Overview

The Datalogic™ Pegaso industrial PDA combines the flexibility of Windows
Mobile

®

with the power of the Intel XScale processor, Wi-Fi wireless technol­ogy, a large color display, and laser scanning in an ergonomic PDA. The Pegaso
is a rugged device suitable for both Commercial and Industrial environments, as
well as Retail-in-Store inventory management applications (back room inven­tory management and shipping/receiving, shelf inventory management, price
lookup, and relabeling applications). The Pegaso will handle 5’ / 1.5M drops to
concrete, and has an IP64 environmental rating.

The Datalogic™ Pegaso industrial PDA combines the flexibility of Windows
Mobile® with the power of the Intel XScale processor, WiFi wireless technol­ogy, a large color display, laser and imaging scanning (1D) in an ergonomic
PDA. The Pegaso is a rugged device suitable for both Commercial and Indus­trial environments, as well as Retail-in-Store inventory management applica­tions (back room inventory management and shipping/receiving, shelf
inventory management, price lookup, and relabeling applications). The Pegaso
will handle 5’ / 1.5M drops to concrete, and has an IP64 environmental rating.

Getting Started

Before using the Pegaso for the first time, you must install the Battery Pack into
the unit, then charge both the Battery Pack and the Backup Battery. See Install­ing the Battery Pack on page 7 for instructions

System Requirements

Minimum Desktop Computer Requirements

• Microsoft Windows XP, Windows 2000, or Server 2003 with the most
current Service Pack installed.

• Microsoft Outlook 98 or later required for synchronization to the desk­top or portable computer of e-mail, calendar, contacts, tasks, and notes.
(Outlook 2003 is recommended).

• Microsoft Internet Explorer 4.01 SP1 or later.

• Hard disk drive with 12 to 65 MB of available hard disk space (actual
requirements will vary based on selection of features and user's current
system configuration).

• Available 9- or 25-pin communications port (adapter required for 25-pin
communications port), or USB port.

• VGA graphics card or compatible video graphics adapter at 256 color or
better.

•Keyboard.

• Microsoft Mouse or compatible input device.

CAUTION

You must charge the battery pack and backup battery in a dock or

with a power cable prior to your first use of the Pegaso. The initial

charge time is approximately 4 hours. See Charging the Batteries on

page 9 for more information.

Powering the Pegaso

Battery Pack

The battery pack in the Pegaso is a 3.7 V, 2200
mAh or 3300 mAh Lithium Ion battery pack. A
message dialog box will appear when the battery
pack reaches a low state.

After charging the first time, a complete charge
takes about four (4) hours depending on the bat­tery pack’s state and the recharging method. A
sample battery pack label is shown at right. The
label on your unit may vary from the illustration.

CAUTION

You must charge the battery pack and backup battery in a dock or

with a power cable prior to your first use of the Pegaso. The initial

charge time is approximately 4 hours.

If you remove the battery pack or it fails, there is a 30-minute window

in which to insert a charged battery pack before the backup battery

fails. If your backup battery fails, the contents of the RAM memory

will be lost. If your backup battery is less than fully charged, there is a

smaller window of time available. Usage time will be reduced, also.

Always charge within temperature range of 32°–113°F (0°–40°C). Reg-

ularly charging near the temperature limits will increase the time nec-

essary to fully charge the battery, and will shorten the battery’s useful

life.

Use only the authorized power supplies, battery packs, chargers, and

docks supplied by your Datalogic reseller. The use of other power

supplies can damage the unit and void your warranty. Refer to the

PRG for the correct power supplies and Accessories.

WARNING

Lithium-ion battery packs may get hot, explode, ignite, or/and cause

serious injury if exposed to abusive conditions.

• Do not place the battery in or near fire, direct sunlight, or other

high temperature locations, or heat the battery.

• Do not connect the positive terminal and negative terminal of the

battery to each other with any metal object (such as wire or coin).

• Do not expose the battery to liquids, or allow to get wet.

• Do not disassemble, modify, or pierce the battery. The battery con-

tains safety and protection devices, which, if damaged, may cause

the battery to generate heat, explode or ignite.

In the event the battery leaks and the fluid gets into your eye, do not

rub the eye. Rinse well with water and immediately seek medical care.

If left untreated, the battery fluid could cause damage to the eye.

Installing the Battery Pack

The Pegaso’s Battery and its cover are integrated — they do not come apart.
Complete the following instructions to install the battery pack:

1. Loosen the elastic handstrap by releasing it from the bottom of the unit
(refer to the PRG).

2. Orient the battery pack with the latch facing toward the top of the Pegaso
(refer to Figure 2 on page 7).

3. Replace the battery door by inserting the bottom tab into the unit, then
clicking the latch into place. If the battery pack is installed incorrectly, it
will not seat properly.

4. Replace the handstrap at the bottom of the unit.

Datalogic recommends annual replacement of rechargeable battery

packs to ensure maximum performance.

When you first remove the Pegaso from the box, you must charge

both the battery pack and the backup battery for a minimum of 4

hours.

If you remove the battery pack or the battery fails, you have about 30

minutes to swap in a new battery pack or charge the battery pack

before the backup battery fails (if the backup battery has been fully

charged).

Additionally, the Power control applet displays a battery power gauge. You can
check the status of both the Main Battery and the Backup battery. From the
Today screen you can tap the Battery icon, or go to

> Settings > System >

Power.

Charging the Batteries

There are several methods for charging the battery pack and backup battery.
LEDs on the Pegaso, the Single-Slot Dock, and the Four-Slot Battery Charger
give visual indication of the charge state.

Table 2 on page 10 gives an overview

of all the LEDs and what they indicate.

When the battery is totally discharged, the battery sensor initiates

a shutdown of all applications, and closes the RF Network connec-

tion. If the battery pack has completely discharged, when the bat-

tery pack is charged or replaced, the unit will resume as before.

Charging with the Dock

A Single-Slot Dock powered by an external power supply (AC adaptor) is avail­able for the Pegaso. Pegasos communicate with the host PC using Microsoft
ActiveSync protocol via either a USB or serial port.

Two methods exist for charging a battery pack using a Single-Slot Dock. Refer
to

Table 2 on page 10. The amber light on the dock will blink when a battery is

inserted, to indicate a successful connection. For more information on the
Dock, refer to the PRG, or the instructions that come with each dock.

Charging with a Battery Charger

The Pegaso is available with a Four-Slot Battery Charger. Use the Battery
Charger to charge batteries independently of the unit.

Backup Battery

The rechargeable 3.7V Lithium Backup Battery receives its charge from the Bat­tery Pack. To retain date, time, data, and other settings for the Pegaso, maintain
at least a minimal charge on the Battery Pack.

When the backup battery is low, an icon will display on the status bar (see

Table 1 on page 8), and a dialog box will open to alert you.

At first use or cold reset, the unit will go through an initial bootup sequence:

1. Touchscreen Calibration on page 12.

2. Getting Connected on page 13.

3. IP Network Setup on page 13.

Entering a Password

The first time you use the Pegaso you will be prompted to enter a password. Tap

Next to continue, or Skip if you do not want the device to be password-pro-

tected.

Follow the on-screen directions to calibrate

the touchscreen.

bration, refer to the PRG.

Follow the onscreen instructions to enter your password. Reference the
Microsoft help system on your device for more information. You can return to
the Password screen anytime by tapping

> Settings > Personal > Lock.

Getting Connected

Bluetooth Setup

1. Open the Bluetooth control panel by tapping > Settings > Connec-

tions > Bluetooth Manager.

2. Search for available Bluetooth Devices by tapping the button for the type
of device you want

(Printer, Serial or All) .

3. Create a pairing by double tapping the listing for the device you want and
selecting the service. If you want to specify encryption or require authen­tication, enable the appropriate checkbox.

4. Tap

OK to complete.

For detailed instructions, reference the PRG.

Connecting to a PC

In order for the Pegaso to communicate with a host PC, Microsoft® ActiveSync
must be installed on the computer. Go to www.microsoft.com/downloads/ for
information. Reference the Pegaso WM PRG for detailed instructions.

IP Network Setup

1. Tap > Settings > Connections.

2. Tap the

Network Cards icon.

3. Select the adapter you are using (available options will vary based on the
radio installed and the number of connections).

4. Complete the two tabs (shown in

Figure 9):

• IP Address: Select DHCP or set static IP settings.

•

Name Servers: If using static IP, set DNS and WINS servers.

RF Setup (Summit Client Utility)

The Summit Client Utility (SCU) is an application designed for users and
administrators of mobile devices that use a Summit radio module. Using SCU,
you can:

• Disable and enable the radio (turn it off and on)

• View the contents of configuration profiles, or configs, each of which
houses the RF, security, and other settings for the radio

• Select the config to be used to connect to a WLAN

• View global settings, which apply to every config

• View status information on the radio, the access point (AP) or WLAN
router to which it is connected, and the RF connection or link between
the two

• Troubleshoot a connection or performance issue, view in-depth diagnos­tic information on the connection and the radio, and perform various
troubleshooting and diagnostic tests

1. To launch the utility go to

> Settings > Connections.

2. Tap on the Wi-Fi icon.

3. To make setting changes tap

Admin Login.

The default password is

SUMMIT.

For more detailed information on making changes to settings, please refer to the
PRG.

Entering Data

To open an application, tap a link on the Today page, or tap > Programs to
display a

list of available programs. Tap a program icon to open it.

There are several ways to enter data with the Pegaso:

• Use the keypad. Refer to Keypad starting on page

20.

• Use the stylus on the touchscreen display. Refer to Using the Stylus on
page 15 for more information on using the stylus.

• Use the on-screen keyboard by tapping with the stylus. Refer to On­Screen Keyboard on page 18.

• Select text. Use the stylus to highlight the desired text by dragging the
stylus across the desired text, double-tapping to select one word, and tri­ple-tapping to select an entire paragraph.

• Use the barcode scanner or imager to enter data. Press the trigger or scan
button to initiate a scan. The scanned data will be entered into the cur­rent application’s open file. Refer to Scanning Barcodes starting on
page

24 for more information on using the scanner.

Using the Stylus

The stylus is located next to the scanning pod as illustrated in Figure 10. The
stylus on the Pegaso is the equivalent of the mouse on a PC. Use the stylus to:

• Navigate the touchscreen display.

• Select characters in the soft input panel (SIP).

• Select applications from the desktop or system tray.

• Select tabs, fields and text within applications and dialog boxes.

Never use a pen, pencil, or other sharp object on the Pegaso’s

touchscreen display. Use only the supplied stylus or plastic-

tipped pens intended for use with a touch-sensitive display. Con-

tact your reseller to replace a missing stylus.

Ambient Light Sensor

The ambient light sensor is used by the Pegaso to automatically adjust the inten­sity of the backlight on the display and keypad in response to changes in light­ing conditions. It is located on the keypad. Reference the Pegaso PRG for
information on enabling or disabling this feature.

Screen Protector

A Screen Protector is available for the Pegaso. Reference the Pegaso PRG for
information on installation.

Navigating the Display

There are several navigation areas on your display, including the title bar and the
soft key bar. Each of these navigation areas has sub-areas of navigation as well.
Take the time to familiarize yourself with these features to save yourself valuable
time.

The Today Screen

After initial startup, the first screen you will see will be the Today screen (unless
your device has been customized differently). You can also access the Today
Screen anytime by tapping

> Today.

The

Title bar at the top of the screen shows Connection status, a link to Volume

control, and Time/Date settings.

The Start Menu

The Title bar at the top of the screen contains the Start icon, program name, and
notification icons. Tap

(Start) to open the Start menu. The Start menu

includes access to

Programs, Settings, Help and shortcuts to programs and func-

tions.
The soft key bar at the bottom of the screen provides context-sensitive menus

for tasks in programs, such as opening a file, saving a file, or editing a file.

On-Screen Keyboard

In applications that accept keyed input, the on-screen keyboard can be used to
enter data using the stylus. The on-screen keyboard is a digital, QWERTY-style
keyboard. Tap the

Keyboard icon to open or close the on-screen keyboard.

Use the stylus to select letters, numbers, or symbols from the on-screen key­board for the current application. Tap the key to change the keypad to
show international letters.

You can also set up the Pegaso to use Block Recognizer, Letter Recognizer, or
Transcriber to enter data. Reference the help system on the PDA for more infor­mation on these features.

Settings

The Settings screen has three tabs: Personal, System and Connections. Each pro­vides access to various options. Tap

> Settings to open the Settings screen,

then tap the tab you want to access.

Keypad

The Pegaso is available with a 19-key keypad. Refer to the PRG for information
on configuring the keypad.

<Alpha> Press <Alpha> to access upper case alpha characters and symbols on the

19-key keypad.

Numeric

Keys

In Normal mode, use the numeric keys to enter numbers. In Alpha mode

these keys can be used to type uppercase letters or punctuation.

<Fn>

Press <Fn> to enter the FN input state. Use FN mode to access additional

features and operations.

A customizable keypad overlay will be available for order, allowing you to

remap the Keypad to your specifications.

<Power>

Press Power to put the Pegaso into sleep (suspend) mode if it is currently

running, and wake up (resume) the unit if it was in sleep mode. Press and

hold it briefly to turn off the unit.

<Scan> Press <Scan> to activate the laser scanner.

4-Way

Rocker

Key

Press the edge of the 4-way rocker key to move the cursor or highlighted text

entry during a menu/list selection. In a text window:

The <Up> arrow moves the cursor up one line.

<Right> arrow moves the cursor to the right one character.

Keyboard Indicators

The Keyboard Indicators are located at the bottom of the display. The most
recently activated state is to the left if more than one state is active. Scroll
between icons to view the active modes.

The Pegaso keypad is organized like a cell phone, with multi-tap access to
uppercase alpha characters on numeric keys (see

Figure 17). Use the alpha-

numeric keys and the

<ESC> key to type letters, numbers, and symbols listed in

Table 5 on page 22.

in Alpha mode, the current alpha character is displayed by a system tray

keyboard indicator.

Alpha mode is persistent, which means that the system stays in Alpha

mode until you press <Alpha> again.

Fn Mode Press <Fn> to enter FN mode. <Fn> is independent of the <Alpha> key.

Use FN mode to access the features and operations on the keypad.

Key Functions —

Most of the keys on the keypad of the Pegaso have more
than one function. To access the secondary features and functions, you must
first press another key to obtain the desired input state.

Numeric Keys —

Press the keys in Ta bl e 5 once, twice, or more to cycle
through the alpha letters and symbols until the desired character appears in the
system tray. After the last character in the sequence for that key, the next key­press will generate the first letter or symbol in the sequence.

Scanning Barcodes

Laser Scanning

To use the scanning function on units containing a laser scanning module, com­plete the following steps:

1. Select and open a data capture application, such as Microsoft

®

Word

Mobile.

2. Aim the scan window at the barcode as shown in Figure 18.

3. Press the

<Scan> key or trigger. The laser scans as long as you hold the

button or trigger, or for 10 seconds, or until a good scan is obtained.

4. Aim the laser beam at the center of the barcode.

• Position the unit close to barcode when scanning small barcodes.

• Position it at a distance when scanning larger barcodes.

• The laser is disabled after you release the key or after 10 seconds, or
once a good scan is obtained.

Trigger (on handle) to initiate a

scan with the Pegaso.

5. The device beeps and the green LED indicator comes on until the trigger
is released. The green LED and the beep tone indicate a good read.

6. The barcode data is entered in the current application.

7. Once a barcode is read successfully, the scanner turns off automatically.

Refer to Scanner Configuration in the PRG to modify the default settings.

Access Microsoft Windows Mobile help by tapping > Help from any screen.

Resetting the Pegaso

There are two basic reset methods for the Pegaso.

• A Warm Reset terminates an unresponsive application and clears the
working RAM.

• A Cold Reset forces all applications to close and clears working RAM.

Warm Reset

A Warm Reset is a transition from the on or idle condition that closes all appli­cations and ensures that all files and settings are persisted before rebooting.. If
an application “hangs,” initiate a Warm Reset to terminate the application.

Procedure to Warm Reset —

Press the three keys in the sequence shown.

All three keys must be held down for the unit to reset. Refer to

Figure 21 for the

location of the reset keys.

Datalogic recommends that you always attempt a Warm Reset

In Windows Mobile 6.0, unlike some other operating systems, there

is very little difference between Warm Reset and Cold Reset.

Cold Reset

A Cold Reset is a complete reset of the Pegaso in which all applications are forc­ibly closed and working RAM is cleared.

Reason to Cold Reset —

Use a Cold Reset when the Windows operating sys-

tem locks up and the Warm Reset command does not work.

To perform a Cold Reset, remove the Battery

Pack and use the Stylus to press the

<Reset> button inside the Battery Compart-

Maintaining the Pegaso

With normal use, the Pegaso, Dock, and Four-Slot Battery Charger require no
maintenance. For trouble-free service, observe the following tips:

• To prolong its life and avoid problems, keep the Pegaso clean. Use a
clean, soft cloth dampened with a mild, dilute cleanser.

• Clean the display with a lens cloth or other soft cloth dampened with a
mild, dilute cleaning solution.

Never use a pen, pencil, or other sharp object on the display/

touch screen. Use only the supplied stylus or plastic-tipped pens

intended for use with a touch-sensitive screen.

Do not use abrasive paper/cloth or abrasive/corrosive cleaners

to clean the unit.

WARNING

Do not use a sharp object to Reset; use the Stylus. A sharp

object can puncture the button, disabling the reset function, rup-

turing the industrial seal, and voiding your warranty. Refer to

Resetting the Pegaso on page 2-26

End User License Agreement (EULA)

Notice to End User: The Datalogic Product you have acquired contains Software, which is
integral to the product’s operation. This Software is being provided to you under license, sub­ject to the terms and conditions of this Agreement. If you use the Datalogic Product, you will
be deemed to have accepted the terms and conditions of this Agreement. If you do not intend
to be bound to the terms of this Agreement, Datalogic is not willing to license the Software to
you, you may not use the Datalogic Product or the Software, and you must contact the party
from whom you acquired the Datalogic Product for instructions.

This End User Software License Agreement (“Agreement” or “EULA”) is a legally binding
agreement governing the licensing of the Software and Documentation by Datalogic Mobile,
Inc. and its wholly owned subsidiaries and affiliates (“Datalogic”) to the entity or person who
has purchased or otherwise acquired a Datalogic Product (“End User”). For purposes of this
Agreement, any software that is associated with a separate end-user license agreement is
licensed to you under the terms of that license agreement. Datalogic and End User hereby
agree as follows:

1. Definitions.

1.1 “Affiliate” means a business entity currently existing or later acquired that controls, is con­trolled by, or is under common control with Datalogic Mobile, Inc.

1.2 “Documentation” means materials such as user’s guides, program reference guides,
quick reference guides, manuals, or similar materials associated with or related to the Data­logic Product, whether in printed, “online”, or other form.

1.3 “Proprietary Information” means: (a) source code, object code, software, documentation,
and any related internal design, system design, data base design, algorithms, technology,
technical data or information, implementation techniques, and trade secrets related to the
Software, (b) any other trade secrets marked appropriately or identified as proprietary or con­fidential, and (c) any information that End User, under the circumstances, should recognize
as confidential. Proprietary Information does not include any information that the receiving
party can establish was (1) in the public domain, (2) already in the receiving party’s posses­sion or rightfully known prior to receipt, (3) rightfully learned from a third party not in violation
of any other's proprietary rights, or (4) independently developed without access to Proprietary
Information.

1.4 “Datalogic Product” means Datalogic Mobile’s Windows Mobile® Portable Digital Assis­tant (PDA) Series, including all preloaded Software in or provided in connection with the Dat­alogic Product and all Documentation related to such product, which has been purchased or
otherwise acquired by End User, whether obtained directly or indirectly from Datalogic.

1.5 “Software” means any software or computer programs of Datalogic or its third party licen­sors in machine readable form which is either preloaded in or provided in connection with the
Datalogic Product, whether obtained directly or indirectly from Datalogic, including any
related update or upgrade such as enhancements or modifications.

2. Scope Of License Granted.

2.1 Datalogic grants to End User a non-exclusive, non-transferable, perpetual license to use
the Software, solely on a Datalogic Product, in machine-readable form only, solely for End
User's internal business purposes. This Agreement does not convey ownership of the Soft­ware to End User. Title to the Software shall be and remain with Datalogic or the third party
from whom Datalogic has obtained a licensed right. As used in this Agreement, the term “pur­chase” or its equivalents when applied to the Software shall mean “acquire under license.”

2.2 End User shall not copy, modify, decompile, disassemble, reverse engineer, or otherwise
reproduce or remanufacture the Software, whether modified or unmodified, nor sell, assign,
sublicense, distribute, lend, rent, give, or otherwise transfer the Software to any other person
or organization, for purposes other than as expressly provided in this Agreement, or to the
extent specifically allowed under foreign law solely for the purposes of interoperability, without
Datalogic’s prior written consent.

3. Transfers, Support.

3.1 Any copying, installing, reproduction, remanufacture, reverse engineering, electronic
transfer, or other use of the Software on other than a Datalogic Product will be a material
breach of this Agreement.

3.2 End User shall not sell, assign, sublicense, distribute, lend, rent, give, or otherwise trans­fer a Datalogic Product containing Software to any third party unless such third party agrees
with Datalogic in writing to be bound by the terms and conditions of this Agreement. Any such
transfer of a Datalogic Product absent such agreement shall be null and void.

3.3 End User may obtain support for Software from Datalogic at Datalogic’s standard support
fees and under Datalogic’s standard support terms and conditions in effect at the time the
support is requested.

4. Intellectual Property.

End User acknowledges that the Software constitutes valuable trade secrets of Datalogic or
Datalogic’s third party licensors and that the Software is protected by intellectual property
laws and treaties. The license set forth in this Agreement does not transfer to End User any
ownership of Datalogic’s or its third party licensors' copyrights, patents, trademarks, service
marks, trade secrets, or other intellectual property rights and End User shall have no right to
commence any legal actions to obtain such rights. End User shall not remove, modify, or take
any other action that would obscure any copyright, trademark, patent marking, or other intel­lectual property notices contained in or on the Datalogic Product.

5. Proprietary Information.

5.1 End User acknowledges that Proprietary Information is the confidential, proprietary, and
trade secret property of Datalogic and Datalogic’s third party licensors and End User acquires
no right or interest in any Proprietary Information.

5.2 End User shall not disclose, provide, or otherwise make available the Proprietary Informa­tion of Datalogic or its third party licensors to any person other than End User’s authorized
employees or agents who are under confidentiality agreement, and End User shall not use
the Proprietary Information other than in conjunction with use of the Datalogic Product exclu­sively for End User’s internal business purposes. End User shall take steps to protect the Pro­prietary Information no less securely than if it were End User's own intellectual property.

5.3 The provisions of this Proprietary Information Section shall survive and continue for five
(5) years after the termination of this Agreement.

6. Limited Warranty.

6.1 Datalogic warrants that, under normal use and operation, the Datalogic Product will con­form substantially to the applicable Documentation for the period specified in the Documenta­tion. During this period, for all reproducible nonconformities for which Datalogic has been
given written notice, Datalogic will use commercially reasonable efforts to remedy nonconfor­mities verified by Datalogic. End User agrees to supply Datalogic with all reasonably
requested information and assistance necessary to help Datalogic in remedying such non­conformities. For all defects reported to Datalogic within the warranty period, Datalogic’s lia­bility is limited to providing End User with one copy of corrections or responding to End User's
problem reports according to Datalogic's standard assistance practices. Datalogic does not
warrant that the product will meet End User's requirements or that use of the product will be
uninterrupted or error free, or that Datalogic's remedial efforts will correct any nonconfor­mance. This limited warranty does not cover any product that has been subjected to damage
or abuse, whether intentionally, accidentally, or by neglect, or to unauthorized repair or unau­thorized installation, and shall be void if End User modifies the product, uses the product in
any manner other than as established in the Documentation, or if End User breaches any of
the provisions of this Agreement.

6.2 EXCEPT AS PROVIDED IN THIS AGREEMENT, THE DATALOGIC PRODUCT IS PRO­VIDED “AS IS” AND DATALOGIC MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR
IMPLIED, WRITTEN OR ORAL, WITH RESPECT TO THE PRODUCT, AND SPECIFICALLY
DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE.

7. Infringement.

7.1 Datalogic will defend End User against any claim in a lawsuit that the Datalogic Product
furnished hereunder infringes a United States patent or copyright of a third party and Data­logic will pay any damages finally awarded against End User by a court of competent jurisdic­tion that are attributable to such claim or will pay End User’s part of any settlement that is
attributable to such claim, provided, that 1) End User notifies Datalogic promptly in writing of
the claim, 2) Datalogic controls the defense or settlement of the claim, and 3) End User coop­erates fully with Datalogic in such defense or settlement. All notices of a claim should be sent
to Datalogic Mobile, Inc., 1505 Westec Drive, Eugene, OR 97402 U.S.A.

7.2 In the defense or settlement of any such claim, Datalogic may, at its option, 1) procure for
End User the right to continue using the Datalogic Product, 2) modify the Datalogic Product

so that it becomes non-infringing, 3) replace the Datalogic Product with an equivalent product
not subject to such claim, or 4) provide End User an opportunity to return the Datalogic Prod­uct and receive a refund of the purchase price paid, less a reasonable allowance for use.

7.3 Datalogic shall have no liability to End User for claims of infringement based upon 1) the
use of any Datalogic Product in combination with any product which Datalogic has not either
furnished or authorized for use with such Datalogic Product 2) the use of any Datalogic Prod­uct designed, manufactured, or modified to the specifications of End User, or 3) End User’s
modification of the Datalogic Product without written authorization from Datalogic.

7.4 THE FOREGOING STATES DATALOGIC’S COMPLETE AND ENTIRE OBLIGATION
CONCERNING CLAIMS OF PATENT, COPYRIGHT, OR OTHER INTELLECTUAL PROP­ERTY INFRINGEMENT, CANCELS AND SUPERCEDES ANY PRIOR AGREEMENTS,
WHETHER ORAL OR WRITTEN, BETWEEN THE PARTIES CONCERNING SUCH
CLAIMS, AND WILL NOT BE MODIFIED OR AMENDED BY ANY PAST, CONTEMPORANE­OUS, OR FUTURE AGREEMENTS OR DEALINGS BETWEEN THE PARTIES, WHETHER
ORAL OR WRITTEN, EXCEPT AS SET FORTH IN A FUTURE WRITING SIGNED BY BOTH
PA RT I E S.

8. Limitation Of Liability.

EXCEPT AS PROVIDED IN SECTION 7, DATALOGIC SHALL NOT BE LIABLE FOR ANY

TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, STRICT LIABILITY, WAR­RANTY, OR ANY OTHER BASIS, EXCEED THE PRICE OR FEE PAID BY END USER FOR
THE DATALOGIC PRODUCT. UNDER NO CIRCUMSTANCES SHALL DATALOGIC BE LIA­BLE TO END USER OR ANY THIRD PARTY FOR LOST PROFITS, LOST DATA, INTER­RUPTION OF BUSINESS OR SERVICE, OR FOR ANY OTHER SPECIAL,
CONSEQUENTIAL, CONTINGENT, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, OR
OTHER SIMILAR DAMAGES, EVEN IF DATALOGIC HAS BEEN ADVISED OF THE POSSI­BILITY OF SUCH DAMAGES.

9. Government Restricted Rights; International Use.

9.1 Use, duplication, or disclosure of the Software by the U.S. Government is subject to the
restrictions for computer software developed at private expense as set forth in the U.S. Fed­eral Acquisition Regulations at FAR 52.227-14(g), or 52.227-19 or in the Rights in Technical
Data and Computer Software clause at DFARS 252.227-7013(c)(1)(ii), whichever is applica­ble.

9.2 If End User is using the Datalogic Product outside of the United States, End User must
comply with the applicable local laws of the country in which the Datalogic Product is used,
with U.S. export control laws, and with the English language version of this Agreement. The
provisions of the “United Nations Convention on International Sale of Goods” shall not apply
to this Agreement.

10. Termination.

10.1 Either party may terminate this Agreement or any license granted under this Agreement
at any time upon written notice if the other party breaches any provision of this Agreement.

10.2 Upon termination of this Agreement, End User immediately shall cease using any non­preloaded software and shall return to Datalogic or destroy all non-preloaded software cov­ered by this Agreement, and shall furnish Datalogic with a certificate of compliance with this
provision signed by an officer or authorized representative of End User. For preloaded soft­ware, End User agrees to sign a waiver prepared by Datalogic concerning further use of the
preloaded Software. End User’s resumed or continued use of the preloaded Software after
termination shall constitute End User’s agreement to be bound by the terms and conditions of
this Agreement for such use.

11. General Provisions.

11.1 Entire Agreement; Amendment. This document contains the entire agreement between
the parties relating to the licensing of the Software and supersedes all prior or contemporane­ous agreements, written or oral, between the parties concerning the licensing of the Soft­ware. This Agreement may not be changed, amended, or modified except by written
document signed by Datalogic.

11.2 Notice. All notices required or authorized under this Agreement shall be given in writing,
and shall be effective when received, with evidence of receipt. Notices to Datalogic shall be
sent to the attention of the Legal Department, General Counsel, Datalogic Mobile, Inc., 1505
Westec Drive, Eugene, OR 97402 U.S.A., or such other address as specified by Datalogic in
writing.

11.3 Waiver. A party’s failure to enforce any of the terms and conditions of this Agreement
shall not prevent the party’s later enforcement of such terms and conditions.

11.4 Governing Law; Venue: This Agreement and the rights of the parties hereunder shall be
governed by and construed in accordance with the laws of the State of Oregon U.S.A, without
regard to the rules governing conflicts of law. The state or federal courts of the State of Ore­gon located in either Multnomah or Lane counties shall have exclusive jurisdiction over all
matters regarding this Agreement, except that Datalogic shall have the right, at its absolute
discretion, to initiate proceedings in the courts of any other state, country, or territory in which
End User resides, or in which any of End User's assets are located.

11.5 Attorneys’ Fees. In the event an action is brought to enforce the terms and conditions of
this Agreement, the prevailing party shall be entitled to reasonable attorneys’ fees, both at
trial and on appeal.

Product Warranty

Warranty

Pegaso products are guaranteed against defects in materials and workmanship for the period
specified at the time of sale. This warranty shall apply to Pegaso PDAs, Base Stations for the
Pegaso and Chargers for the Pegaso. Cables, mounts and other accessory items are specifi­cally warranted for a period of 90-days from product purchase. Customer must notify Data­logic of the claimed defect before the expiration of the Warranty period and obtain from
Datalogic a return authorization number for return of the product to designated Datalogic ser­vice center. If Datalogic determines Customer’s claim is valid, Datalogic will repair or replace
product without additional charge for parts and labor. Customer shall be responsible for pack­aging and shipping the product to the designated Datalogic service center, with shipping
charges prepaid. Datalogic shall pay for the return of the product to Customer if the shipment
is to a location within the country in which the Datalogic service center is located. Customer
shall be responsible for paying all shipping charges, duties, taxes, and any other charges for
products returned to any other locations.

Warranty is subject to the limitations and exclusions set forth in the paragraphs that follow.

WARRANTY SET FORTH ABOVE IS IN LIEU OF ANY OTHER WARRANTIES, EXPRESS
OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS.

Exclusions

Warranty coverage shall not apply to any claimed defect, failure or damage which Datalogic
determines was caused by: abuse, neglect, improper use of product; failure to provide prod­uct maintenance, including but not limited to cleaning of the display in accordance with prod­uct reference guide; installation or service of product by other than Datalogic representatives;
use of product with any other instrument, equipment or apparatus; modification or alteration
of product or units with Warranty Void labels that have been tampered with. External cables
and replacement of upper window/cartridge due to scratching, stains or other degradation will
not be covered under the Warranty. External power supplies returned for service must be
accompanied by the original product for performance of service.

Returned products that Datalogic has determined are not covered by Warranty, will be
charged Datalogic standard repair rates then in effect for repair of product. Replacement of
display due to scratching, stains or other degradation will not be covered under Warranty. If a
product is determined to be not repairable customer will be notified and product may be
returned to customer at their request. A minimum repair fee may be charged.

Limitation of Liability

DATALOGIC's REPAIR OR REPLACEMENT OF DEFECTIVE PRODUCT AS SET FORTH
ABOVE IS THE CUSTOMER’S SOLE AND EXCLUSIVE REMEDY ON ACCOUNT OF
CLAIMS OF BREACH OF WARRANTY OR PRODUCT DEFECT. UNDER NO CIRCUM­STANCES WILL DATALOGIC BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR
ANY LOST PROFITS, OR ANY INCIDENTAL, CONSEQUENTIAL IN-DIRECT, SPECIAL OR
CONTINGENT DAMAGES REGARDLESS OF WHETHER DATALOGIC HAD ADVANCE

Assignment

Customer may not assign or otherwise transfer its rights or obligations under Warranty except
to a purchaser or transferee of product. No attempted assignment or transfer in violation of
this provision shall be valid or binding upon Datalogic.

Risk of Loss

Customer shall bear risk of loss or damage for product in transit to Datalogic. Datalogic shall
assume risk of loss or damage for product in Datalogic's possession or product being
returned to Customer by Datalogic, except such loss or damage as may be caused by the
negligence of Customer, its agents or employees. In the absence of specific written instruc­tions for the return of product to Customer, Datalogic will select the carrier, but Datalogic shall
not thereby assume any liability in connection with the return shipment.

Your wireless Pegaso Mobile Computer is a low power radio transmitter and
receiver. When it is ON, it receives and also sends out Radio Frequency (RF)
signals. In August, 1996, the Federal Communications Commissions (FCC)
adopted RF exposure guidelines with safety levels for handheld wireless phones.
Those guidelines are consistent with the safety standards previously set by both

Electronic Devices

Most modern electronic equipment is shielded from RF signals. However, cer­tain electronic equipment may not be shielded against the RF signals from your
wireless mobile computer.

Pacemakers

The Health Industry Manufacturers Association recommends that a minimum
separation of six (6) inches be maintained between a handheld wireless mobile
device and a pacemaker to avoid potential interference with the pacemaker.
These recommendations are consistent with the independent research by and
recommendations of Wireless Technology Research. Persons with pacemakers:

• Should ALWAYS keep Pegaso Mobile computer more than six (6) inches
from their pacemaker when computer is turned ON;

• Should not carry Pegaso Mobile computer in a breast pocket;

• Should turn Pegaso Mobile computer OFF immediately if there is any
reason to suspect that interference is taking place.

Other Medical Devices

If you use any other personal medical device, consult the manufacturer of your
device to determine if it is adequately shielded from external RF energy. Your
physician may be able to assist you in obtaining this information.

Health Care Facilities

Turn your Pegaso Mobile computer OFF in health care facilities when any regu­lations posted in these areas instruct you to do so. Hospitals or health care facil­ities may use equipment that could be sensitive to external RF energy.

Driving

Check the laws and regulations on the use of wireless GSP devices in the areas
where you drive and always obey them. Also, if using your GSP while driving,

Datalogic scanners are certified in the U.S. to conform to the requirements of DHHS/
CDRH 21CFR Subchapter J and to the requirements of IEC/EN 60825-1:1998-2001.

Class 1, 2, 3R, and Class II products are not considered to be hazardous. The scanner
contains internally a Visible Laser Diode (VLD) whose emissions do not exceed the max­imum limits as set forth in the above regulations. The scanner is designed so that there is
no human access to harmful laser light during normal operation, user maintenance or
during prescribed service operations.

CAUTION

Do not attempt to open or otherwise service any components in the optics cavity. Open­ing or servicing any part of the optics cavity by unauthorized personnel may violate laser
safety regulations. The optics system is a factory only repair item.

CAUTION

Use of optical systems with the scanner will increase eye hazard. Optical instruments
include binoculars, microscopes and magnifying glasses. This does not include eye glasses
worn by the user.
