ThelimitedwarrantyprovidedbyAPCbySchneiderElectric(APC®)inthisStatementofLimited FactoryW arrantyappliesonlytoproductsyoupurchaseforyourcommercialorindustrialuseinthe ordinarycourseofyourbusiness.

TermsofWarranty

AmericanPowerConversionwarrantsthattheproductshallbefreefromdefectsinmaterialsand workmanshipforaperiodofoneyearfromthedateofproductstart-upwhenstart-upisperformed byAPCauthorizedservicepersonnelandoccurswithinsixmonthsofTheAPCshipmentdate.This warrantycoversrepairingorreplacinganydefectivepartsincludingon-sitelaborandtravel.Inthe eventthattheproductfailstomeettheforegoingwarrantycriteria,thewarrantycoversrepairingor replacingdefectivepartsatthesolediscretionofAPCforaperiodofoneyearfromtheshipmentdate. ForAPCcoolingsolutions,thiswarrantydoesnotcovercircuitbreakerresetting,lossofrefrigerant, consumables,orpreventivemaintenanceitems.Repairorreplacementofadefectiveproductorpart thereofdoesnotextendtheoriginalwarrantyperiod.Anypartsfurnishedunderthiswarrantymaybe neworfactory-remanufactured.

Non-transferableWarranty

Thiswarrantyisextendedtotherstperson,rm,associationorcorporation(hereinreferredtoby “You”or“Y our”)forwhomtheAPCproductspeciedhereinhasbeenpurchased.Thiswarrantyisnot transferableorassignablewithoutthepriorwrittenpermissionofAPC.

AssignmentofWarranties

APCwillassignyouanywarrantieswhicharemadebymanufacturersandsuppliersofcomponentsof theAPCproductandwhichareassignable.Anysuchwarrantiesareassigned“ASIS”andAPCmakes norepresentationastotheeffectivenessorextentofsuchwarranties,assumesnoresponsibilityforany matterswhichmaybewarrantedbysuchmanufacturersorsuppliersandextendsnocoverageunderthis Warrantytosuchcomponents.

APCwarrantsforthewarrantyperiodandonthetermsofthewarrantysetforthhereinthatthe APCproductwillsubstantiallyconformtothedescriptionscontainedintheAPCOfcialPublished SpecicationsoranyofthedrawingscertiedandagreedtobycontractwithAPCifapplicablethereto (“Specications”).ItisunderstoodthattheSpecicationsarenotwarrantiesofperformanceandnot warrantiesoftnessforaparticularpurpose.
