FOR CERTAIN SOFTWARE
INCLUDED IN YOUR SONY
RECEIVER

IMPORTANT – READ THIS
AGREEMENT BEFORE USING
YOUR SONY RECEIVER. USING
YOUR RECEIVER INDICATES
YOUR ACCEPTANCE OF THIS
AGREEMENT.

This End User License Agreement (“EULA”)
is a legal agreement between you and Sony
Electronics Inc. (“Sony”), the licensor of the
software included in this Sony Receiver and
accompanying printed or online
documentation, which shall be referred to as
the “Sony Software”. This EULA covers the
Sony Software. The Sony Software includes
software in your Sony Receiver, including
software of Sony and Sony’s third party
licensors (“Third Party Licensors”) and their
updates and upgrades provided to you by
Sony, whether stored on media, or downloaded
to the Sony Receiver via any method. By your
initial use of your Sony Receiver, you agree to
be bound by the terms of this EULA. If you do
not agree to the terms of this EULA, Sony is
unwilling to license the Sony Software to you,
and you should promptly contact Sony for
instructions on the return of the entire Sony
Receiver and included Sony Software for a
refund of the purchase price of the Sony
Receiver.

SOFTWARE LICENSE

The Sony Software is licensed, not sold. Sony
and its Third Party Licensors grant you a
personal, non-transferrable, non-exclusive and
limited license to use the Sony Software only
on the Sony Receiver. You may use the Sony
Software for personal use only. You may make
one back-up copy of the Sony Software solely
for recovery purposes. You agree not to
modify, reverse engineer, decompile,
disassemble or otherwise attempt to derive
source code from the Sony Software in whole
or in part or to use the Sony Software in whole
or in part for any purpose other than allowed
under this EULA. In addition, you may
transfer all of your rights under this EULA
only as part of a sale or transfer of the Sony
Receiver provided you retain no copies,
transfer all of the Sony Software (including all
copies, component parts, any media, printed
materials, all versions and any upgrades of the
Sony Software, and this EULA), and the
recipient agrees to the terms of this EULA.
Sony and its Third Party Licensors retain all
rights that this EULA does not expressly grant
to you.

COPYRIGHT

The Sony Software is protected by copyright
laws and international copyright treatises, as
well as other intellectual property laws and
treaties. All title and copyright and other
intellectual rights in and to the Sony Software,
and all copies of the Sony Software, are owned
by Sony or its Third Party Licensors.

LIMITED WARRANTY ON
MEDIA

In situations where the Sony Software or any
part thereof is furnished on media, Sony
warrants that for a period of ninety (90) days
from the date of its delivery to you, the media
on which the Sony Software is furnished to
you will be free from defects in materials and
workmanship under normal use. This limited
warranty extends only to you as the original
licensee. Sony’s entire liability and your
exclusive remedy will be replacement of the
media not meeting Sony’s limited warranty.
ANY IMPLIED WARRANTIES OR
CONDITIONS ON THE MEDIA,
INCLUDING THE IMPLIED
WARRANTIES AND CONDITIONS OF
MERCHANTABILITY AND/OR FITNESS

AUTOMATIC UPDATE FEATURE

From time to time, Sony or third parties may
automatically update or otherwise modify the
Sony Software, for example, but not limited to,
for purposes of error correction, improvement
of features, and enhancement of security
features. Such updates or modifications may
change or delete the nature of features or other
aspects of the Sony Software, including
features you may rely upon. You hereby agree
that such activities may occur at Sony’s sole
discretion and that Sony may condition
continued use of the Sony Software upon your
complete installation or acceptance of such
update or modifications.

SOFTWARE DATA
COLLECTION AND
MONITORING

The Sony Software contains features which
may allow Sony and/or third parties to collect
data from, control and/or monitor the Sony
Receiver and other devices running or
interacting with the Sony Software. You
hereby consent to such activities. Sony’s
current privacy policy is located at http://
products.sel.sony.com/SEL/legal/privacy.pdf.
Please contact applicable third parties for
privacy policies related to their software and
services.

HIGH RISK ACTIVITIES

The Sony Software is not fault-tolerant and is
not designed, manufactured or intended for
use or resale as on-line control equipment in
hazardous environments requiring fail-safe
performance, such as in the operation of
nuclear facilities, aircraft navigation or
communication systems, air traffic control,
direct life support machines, or weapons
systems, in which the failure of the Sony
Software could lead to death, personal injury,
or severe physical or environmental damage
(“High Risk Activities”). SONY, each of the
THIRD PARTY LICENSORS AND EACH
OF THEIR RESPECTIVE AFFILIATES
specifically disclaim any express or implied
warranty or condition of fitness for HIGH
RISK ACTIVITIES.

RESTRICTIONS ON EXPORT OF
ENCRYPTION TECHNOLOGY

The Sony Software may contain encryption
technology. You acknowledge that any export
of Sony Software containing encryption
technology from the United States or
subsequent re-export of such software by a
person located outside of the United States
requires a license or other authorization from
the U.S. Department of Commerce’s Bureau
of Industry and Security. You further
acknowledge that the Sony Software
containing encryption technology and
acquired from Sony is not intended for use by
a foreign government end user. By accepting
this license agreement, you agree to abide by
all relevant U.S. export laws and regulations in
the purchase and use of the Sony product being
acquired, including, but not limited to those
regulations relating to the export control of
cryptographic items and not to transfer, or
authorize the transfer, of the Sony Software to
a prohibited country or otherwise in violation
of any such restrictions or regulations.

RESTRICTED RIGHTS

The Sony Software is provided with
RESTRICTED RIGHTS. Use, duplication or
disclosure by the United States Government is
subject to restrictions as set forth in

consent to the venue and jurisdiction of such
courts. THE PARTIES HERETO WAIVE
TRIAL BY JURY WITH RESPECT TO ANY

SEVERABILITY

If any part of this EULA is held invalid or
unenforceable, the other parts will remain
valid.

THIRD PARTY BENEFICIARIES

Each Third Party Licensor is an express
intended third-party beneficiary of, and shall
have the right to enforce, each provision of this
EULA with respect to the software of such
party.

CONFIDENTIALITY

You agree to keep information contained in
Sony Software which is not publicly known
confidential to yourself, and not to disclose
such information to others without Sony’s
prior written approval.

DEPENDENT SOFTWARE

The software, network services or other
products other than Sony Software upon which
the Sony Software’s performance depends
might be interrupted or discontinued at the
discretion of the suppliers (software suppliers,
service providers, or Sony). Sony and its
suppliers do not warrant that the software,
network services or other products will
continue to be available, or will operate
without interruption or modification.

TERM

This EULA is effective until terminated. Sony
may terminate this EULA immediately if you
fail to comply with its terms by giving you
notice. In such event, you must destroy the
Sony Software and accompanying
documentation, and all copies you have made
of them. In addition, upon termination you will
have no recourse against Sony or its licensors
for your inability to use the Sony Software or
the accompanying documentation.

About the firmware of this
product

This product is protected by certain
intellectual property rights of Microsoft
Corporation. Use or distribution of such
technology outside of this product is
prohibited without a license from Microsoft or
an authorized Microsoft subsidiary.

parts may not be separated unless expressly

Storage/Network Use. You may not use the
SOFTWARE over a network or distribute the

Data Files. The SOFTWARE may create data
files automatically for use with the

specifically described in documentation

Rental. You may not rent or lease the

SOFTWARE Transfer. You may permanently

is not publicly known confidential to yourself,
and not to disclose such information to others
without SONY’s prior written approval.
Dependent Software. The software, network
services or other products other than
SOFTWARE upon which the SOFTWARE’s
performance depends might be interrupted or
discontinued at the discretion of the suppliers
(software suppliers, service providers, or
SONY). SONY and its suppliers do not
warrant that those software, network services
or other products will continue to be available,
or will operate without interruption or
modification.

SOFTWARE (including but not limited to any
images, photographs, animation, video, audio,
music, text and “applets”, incorporated into

USE OF SOFTWARE WITH
COPYRIGHTED MATERIALS

The SOFTWARE is capable of being used by
you to store, process and use content created
by you and third parties. Such content may be
protected by copyright, other intellectual
property laws, and/or agreements. You agree
to use the SOFTWARE only in compliance
with all such laws and agreements that apply to
such content. You agree that SONY may take
appropriate measures to protect copyright of

HIGH RISK ACTIVITIES

The SOFTWARE is not fault-tolerant and is
not designed, manufactured or intended for
use or resale as on-line control equipment in
hazardous environments requiring fail-safe
performance, such as in the operation of
nuclear facilities, aircraft navigation or
communication systems, air traffic control,
direct life support machines, or weapons
systems, in which the failure of the
SOFTWARE could lead to death, personal
injury, or severe physical or environmental
damage (“High Risk Activities”). SONY and
its suppliers specifically disclaim any express

LIMITED WARRANTY ON CD­ROM MEDIA

In situations where a back-up copy of the
SOFTWARE is furnished on CD-ROM media,
SONY warrants that for a period of ninety (90)
days from the date of its delivery to you the
CD-ROM media on which the back-up copy of
the SOFTWARE is furnished to you will be
free from defects in materials and
workmanship under normal use. This limited
warranty extends only to you as the original
licensee. SONY’s entire liability and your
exclusive remedy will be replacement of the
CD-ROM media not meeting SONY’s limited
warranty and which is returned to SONY with
proof of purchase in the form of a bill of sale
(which is evidence that the CD-ROM media is

SONY, le support associé, tout document
imprimé et tout document électronique ou « en
ligne », ainsi que toute mise à jour ou mise à
niveau, fournis ou autorisés par SONY. Vous
pouvez utiliser le LOGICIEL SONY
uniquement avec le PRODUIT SONY. Votre
utilisation initiale du PRODUIT SONY
constitue votre acceptation des modalités de la
présente LICENCE. Si vous n’acceptez pas les
modalités de la présente LICENCE, vous
devez contacter SONY sans délai afin
d’obtenir des directives concernant le retour
du PRODUIT SONY complet et des

LOGICIELS SONY accompagnant le produit
afin d’obtenir le remboursement du prix
d’achat du PRODUIT SONY.

LICENCE D’UTILISATION

Le LOGICIEL SONY est protégé par les lois
sur les droits d’auteurs et les traités
internationaux sur les droits d’auteurs, ainsi
que par d’autres lois et traités sur la propriété
intellectuelle. Le LOGICIEL SONY vous est
offert sous licence et non vendu.
CONCESSION DE LICENCE
La présente LICENCE vous concède des
droits limités, non exclusifs et non
transférables (sauf les cas faisant l’objet de
prescriptions expresses) tels que répertoriés ci­après :
Utilisation du LOGICIEL SONY. Ce
LOGICIEL SONY est à l’usage exclusif de ce
PRODUIT SONY.
Fins personnelles. Vous pouvez utiliser le
LOGICIEL SONY uniquement pour des fins
personnelles.
Copie de secours. Vous pouvez créer une
copie de secours du LOGICIEL SONY
uniquement aux fins d’archivage.

DESCRIPTION DES AUTRES
DROITS ET LIMITATIONS

Limitation quant à l’ingénierie inverse, la
décompilation et le désassemblage. Il est
interdit de modifier, de faire l’ingénierie
inverse, de décompiler, désassembler ou de
tenter d’autre façon que ce soit d’extraire le
code source du LOGICIEL SONY, en tout ou
en partie.
Séparation de composants. Le LOGICIEL
SONY est offert sous licence en tant que
produit simple et unique. II est interdit de
séparer ses parties composantes sous réserve
d’une autorisation expresse de SONY.
Utilisation dans un réseau. Il vous est interdit
d’utiliser le LOGICIEL SONY moyennant un
réseau d’ordinateurs ou de distribuer le
LOGICIEL SONY à d’autres ordinateurs par
un réseau, sous réserve des conditions

énoncées dans les imprimés accompagnant le
LOGICIEL SONY.
Limitation quant aux fonctions. Il vous est
interdit d’éviter, de modifier, de frustrer ou de
contourner les fonctions ou les protections
faisant partie du LOGICIEL SONY, ainsi que
les mécanismes liés au LOGICIEL SONY.
Marque de commerce; avis. Il vous est interdit
d’enlever, de modifier, de cacher ou de
défigurer les marques de commerce ou les avis
figurant sur le LOGICIEL SONY.
Fichiers de données. Le LOGICIEL SONY
peut automatiquement créer des fichiers de
données pour utilisation avec le LOGICIEL
SONY. Les fichiers de données sont réputés
faire partie du LOGICIEL SONY.
PRODUIT SONY unique. Le LOGICIEL
SONY est offert sous licence, avec le
PRODUIT SONY, en tant que produit simple
et unique. Il est interdit de séparer le
LOGICIEL SONY du PRODUIT SONY, sous
réserve des conditions énoncées dans les
imprimés accompagnant le LOGICIEL
SONY.
Location. Il vous est interdit de louer ou de
céder à bail le LOGICIEL SONY.
Cession du logiciel. Vous pouvez céder à titre
définitif tous vos droits en vertu de la présente
LICENCE seulement dans le cadre d’une
vente ou d’une cession du PRODUIT SONY, à
condition de n’en conserver aucune copie, de
céder l’intégralité du LOGICIEL SONY
(incluant toutes les copies, les parties
composantes, les supports et les imprimés,
toutes les versions et toute version actualisée
du LOGICIEL SONY et de la présente
LICENCE), et le cessionnaire accepte les
modalités de la présente LICENCE.
Résiliation. Sans préjudice à d’autres droits,
SONY peut résilier la présente LICENCE si
vous faites défaut de vous conformé aux
modalités qui y sont prévues. Dans ce cas,
vous devez détruire toutes les copies du
LOGICIEL SONY ainsi que chacune de ses
parties composantes.
Non-divulgation. Vous vous abstiendrez de
dévoiler les renseignements confidentiels
contenus dans le LOGICIEL SONY à

quiconque, sous réserve du consentement
préalable par écrit de SONY.
Logiciel dépendant. Le logiciel, les services
de réseau ou d’autres produits autres que le
LOGICIEL SONY sur lesquels dépend la
performance du LOGICIEL SONY peuvent
être interrompus ou abandonnés à la discrétion
des fournisseurs (fournisseurs de logiciel,
fournisseurs de service, ou SONY). SONY et
ses fournisseurs ne font aucune promesse que
ces logiciels, services de réseau ou autres
produits seront toujours disponibles ou qu’ils
fonctionneront sans interruption ou
modification.

DROITS D’AUTEUR

Le titre et les droits d’auteur relatifs au
LOGICIEL SONY (incluant, mais sans s’y
limiter, images, photos, animation, vidéo,
audio, musique, texte et « applets »,
incorporés dans le LOGICIEL SONY), et
toutes les copies du LOGICIEL SONY,
appartiennent à SONY ou à ses fournisseurs.
Tous les droits qui ne sont pas expressément
concédés dans le cadre de la présente
LICENCE sont réservés à et par SONY.

Le LOGICIEL SONY peut être utilisé par
vous pour garder, traiter et utiliser des
informations crées par vous ou par des tiers.
Ce contenu peut être protégé par les lois sur les
droits d’auteur, des autres lois sur la propriété
intellectuelle, ou des conventions. Vous vous
engagez d’utiliser le LOGICIEL SONY
conformément à toutes les lois et conventions
applicables à ce contenu. Vous reconnaissez

ACTIVITÉS À HAUT RISQUE

Le LOGICIEL SONY n’est pas insensible aux
défaillances et n’est pas conçu, fabriqué ou
destiné à l’utilisation ou à la revente à titre de
matériel de contrôle électronique dans les
environnements dangereux nécessitant une
performance à sécurité absolue, comme le
fonctionnement des installations nucléaires,
les systèmes de navigation ou de
communication aériennes, le contrôle de la
circulation aérienne, les systèmes directs de
maintien des fonctions vitales, ou les systèmes
d’arme, dans lesquels la défaillance du
LOGICIEL SONY entraînerait un décès, un
préjudice corporel, ou un dommage physique
ou environnemental grave (« activités à haut
risque »). SONY et ses fournisseurs déclinent
expressément toute garantie ou condition
expresse ou implicite de convenance des
activités à haut risque.

GARANTIE LIMITÉE
RELATIVEMENT AU SUPPORT
CD-ROM

Si le LOGICIEL SONY est fourni avec une
copie sauvegardée sur CD-ROM, SONY
garantit le support CD-ROM d’être sans défaut
de fabrication ou de matériel, relativement à
son utilisation normale, durant une période de
quatre-vingt-dix (90) jours à compter de la
date de livraison du LOGICIEL SONY à vous.
Cette garantie est fournie uniquement à vous
en tant qu’utilisateur original sous licence. Le
remplacement du support CD-ROM, qui doit
être expédié à SONY ainsi qu’une preuve
d’achat en forme de facture d’achat (servant
comme preuve que la période de garantie du
support CD-ROM n’est pas expirée) est votre
unique recours et l’unique responsabilité de
SONY. SONY n’est aucunement responsable

de remplacer un CD-ROM endommagé par
accident, abus ou l’usage inapproprié. LA
