicals as
reasonably determined to be unsafe by our technician. If you or your authorized representative is
not at the location when the service technician arrives, the service technician will not be able to
service your system and you may be charged an additional amount for a follow-up service call.
If the telephone technician determines that your system needs a replacement part, you authorize
the on-site technician to act as your service agent to handle the delivery and return of the
warranty parts necessary to render on-site repairs. You may incur a charge if you fail to allow the
on-site technician to return non-working/unused units/warranty parts to Dell.
What if I purchased a service contract?
If your service contract is with Dell, service will be provided to you under the terms of the service
agreement. Please refer to that contract for details on how to obtain service.

May I transfer the limited warranty?
Limited warranties on systems may be transferred if the current owner transfers ownership of

Dell Return Policy (U.S. Only)
Dell values its relationship with you and offers you the option to return most products you
purchase directly from Dell. You may return eligible products for a credit or a refund of the
purchase price paid, less shipping and handling and any applicable restocking fees, as set forth in
detail below.
21-Day Return Period for Certain Hardware and Software Products and Accessories: Unless you
have a separate agreement with Dell, or except as provided below, all hardware, accessories,
peripherals, parts and media-based software (provided that the software is unopened and still in
its sealed package or, if delivered electronically, software you have not accepted by clicking the "I
agree to these Terms and Conditions" button), may be returned within 21 days from the date on
the packing slip or invoice for a credit or a refund of the purchase price paid, less shipping and
handling and any applicable restocking fees (as further described below). Any product returned
to Dell without prior authorization from Dell will be considered an unauthorized return, and the
customer will not receive credit for the product and Dell will not ship the product back to you.

Dell may be returned within 30 days from the date on the packing slip or invoice.

from divisions designated by Dell as Commercial or Public may be returned within 30 days
from the date on the packing slip or invoice.
•Application software and operating systems that have been installed by Dell may be
returned only if installed on a returnable system, and only if you return that system within
the applicable return period.
•Dell EqualLogic™ and EqualLogic-branded products, Dell|EMC and EMC-branded
products, DellKACE and KACE-branded hardware and software products, Dell
Compellent and Compellent-branded hardware and software products, Dell Force 10 and
Force 10-branded hardware and software products, PowerVault ML6000 tape libraries,
non-Dell-branded enterprise products, enterprise software, and customized hardware or
software products may not be returned at any time.
•Software licenses purchased under any type of volume license agreement may be returned
only with the express approval of the publisher, which in many circumstances will not be
granted.
Restocking Fees: Unless the product is defective or the return is a direct result of a Dell error,
Dell may charge a restocking fee of up to 15% of the purchase price plus any applicable sales tax.
How to Return: Before returning a product, you MUST first contact Dell customer service and
obtain a Credit Return Authorization (CRA) number before the end of the applicable return
period. Dell will not accept returns without a CRA number. To find the appropriate phone

Limited Warranty Terms for Dell-Branded Hardware Products

Dell-branded hardware products purchased in Canada come with either a 1-year, 2-year, 3-year, or
4-year limited warranty depending on the product purchased. To determine which warranty came
with your hardware product(s), see your invoice.
What is covered by this limited warranty?
This limited hardware warranty covers defects in materials and workmanship in your—our enduser customer's—Dell-branded hardware products, including Dell-branded peripheral products.
What is not covered by this limited warranty?
This limited hardware warranty does not cover:
•Software, including the operating system and software added to the Dell-branded
•Non–Dell-branded products and accessories
•Dell-branded consumable products (lamp bulbs for Dell-branded projectors, toner and ink
•Problems that result from:
•Products with missing or altered Service Tags or serial numbers
•Products for which Dell has not received payment
•Normal wear and tear

How long does this limited warranty last?
This limited hardware warranty lasts for the time period indicated on your packing slip, invoice,
or receipt except for the following Dell-branded hardware:
•The warranty for print head that is included as original equipment in the Dell mobile
printer is for parts only and is effective for a period of 1 year after the date of purchase of
the printer or 1000 prints of printer usage, whichever occurs first.
•Portable computer batteries carry the lesser of either a 1-year limited hardware warranty or
the length of the limited hardware warranty for the Dell computer with which the battery
is shipped.
•The limited hardware warranty for Power Adapters purchased independent of a system is
one year. Power Adapters purchased with a system are covered by the system limited
hardware warranty.
•Your PERC 5 or PERC 6 battery may provide up to 72 hours of controller cache memory
backup power when new. Under the 1-year limited hardware warranty, we warrant that the
battery will provide at least 24 hours of backup coverage during the 1-year limited
hardware warranty period
•Projector lamps carry a 90-day limited hardware warranty.
•Memory carries a limited hardware warranty of 3 years.
•The limited hardware warranty for monitors purchased independently of a system lasts
3 years or the time period indicated on your invoice. Monitors purchased with a system are
covered by the system limited hardware warranty.

•PDAs, earphones, and remote inline controls carry a 1-year limited hardware warranty.
•Other add-on hardware carries the longer of either a 1-year limited hardware warranty for
new parts and a 90-day limited hardware warranty for reconditioned parts or, for both new
and reconditioned parts, the remainder of the warranty for the Dell computer on which
such parts are installed.
•SATA hard drives in PowerEdge™, PowerEdge SC™ and PowerVault™ systems launched
on or after March 24th, 2009 (e.g., PowerEdge T110, PowerEdge T310, PowerEdge T410,
PowerEdge T610, PowerEdge T710, PowerEdge R210, PowerEdge R310, PowerEdge R410,
PowerEdge R510, PowerEdge R610, PowerEdge R710, PowerEdge M610, PowerEdge M710
and PowerVault NX300) carry the lesser of either a 1-year limited hardware warranty or the
length of the limited hardware warranty for the Dell system with which the SATA hard
drive is shipped. Service offerings may be available to extend the SATA hard drive warranty
period on these systems for an additional fee.
The limited hardware warranty on all Dell-branded products begins on the date of the packing
slip, invoice, or receipt. The warranty period is not extended if we repair or replace a warranted
product or any parts. Dell may change the availability of limited warranties, at its discretion, but
any changes will not be retroactive.
What do I do if I need warranty service?
Before the warranty expires, please call us or our authorized representatives according to the
following table. Long distance telephone carrier charges may apply. Please also have your Dell
Service Tag or order number available.
If you purchased through a retailer (not directly from Dell), you may be required to provide Dell
with your original sales receipt from your purchase to receive any warranty service from Dell.
If you purchased through Best Buy, you must have all original sales receipts from your purchase to
receive any warranty service at a Best Buy store.Please also have your Dell Service Tag or order
number available.

What will Dell do?
Hardware is often sold with a standard or upgraded Dell service contract. In such cases, your
invoice will indicate which service you are receiving from Dell and service will be provided to you
under the terms of the applicable service agreement. Please refer to that contract located at
http://www.dell.ca/servicecontracts for details on how to obtain service.

Otherwise, during the 90 days of the 90-day limited warranty and the first year of all other
limited warranties: Dell or its authorized representative will repair any Dell-branded hardware
products that we authorized you to return to us that prove to be defective in materials or
workmanship. If Dell or its authorized representative is not able to repair the product, we will
replace it with a comparable product that is new or refurbished.
When you contact us via phone or web, we will issue a Return Material Authorization Number
for you to include with your return. You must return the products to us in their original or
equivalent packaging, prepay shipping charges, and insure the shipment or accept the risk if the
product is lost or damaged in shipment. We will return the repaired or replacement products
to you.
If we determine that the problem is not covered under this warranty, we will notify you and may
inform you of service alternatives that are available to you on a fee basis.
NOTE: Before you ship the product(s) to us, make sure to back up the data on the hard
drive(s) and any other storage device(s) in the product(s). Remove any confidential,
proprietary, or personal information and removable media such as floppy disks, CDs, or PC
Cards. We are not responsible for any of your confidential, proprietary, or personal
information; lost or corrupted data; or damaged or lost removable media.
During the remaining years: For any remaining period of the limited hardware warranty, we will
replace any defective part with new or refurbished parts, if we agree that it needs to be replaced.
Customers must return the defective part to Dell. When you contact us, we may require a valid
credit card number at the time you request a replacement part, but we will not charge or invoice
you for the replacement part as long as you return the original part to us within 10 days of your
receipt of the replacement part. If we do not receive the original part within 10 days, we will
either invoice you or charge to your credit card the then-current Dell standard price for that part.
We will pay to ship the part to you if you use an address in Canada. Please note that we are
unable to ship repaired or replaced products to you to an address outside of Canada.
We will also include a prepaid shipping container with each replacement part for your use in
returning the replaced part to us.
NOTE: Before you replace parts, make sure to back up the data on the hard drive(s) and any
other storage device(s) in the product(s). We are not responsible for lost or corrupted data.
How will you fix my product?
We use new and refurbished parts made by various manufacturers in performing warranty repairs
and in building replacement parts and systems. Refurbished parts and systems are parts or
systems that have been returned to Dell or its suppliers, some of which were never used by a
customer. All parts and systems are inspected and tested for quality. Replacement parts and
systems are covered for the remaining period of the limited hardware warranty for the product
you bought. Dell owns all parts removed from repaired products.

May I transfer the limited warranty?
Limited hardware warranties on systems may be transferred if the current owner transfers
ownership of the system and records the transfer with us.The limited hardware warranty on
Dell-Certified Memory may not be transferred. You may record your transfer by going to Dell's

All requests to transfer ownership are at Dell's sole discretion. All such transfers will be subject to
the terms and conditions of the original service or limited hardware warranty agreement and
Dell's applicable terms and conditions of sale located at www.dell.com/terms. Dell cannot
guarantee the authenticity of the products, limited warranties, service or support, or the accuracy
of the listings of products you purchase from a third party.
Dell Return Policy (Canada Only)
Dell values our relationship with you, and offers you the option to return most products that you
purchase directly from Dell. You may return to eligible products for a credit or a refund of the
purchase price paid, less shipping and handling and applicable restocking fees, as set forth in
detail below.
30-Day Return Policy for Certain Hardware, Software Products, and
Accessories:
Unless you have a separate agreement with Dell or except as provided in the section below, all
hardware, accessories, peripherals, parts and media-based software that are unopened and still in
their original sealed package or, if delivered electronically, that has not been downloaded, may be
returned to Dell up to 30 days after you receive them for a credit or a refund of the purchase price
paid, less shipping and handling and applicable restocking fees and taxes if already paid.
Any product returned to Dell without prior authorization from Dell will be considered an
unauthorized return and the customer will not receive credit for the product and Dell will not
ship the product back to you.
Refunds or exchanges for defective merchandise can be made within 30 days of receipt of the
merchandise.
14-Day Return Period for Reconditioned or Refurbished Dell-branded
products from Dell:
If you are the original purchaser who bought reconditioned or refurbished products from Dell,
you may return the products to Dell within 14 days after the date of packing slip or invoice for a
refund or credit of the product purchase price.
Fees: Unless the product is defective or the return is a direct result of the Dell error, the refund or
credit does not include any shipping and handling charges shown on your packing slip or invoice;
you are responsible for those and for any damages incurred during the return shipment.

THE REFUND OR CREDIT IS ALSO SUBJECT TO A FIFTEEN PERCENT (15%)
RETURN ADMINISTRATIVE FEE OF THE PURCHASE PRICE PAID PLUS ANY
APPLICABLE SALES TAX UNLESS OTHERWISE PROHIBITED BY LAW.
If you are an organization that bought the products under a written agreement with Dell, the
agreement may contain different terms for the return of products than specified by this policy.
PROCEDURE: Before returning a product, you must first contact Dell Customer Service and
obtain a Credit Return Authorization Number before the end of the applicable return period.
Dell will not accept returns without a CRA number. HOME and HOME OFFICE customers
must call Dell Customer Service at 1-800-847-4096 and BUSINESS and PUBLIC SECTOR
customers must call Dell Customer Service at 1-800-387-5757.
Any product returned to Dell without prior authorization from Dell will be considered
unauthorized return and the customer will not receive credit for the product and Dell will not
ship the product back to you.
Within 5 days of the date that Dell Customer Service issues the Credit Return Authorization
number, you must ship the product to Dell in strict compliance with the following:
•Ship back all products you are seeking to return to Dell and for which you received a CRA
number. For partial returns, your credit may be less than invoice or individual component
prices due to bundled or promotional pricing and any unadvertised discounts
or concessions.
•Return the products in their original packaging, in as-new condition along with any media,
documentation, and all other items that were included in the original shipment such as

returning multiple items, you should have multiple and uniquely numbered waybills, one
per each individually boxed item.
•Do not photocopy and use the same waybill multiple times on separately boxed items or
this will impede and delay your credit.

drive(s) and any other storage device(s) in the product(s). Remove any confidential,
proprietary or personal information, removable media, such as floppy disks, CDs, or PC Cards.

DELL’S "TOTAL SATISFACTION" RETURN POLICY does not apply to the following
products which may not be returned at any time:

Application software and operating systems that have been installed by Dell may be returned
only if installed on a returnable system, and only if you return that system within the applicable
return period.
Non-Dell branded Software and licenses may be returned only with the express approval of the
publisher, which in many circumstances will not be granted.
With proper authorization, you may return software for a refund or credit only if the sealed
package containing the floppy disk(s) or CD(s) is unopened.
For customers who want to return, for refund or credit only, either application or operating
system software that has been installed by Dell, the whole system must be returned, along with
any media and documentation that may have been included in the original shipment.
Retail and Reseller Products: Products purchased from a Retailer or Reseller (i.e. not from Dell
directly) are governed by the return and exchange policies of the Retailer or Reseller where you
purchased the products.
Dell Software and Peripherals (Canada Only)
Third-Party Software and Peripherals Products
Similar to other resellers of software and peripherals, Dell does not warrant third-party products.
Third-party software and peripheral products are covered by the warranties provided by the
original manufacturer or publisher only. Third-party manufacturer warranties vary from product
to product. Consult your product documentation for specific warranty information. More
information may also be available from the manufacturer or publisher.
While Dell offers a wide selection of software and peripheral products, we do not specifically test
or guarantee that all of the products we offer work with any or all of the various models of
Dell computers, nor do we test or guarantee all of the products we sell on the hundreds of
different brands of computers available today. If you have questions about compatibility, we
recommend and encourage you to contact the third-party software and peripheral product
manufacturer or publisher directly.
