Arbitration Agreement - This Product is subject to a binding arbitration agreement between you and SAMSUNG ELECTRONICS AMERICA, INC.

(“Samsung”). You can opt out of the agreement within 30 calendar days of the first consumer purchase by emailing optout@sea.samsung.com or calling 1-800-SAMSUNG (726-7864) and providing the applicable information. For complete terms and conditions that bind you and Samsung, refer to the “Arbitration Agreement” section of this document. THESE TERMS OF SERVICE (“TOS”) ARE A LEGAL AGREEMENT BETWEEN YOU AND SAMSUNG ELECTRONICS CO., LTD. (“SAMSUNG”) FOR THE SMARTTHINGS TRACKER SERVICE AND ANY RELEVANT SOFTWARE OR DOCUMENTATION THEREOF (COLLECTIVELY, THE “SERVICE”) PROVIDED BY SAMSUNG, ITS AFFILIATES, ITS THIRD PARTY SUPPLIERS, AND/OR LICENSORS.

BY INSTALLING OR OTHERWISE USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TOS, INCLUDING THE DISPUTE RESOLUTION PROVISION. IF YOU DO NOT AGREE TO THE TOS, DO

Intellectual Property

AllIntellectualProperty,asdefinedbelow,owned byorwhichisotherwisethepropertyofSamsung oritsrespectivesuppliersrelatingtotheProduct, includingbutnotlimitedto,accessories,parts, orsoftwarerelatingthereto,isproprietaryto Samsungandprotectedunderfederallaws, statelaws,andinternationaltreatyprovisions. IntellectualPropertyincludes,butisnotlimitedto, inventions(patentableorunpatentable),patents, tradesecrets,copyrights,software,computer programs,andrelateddocumentationandother worksofauthorship.

Youmaynotinfringeorotherwiseviolatetherights securedbytheIntellectualProperty.Moreover, youagreethatyouwillnot(andwillnotattempt to)modify,preparederivativeworksof,reverse engineer,decompile,disassemble,orotherwise attempttocreatesourcecodefromthesoftware.

NotitletoorownershipintheIntellectualProperty istransferredtoyou.Allapplicablerightsofthe IntellectualPropertyshallremainwithSamsung anditssuppliers.

Open Source Software

SomesoftwarecomponentsofthisProduct, includingbutnotlimitedto‘PowerTOP’and ‘e2fsprogs’,incorporatesourcecodecoveredunder GNUGeneralPublicLicense(GPL),GNULesser GeneralPublicLicense(LGPL),OpenSSLLicense, BSDLicenseandotheropensourcelicenses.To obtainthesourcecodecoveredundertheopen sourcelicenses,pleasevisit:

ModificationofSoftware

Samsung is not liable for performance issues or incompatibilities caused by your editing of registry settings, or your modification of Operating System (OS) software. Using custom OS software may cause your Product and applications to work improperly. Your carrier may not permit users to download certain software, such as custom OS.

DisclaimerofWarranties;Exclusion ofLiability

The information below explains that a user accepts this Product as sold, including the hardware and software components as created and packaged for sale. If the user changes these parameters through a unique modification, Samsung will not be held responsible for damages or issues that result from these end-user changes.

Except as set forth in the Standard Limited Warranty that accompanies the Product, the purchaser takes the Product “as is”, and Samsung makes no express or implied warranty of any kind whatsoever with respect to the Product, including but not limited

to the:

merchantability of the Product or its fitness for any particular purpose or use;

design, condition or quality of the Product;

performance of the Product;

workmanship of the Product or the components contained therein; or

compliance of the Product with the requirements of any law, rule, specification or contract pertaining thereto.

Nothing contained in the User Manual or any other document shall be construed to create an express

or implied warranty of any kind whatsoever with respect to the Product. In addition, Samsung shall not be liable for any damages of any kind resulting from the purchase or use of the Product or arising from the breach of the express warranty, including incidental, special or consequential damages, or loss of anticipated profits or benefits.

Section 1: Arbitration Agreement

THIS IS A BINDING LEGAL AGREEMENT (“AGREEMENT”) BETWEEN YOU (EITHER AN INDIVIDUAL OR ENTITY) AND SAMSUNG ELECTRONICS AMERICA, INC. (“SAMSUNG”). ELECTRONIC ACCEPTANCE OF THE AGREEMENT, OPENING THE PRODUCT PACKAGING, USE OF THE PRODUCT, OR RETENTION OF THE PRODUCT CONSTITUTES ACCEPTANCE OF THIS AGREEMENT,

REGARDLESS OF WHETHER YOU ARE THE ORIGINAL PURCHASER, USER, OR OTHER RECIPIENT OF THE PRODUCT.

YOU AND SAMSUNG EACH AGREE THAT ALL DISPUTES BETWEEN YOU AND SAMSUNG RELATING IN ANY WAY TO OR ARISING IN ANY WAY FROM THE STANDARD LIMITED WARRANTY OR THE SALE, CONDITION OR PERFORMANCE OF THE PRODUCT SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, AND NOT BY A COURT OR JURY. ANY SUCH DISPUTE SHALL NOT BE COMBINED OR CONSOLIDATED WITH A DISPUTE INVOLVING ANY OTHER PERSON’S OR ENTITY’S PRODUCT OR CLAIM, AND SPECIFICALLY, WITHOUT LIMITATION OF THE FOREGOING, SHALL NOT

UNDER ANY CIRCUMSTANCES PROCEED AS PART OF A CLASS ACTION. THE ARBITRATION SHALL BE CONDUCTED BEFORE A SINGLE ARBITRATOR, WHOSE AWARD MAY NOT EXCEED, IN FORM

OR AMOUNT, THE RELIEF ALLOWED BY THE APPLICABLE LAW.

Thearbitrationshallbeconductedaccording totheAmericanArbitrationAssociation(AAA) CommercialArbitrationRulesapplicableto consumerdisputes.TheAAARulesareavailable

onlineatadr.orgorbycallingtheAAAat 1-800-778-7879.ThisAgreementisenteredinto pursuanttotheFederalArbitrationAct.This AgreementisenteredintopursuanttotheFederal ArbitrationAct.ThelawsoftheStateofNewYork, withoutreferencetoitschoiceoflawprinciples, shallgoverntheapplicationandinterpretationof theAgreementandalldisputesthataresubject tothisAgreement.Thearbitratorshalldecideall issuesofinterpretationandapplicationofthis Agreement.Foranyarbitrationinwhichyourtotal damageclaims,exclusiveofattorneyfeesand expertwitnessfees,are$5,000.00orless(“Small Claim”),thearbitratormay,ifyouprevail,award yourreasonableattorneyfees,expertwitnessfees andcostsaspartofanyaward,butmaynotgrant

Samsungitsattorneyfees,expertwitnessfeesor costsunlessitisdeterminedthattheclaimwas broughtinbadfaith.InaSmallClaimcase,youshall berequiredtopaynomorethanhalfofthetotal administrative,facilityandarbitratorfees,or$50.00 ofsuchfees,whicheverisless,andSamsungshall paytheremainderofsuchfees.Administrative, facilityandarbitratorfeesforarbitrationsinwhich yourtotaldamageclaims,exclusiveofattorney feesandexpertwitnessfees,exceed$5,000.00 (“LargeClaim”)shallbedeterminedaccordingto AAArules.InaLargeClaimcase,thearbitrator maygranttotheprevailingparty,orapportion amongtheparties,reasonableattorneyfees,expert witnessfeesandcoststotheextentallowedby theapplicablelaw.Judgmentmaybeenteredon thearbitrator’sawardinanycourtofcompetent jurisdiction.

ThisAgreementalsoappliestoclaimsagainst Samsung’semployees,representatives,parents andotheraffiliatesifanysuchclaimrelatesin anywaytoorarisesinanywayfromtheStandard LimitedWarrantyortheProduct’ssale,conditionor performance.

You may opt out of this Agreement by providing notice to Samsung no later than 30 calendar days from the date of the first consumer purchaser’s purchase of the Product. To opt out, you must send notice by e-mail to optout@sea.samsung.com, with the subject line: “Arbitration Opt Out.” You must include in the opt-out email (a) your name and address; (b) the date on which the Product was purchased; (c) the Product model name or model number; and (d) the IMEI or MEID or Serial Number, as applicable, if you have it (the IMEI or MEID or Serial Number can be found (i) on the Product box; (ii) on the Product information screen which can be found under “Settings;” (iii) on a label on the back of the Product beneath the battery, if the battery is removable; and (iv) on the outside of the Product if the battery is not removable).

Alternatively, you may opt out by calling 1-800-SAMSUNG (726-7864) no later than 30 calendar days from the date of the first consumer purchaser’s purchase of the Product and providing the same information. These are the only two forms of notice that will be effective to opt out of this Agreement.

Opting out of this Agreement will not affect in any way the benefits to which you would otherwise be entitled, including the benefits of the Standard Limited Warranty.

Section 2: Standard Limited Warranty

Whatiscoveredandforhowlong?

SAMSUNGELECTRONICSAMERICA,INC. (“SAMSUNG”)warrantsthatthisProductisfree fromdefectsinmaterialandworkmanshipunder normaluseandserviceforthewarrantyperiod. Thewarrantyperiodcommencesuponthedate ofpurchasebythefirstconsumerpurchaserand continuingforthefollowingspecifiedperiodof timeafterthatdate:

Device: 1 Year

Batter(ies)*, including Internal Batteries: 1 Year

Other Accessories*: 1 Year

*If applicable.

Whatisnotcovered?

ThisStandardLimitedWarrantyisconditioned uponproperuseoftheProduct.ThisStandard LimitedWarrantydoesnotcover:(a)defectsor damageresultingfromaccident,misuse,abnormal use,abnormalconditions,improperstorage, exposuretoliquid,moisture,dampness,sandor dirt,neglect,orunusualphysical,electricalor electromechanicalstress;(b)scratches,dentsand cosmeticdamage,unlesscausedbySamsung;(c) defectsordamageresultingfromexcessiveforceor useofametallicobjectwhenpressingonatouch screen;(d)equipmentthathastheserialnumber ortheenhancementdatacoderemoved,defaced, damaged,alteredormadeillegible;(e)ordinary wearandtear;(f)defectsordamageresultingfrom theuseofProductinconjunctionorconnection withaccessories,products,orancillary/peripheral equipmentnotfurnishedorapprovedbySamsung;

(g)defectsordamageresultingfromimproper testing,operation,maintenance,installation, service,oradjustmentnotfurnishedorapprovedby Samsung,includingbutnotlimitedtoinstallation ofunauthorizedsoftwareandunauthorized

rootaccess,bothofwhichshallvoidthislimited warranty;(h)defectsordamageresultingfrom

externalcausessuchascollisionwithanobject,fire, flooding,dirt,windstorm,lightning,earthquake, exposuretoweatherconditions,theft,blownfuse, orimproperuseofanyelectricalsource;(i)defects ordamageresultingfromcellularsignalreception ortransmission,orvirusesorothersoftware problemsintroducedintotheProduct;or(j)Product usedorpurchasedoutsidetheUnitedStates.

ThisStandardLimitedWarrantycoversbatteries onlyifbatterycapacityfallsbelow80%ofrated capacityorthebatteryleaks,andthisStandard LimitedWarrantydoesnotcoveranybatteryif(i) thebatteryhasbeenchargedbyabatterycharger notspecifiedorapprovedbySamsungforcharging thebattery;(ii)anyofthesealsonthebatteryare brokenorshowevidenceoftampering;or(iii)the batteryhasbeenusedinequipmentotherthanthe Samsungdeviceforwhichitisspecified.

WhatareSamsung’sobligations?

Duringtheapplicablewarrantyperiod,provided theProductisreturnedinaccordancewiththe termsofthisStandardLimitedWarranty,Samsung willrepairorreplacetheProduct,atSamsung’s soleoption,withoutcharge.Samsungmay,at Samsung’ssoleoption,userebuilt,reconditioned,

ornewpartsorcomponentswhenrepairingany Product,ormayreplacetheProductwitharebuilt, reconditionedornewProduct. Repaired/replacedcases,pouchesandholsters willbewarrantedforaperiodofninety(90)days. Allotherrepaired/replacedProductswillbe warrantedforaperiodequaltotheremainderof theoriginalStandardLimitedWarrantyonthe originalProductorforninety(90)days,whichever

islonger.AllreplacedProducts,parts,components, boardsandequipmentshallbecometheproperty ofSamsung.Excepttoanyextentexpresslyallowed byapplicablelaw,transferorassignmentofthis StandardLimitedWarrantyisprohibited.

Whatmustyoudotoobtainwarranty service?

ToobtainserviceunderthisStandardLimited Warranty,youmustreturntheProducttoan authorizedphoneservicefacilityinanadequate containerforshipping,accompaniedbythesales receiptorcomparableproofofsaleshowingthe originaldateofpurchasebythefirstconsumer purchaser,theserialnumberoftheProductandthe seller’snameandaddress.
