Congratulations on your new purchase of the X.O. Wave
Beach 3D Wireless Stereo Headset.
Before using, please take the necessary time to read
this instruction manual and get familiar with your new
purchase.

1. Avoid pulling on the cords or cables. Always grip the

cable rmly when unplugging from the headset.

2. This product has not been designed to sustain high
temperature such as inside cars staying for hours in
direct sunlight. Avoid exposure to external heat sources;
direct, prolonged sunlight; dust; corrosive chemicals;
and moisture. When you do not use your device, please
keep your headset in a dry location, protected from high
temperature.

3. It is normal for electronic devices to warm during use.
Avoid placing the headset near heat-sensitive materials

or magnetic elds.

4. Do not drop your headset or subject it to shocks.

5. Do not place anything on top of it when in use.

6. Always use the supplied cables and connectors, or X.O.
original cable. Use of non-original X.O. cables, or cables
not supplied with your smartphone or tablet constitutes a
misuse and may result in injury or damage.

7. Do not attempt to service or disassemble! This product
is not user-serviceable! Attempting to disassemble,
service or temper with the headset can result in electrical
hazard, including death from exposure to high voltage.
If you experience problems with the unit, discontinue
use and contact X.O. customer service for assistance.
Attempting to open or repair will void all warranties,

of your new X.O. Wave Beach 3D headset in connection
with your smartphone or tablet.

11. To avoid damage to your cable, device and charger,
pay attention to not force cables in and out of the
connector(s), and leave cable connected to the headset
unbent, especially do not place objects against connected
cable, forcing the cable to bend close to the connector(s).

12. Save energy: unplug your charging cable when the
headset is fully charged and place it in safe and dry
location. Please do not dispose of your headset in trash
bins but recycle with your other electronic products.

Before starting:

Please recharge your X.O. Wave Beach 3D stereo
headset to full capacity. Use the short micro USB-to­USB cable (included in the box). Connect the micro USB
connector into the headset using the connector shown
hereunder (6) and connect to a USB computer or any
other device with a USB connector (5 Volt). The device
you are charging from must be turned on to recharge
X.O. Wave Beach 3D Stereo headset. A complete cycle
of charge lasts around 2 hours and 30 minutes. When
you start charging, the LED indicator shown hereunder
(8) will remain in solid red color. As soon as the headset
battery has reached full charging capacity, the LED will
turn to blue color. Disconnect the cable, you have fully
recharged your headset and it is ready for hours of
listening.

Warning:

Listening to high volume may affect your hearing severely.
It is not safe to use a headset when you are driving, riding
or cycling.

1- HEAD BAND

Please notice earcups are both rotatable to take less
space when you carry them with you. Please notice the
alloy metal side arm are adjustable as shown hereunder.
Adjust for maximum comfort. All the wireless control
buttons are located conveniently onto the right earcup.

Please note that no control will work unless you have
turned on X.O. Wave Beach 3D and you are connected
wirelessly to a device.

2- PREVIOUS TRACK/ VOLUME UP.

Please notice the surface of this control is embossed with
3 dots to make it easier by just touching the surface to
identify it without having to look.

- Press once: Go back to the beginning of the current
track

- Press twice: Go back to the previous track in the current
playlist

- Long press: increase volume progressively

3-NEXT TRACK/VOLUME DOWN.

Please notice the surface of this control is embossed with
1 dot so you can tell the difference with PREVIOUS/UP
button by just touching the surface without having to look.

- Press once: Go to the next track

- Long press: decrease volume progressively

Please use exclusively the cable provided in the box of
your product. Other cables might create technical issues.
You may lose your vendor’s warranty by not using an
X.O. original micro USB cable.

7- 3.5MM JACK PLUG

Your X.O. Wave Beach 3D Stereo headset can also be
used using the jack cable included in the box. Other
cables might create technical issues. You may lose your
vendor’s warranty by not using an X.O. original jack 3.5
mm cable.
Please take the time to look at your Jack cable. You will
notice that there is no microphone built in on your cable.
The jack cable is intended only for listening to music.
You have no microphone to take or receive calls with the
cable. All the built-in wireless controls on your headset
will be unable to control the device you connect via the
Jack plug. When connected with the jack, use the control
of the device to change track, volume, or pause.

8- Built-in microphone

The built-in microphone, like all the built-in control
buttons, are active only when your X.O. Wave Beach 3D
is charged and powered on, and that you are paired via
the Bluetooth of a smartphone or tablet.
You can be paired to up to 2 devices simultaneously
wirelessly.

9- Low battery

When the battery power is low, the headphones will
automatically turn off. To maintain proper battery levels,
charge the headphones at least once per month. If
the headphone sits without being powered on for long
periods of time, it will need to be recharged to maintain
full battery levels.

How do I connect wirelessly?

Before you start:

- Make sure your X.O. Wave Beach 3D headset is turned
OFF at this stage.

- Make sure the smartphone or tablet you try to connect to
is Bluetooth-enabled, with Bluetooth turned ON.

- If your smartphone or tablet is currently connected to
an audio Bluetooth peripheral, please disconnect it. Go
into your device’s settings, and in the Bluetooth menu,
disconnect any Bluetooth audio device.

1. Turn your X.O. Wave Beach 3D headphone ON by
holding down the ON/OFF button (5). The LED indicator

(8) will start ashing alternatively and rapidly in red and

blue colors. Your headset is now discoverable by a
smartphone, tablet or any other Bluetooth device.

2. Go into the settings of your device, in the Bluetooth
menu, and select “X.O. Beach 3D”. You are connected
now to your device. The LED indicator is now turned off.
In the unlikely case your device requires a password to
connect to the X.O. Wave Beach 3D, enter “0000”.

3D Surround Effect companion
Application

Your X.O. Wave Beach 3D comes with its companion app,
Boom. Boom is a state-of-the-art DSP application (Digital
Signal Processing) that runs on your iOS or Android
device. Boom is a new and different music player, that taps

into your current music library. Boom immerses you into
a really incredibly immersive surround experience with its
unique technology. Your music appears both natural and
largely enhanced by the stereophonic effect in a striking
way. The feeling is unique. Perfectly adjusted to X.O.
Wave Beach 3D, it enriches your musical experience in
a way you have never imagined before. This feature has
been optimized for X.O. Wave Beach 3D headset and is
not active for more than a trial period of 3 days to other
customers. Boom also provide adaptive preset equalizer
and an intensity music slider to complete your musical
experience.

Vendor Warranty

X.O provides a one-year vendor warranty for this product.
During that time, counting from the documented date of
purchase by the customer, as shown on his/her proof of
purchase, in the unlikely event that this product ceases
operating while being used under normal conditions, X.O.
will choose to either replace the product, or alternatively,
credit the customer with the full purchase price. If you
have purchased your product from a reseller, please
return your product where you bought it from, in its
original packaging and with all its accessories with a
proof of purchase.

• The item must be in an ‘as new’ condition and returned

in the ORIGINAL, undamaged packaging with the
accessories. Any of these missing, the return request will
not be entertained.

• The warranty is invalid if:

• Defects and damages are due to misuse,

fault of negligence or usage other than the normal and
customary manner

• Serial number and/or security seal are removed

or tempered with.

• The product is modied, disassembled,

tempered or attempted repair by any person.

• Returning cost must be supported by customer, re-

delivery cost will be covered by X.O.

• You must attach your original Receipt of purchase.

Limitations of Warranty

• Product Warranty does not protect against acts of God
such as ood, earthquake, lightning, war, terrorist attacks,

vandalism, theft, normal-use wear and tear, erosion,
depletion, obsolescence, abuse, damage due to low voltage
disturbances (i.e. brownouts or sags), non-authorized

program, or system equipment modication or alteration.

• X.O. reserves the right to review the damaged product.

All costs of shipping the product to X.O. for inspection
shall be covered solely by the purchaser. Damaged
equipment must remain available for inspection until

the claim is nalized. Whenever claims are settled, X.O.

reserves the right to be subrogated under any existing
insurance policies the purchaser may have.

Instruction Manual to Download Boom

iOS and Android

1. What is Boom?

Boom is a premium music player app that redenes

your music experience on your iOS and Android devices
with its unique sound staging algorithm that produces
deep, immersive, pristine, and rich 3D sound on any
headphones. With its innovative virtual surround sound
technology, Boom can completely transform your
music experience. It provides handcrafted equalizer

presets, ner control for bass and intensity of sound to

deliver unmatched sound on your headphones. Boom

is specically tuned to work with X.O. Wave Beach 3D

headphones.

2. Device specication

Boom is compatible with all iOS devices running iOS 9 &
later. For Android, Boom supports devices with Android
version 5.0 and above.

3. Download Boom

Find your Boom Activation Code inside your X.O. Wave
Beach box. Log on to www.boom3Dapp.com and follow
the instructions to download and enjoy Boom on your iOS
or Android mobile devices.

To Download Boom on iOS device (This is only valid
on US App Store ID)

1. Please enter your Boom activation code as provided
in the activation card with X.O. Wave headset to receive
your Boom iOS link.

2. Enter your email address, verify it and submit.

3. You’ll receive an email containing the App link button to
download the app.

4. Click on the App Store button to download Boom and
start Boomin’!

To Download Boom on Android device:

1. Please enter your Boom activation code as provided
in the activation card with Wave headset to receive your
Boom Android link.

2. Enter your email address, verify it and submit.

3. You’ll receive an email containing the Boom Android
Store button.

4. Clicking on the button will take you to the Boom Android
Store Page with a “Download” button, tap on “Download”
button.

5. Once the Boom APK le is downloaded, please go to
“File Manager” to get the APK le and install the app on

your device and start Boomin’!

4. 3D Surround Sound

The most signicant feature of Boom is the patent-

pending 3D Surround Sound technology, which offers
an immersive virtual surround sound experience that
is entrancing and is optimized for Xtyle Odeon Wave
headset! It works like a charm on all stored songs, and

it brings out the acoustics and nuances you might have
otherwise missed.

Click on the ‘Effects’ icon at the bottom of your music
player screen to enter a menu where you can nd the 3D

icon. Tap on the icon to switch on/off the 3D effect.

5. 3D Speakers Set-Up

Click on the speaker icon on the right side of the 3D
surround sound to enter 3D settings screen where you
can individually turn channels ON/OFF by tapping on
them.

6. Equalizer Presets

The bunch of Equalizer Presets in Boom allow you to
choose from 25 potential music scenarios suitable for
individual listening styles. Click on “Effects” and you

can nd the Equalizer with the Presets listed below.

Swipe them to select options such as Electronic, Pop,
Bass Booster, Dubstep, and more. Or, to make things
easier, you can also let Boom intelligently apply an Auto­Equalizer to any song!

7. Bass Adjustment

Click on the “Effects” to enter a menu to nd the Full Bass

option. You can tap on that to switch on/ off Full Bass
option.

8. Intensity Slider

You can nd a slider to adjust the intensity of 3D surround

inside the effects, below the 3D surround sound.

9. Playing Songs from Cloud

- Go to library.

- Select your cloud accounts (Dropbox or Google Drive)

- Login to stream music saved in your cloud.

- Currently, Boom only supports songs stored locally on
your iOS and Android devices and songs that are stored
in your Google Drive and DropBox accounts. You cannot
use Boom on DRM-protected songs.

10. What else can Boom do?

Boom allows you to easily create your own Playlists, and
create your favorite. You can also set Crossfade option
for your music playlist. Set a sleep timer to allow Boom to
turn off music automatically after a particular time.

1. Évitez de tirer sur les cordons ou les câbles. Saisissez
toujours fermement la partie connecteur du câble lorsque
vous le débranchez du casque.

2. Ce produit n’a pas été conçu pour supporter des

8. N’utilisez pas le casque dans un environnement

9. Laissez sufsamment d’espace libre autour du casque

10. Préservez la durabilité de votre câble de charge:
ne placez aucun objet exerçant une pression contre le
connecteur lorsqu’il est connecté.

11. Pour éviter d’endommager le câble, l’appareil et
votre chargeur, veillez à ne pas forcer l’entrée et la sortie
des câbles et à ne pas laisser le câble plié quand il est
branché au casque, en particulier ne pas placer d’objets
susceptible de faire plier le câble en force contre le câble
branché.

12. Économisez de l’énergie : débranchez votre câble de
charge lorsque votre casque est chargé et placez-le dans
un endroit sûr et sec. Veuillez ne pas jeter votre casque
dans les poubelles mais le recycler avec vos autres
produits électroniques.

Avant de commencer:

Veuillez recharger complètement votre casque stéréo 3D
X.O. Wave Beach. Utilisez le câble Micro-USB à USB-A
(inclus dans la boîte). Branchez le connecteur Micro
USB dans le casque illustré ci-dessous (6) et connectez
le connecteur USB-A à un ordinateur USB ou à tout
autre périphérique avec un connecteur USB (courant
5V). L’appareil que vous chargez doit être allumé pour
recharger le casque X.O. Wave Beach 3D Stereo. Un
cycle de charge complet dure environ 2 heures et 30
minutes. Lorsque vous commencez à charger, l’indicateur
LED illustré ci-dessous (8) restera en rouge. Lors la
batterie est chargée, la LED devient bleue. Débranchez
le câble, vous avez entièrement rechargé votre casque et
il est prêt pour des heures d’écoute.

Attention:

L’écoute d’un volume élevé peut affecter sévèrement
votre audition.
Il est dangereux d’utiliser un casque lorsque vous
conduisez, roulez ou pédalez.

1- Arceau

Veuillez noter que les oreillettes sont rotatives pour
prendre moins d’espace lorsque vous les portez avec
vous. Veuillez noter que les bras latéraux en alliage
d’aluminium sont réglables comme indiqué ci-dessous.
Ajuster pour un confort maximum. Tous les boutons

de commande sans l sont situés commodément sur

l’oreillette droite.

Veuillez noter qu’aucun bouton de contrôle ne fonctionnera
à moins que vous n’ayez allumé X.O. Wave Beach 3D et

que vous soyez connecté sans l à un appareil.

2- Morceau précédent / Plus de volume :

Veuillez noter qu’il y a des 3 points en relief sur ce bouton
de contrôle pour mieux vous aider à le reconnaitre en

touchant simplement la surface pour l’identier sans avoir

à regarder.
Appuyez une fois: Revenez au début de la piste en cours
Appuyez deux fois: Revenez à la piste précédente de la
liste de lecture en cours
Appui long: augmenter progressivement le volume

3- Morceau suivant / Moins de volume :

Veuillez noter qu’il y a des 3 points en relief sur ce bouton
de contrôle, vous pouvez pouvez faire la différence
avec le bouton Morceau précédent / Plus de volume en
touchant simplement la surface sans avoir à regarder.
Appuyez une fois: Aller à la piste suivante
Appui long: diminuer progressivement le volume

Veuillez utiliser exclusivement le câble fourni dans la
boîte de votre produit. D’autres câbles peuvent créer
des problèmes techniques. Vous risquez de perdre la

7- Prise Jack 3.5MM

Votre casque stéréo X.O. Wave Beach 3D peut également
être utilisé en utilisant le câble jack inclus dans la boîte.
D’autres câbles peuvent créer des problèmes techniques.
Vous risquez de perdre la garantie constructeur en
n’utilisant pas de câble jack 3,5 mm d’origine X.O.
Veuillez prendre le temps de regarder votre câble Jack.
Vous remarquerez qu’il n’y a pas de microphone intégré
sur votre câble. Le câble jack est conçu uniquement pour
écouter de la musique. Vous n’avez pas de microphone

Le microphone intégré, comme tous les boutons de
contrôle intégrés, n’est utilisable que lorsque votre X.O.
Wave Beach 3D est chargé et allumé, et que vous êtes
jumelé via le Bluetooth d’un smartphone ou d’une tablette.
Vous pouvez être jumelé à deux appareils simultanément

9- Batterie faible

Lorsque la batterie est faible, le casque s’éteint
automatiquement. Pour maintenir un niveau de batterie
approprié, chargez-le au moins une fois par mois. Si le
casque se trouve sans être allumé pendant de longues
périodes, il doit être rechargé pour maintenir un bon
niveau de batterie.

Comment me connecter sans l?

Avant de commencer:

- Assurez-vous que votre casque X.O. Wave Beach 3D
est éteint à ce stade.

- Assurez-vous que la fonction Bluetooth de votre
smartphone ou la tablette à laquelle que vous essayez
de vous connecter est activée.

- Si votre smartphone ou votre tablette est actuellement
connecté à un autre périphérique audio Bluetooth,
déconnectez-le. Allez dans les paramètres de votre
appareil et dans le menu Bluetooth, déconnectez tout
périphérique audio Bluetooth.

1. Allumez votre casque X.O. Wave Beach 3D en appuyant
le bouton ON / OFF (5). L’indicateur LED (8) clignotera
alternativement et rapidement en rouge et bleu. Votre
casque est maintenant détectable par un smartphone,
une tablette ou tout autre appareil Bluetooth.

2. Allez dans les paramètres de votre appareil, dans le
menu Bluetooth et sélectionnez « X.O. Beach 3D «. Vous
êtes jumelé maintenant à votre appareil. L’indicateur LED
est maintenant éteint. Dans le cas improbable où votre
appareil nécessite un mot de passe pour se connecter au
X.O. Wave Beach 3D, entrez «0000».

1. Qu’est-ce que Boom?

Boom est une application de lecteur de musique haut de

gamme qui redénit votre expérience musicale sur vos

appareils iOS et Android avec son algorithme unique de
mise en scène du son qui produit un son 3D profond,
immersif, immaculé et riche sur n’importe quel casque.
Grâce à sa technologie innovante de son stéréophonique
virtuel, Boom peut complètement transformer votre
expérience musicale. Il fournit des préréglages de

l’égaliseur fait à la main, un contrôle plus n pour les

basses et l’intensité du son pour offrir un son inégalé sur
vos écouteurs.
Boom est spécialement conçu pour fonctionner avec les
casques X.O. Wave Beach 3D.

2. Spécication technique

Boom est compatible avec tous les appareils iOS
exécutant iOS 9 et versions ultérieures. Pour Android,

4. Effet stéréophonique 3D

La caractéristique la plus signicative de Boom est la

technologie effet stéréophonique 3D sur le son qui est
en attente de son brevet. Il offre une expérience de son
immersive, stéréophonique, virtuel qui est envoûtante
et est optimisée pour le casque X.O. Wave Beach 3D! Il
donne plus de charme sur toutes les chansons stockées,
et il fait ressortir l’acoustique et les nuances que vous
auriez pu manquer autrement.

Cliquez sur l’icône «Effets» en bas de l’écran de votre
lecteur de musique pour entrer dans un menu où vous
pouvez trouver l’icône 3D. Appuyez sur l’icône pour
activer / désactiver l’effet 3D.

5. Conguration des haut-parleurs 3D

Cliquez sur l’icône du haut-parleur sur le côté droit du
son 3D stéréophonique pour accéder à l’écran des
paramètres 3D où vous pouvez activer / désactiver
individuellement les canaux en appuyant dessus.

6. Préréglages de l’égaliseur

Le groupe de Presets Equalizer dans Boom vous permet
de choisir parmi 25 scénarios musicaux potentiels adaptés
aux styles d’écoute individuels. Cliquez sur «Effets» et
vous pouvez trouver l’égaliseur avec les préréglages.
Faites-les glisser pour sélectionner des options telles
qu’Électronique, Pop, Bass Booster, Dubstep, et plus
encore. Ou, pour rendre les choses plus faciles, vous
pouvez également laisser Boom appliquer intelligemment
un égaliseur automatique à n’importe quelle chanson!

7. Réglage des basses

Cliquez sur le «Effets» pour entrer dans un menu pour
trouver l’option Full Bass. Vous pouvez appuyer dessus
pour activer / désactiver l’option Full Bass.

8. Curseur d’intensité

Vous pouvez trouver un curseur pour ajuster l’intensité de
l’ambiance 3D à l’intérieur des effets, en dessous du son
avec effet stéréophonique 3D.

9. Jouer des chansons à partir du Cloud

- Aller à la librairie.

- Sélectionnez vos comptes de cloud (Dropbox ou Google
Drive)

- Connectez-vous pour diffuser de la musique enregistrée
dans votre nuage.

- Actuellement, Boom ne prend en charge que les
morceaux stockés localement sur vos appareils iOS
et Android et les morceaux stockés dans vos comptes
Google Drive et DropBox. Vous ne pouvez pas utiliser
Boom sur des morceaux protégés par DRM.

10. Qu’est-ce que Boom peut faire d’autre?

Boom vous permet de créer facilement vos propres
listes de lecture et de créer votre favori. Vous pouvez

également dénir l’option Crossfade pour votre liste

de lecture musicale. Réglez une minuterie de mise en

IT IS IMPORTANT THAT YOU READ AND UNDERSTAND
THIS EULA CAREFULLY BEFORE INSTALLING OR
USING THE SOFTWARE PRODUCT – BOOM.

For all practical purposes, irrespective of the version
nomenclature, the base product name will be used as
“Boom” in the EULA. Boom includes the mobile software,
the associated media, may include printed materials
and may include “online” or electronic documentation

collectively called as ‘App’, ‘Software’ or ‘Software

Product’.
This is a legal Document between you (either an individual

or an entity, herein referred to as ‘User’), LaFab US LLC
(herein referred to as ‘Headset Manufacturer’) and Global

Delight Technologies Pvt. Ltd., (herein after referred to

as ‘Company’). By downloading, copying, installing, or

otherwise using the App, User acknowledges that User
has read this EULA, that User understands it, and that
User agrees to be bound by the EULA. User can install
the App on a Mobile Handset.
“Use” means downloading, installation, copying, storing,
executing, loading, searching, displaying or otherwise
using the Software.

“Content” means audio, video or image les such as

music videos, music, songs, podcasts, audio books,
cover artwork, movies, streaming services, etc.
In case User does not wish to continue or does not agree
with the terms and conditions of this Agreement, User
can exit from the installation or Use of the App.

RIGHTS AND OBLIGATIONS:

1. Copyright: Global Delight and its Products and Logos

are the Trademarks of the Company. All intellectual
property rights in the Software and its associated
documents (including but not limited to any images,
photographs, animations, video, audio, music, text, and
«applets,» incorporated into the Software Product) are
exclusively owned by the Company, and are protected
by applicable Copyright, Trade Secret, Patent and
Trademark laws. The Software is licensed, not sold. User

will not remove any identication, modify or obscure any

proprietary or copyright notice of the Company from any
copy of the Software or documents. In case of misuse of
the intellectual property by any User in any manner or
form, Company will, in appropriate circumstances, initiate
Legal Procedures against the User.
Copyright – Third party services and Content: Boom,
when used on your, mobile handset accesses Content
either residing on the local device and/or through online
or streaming services. Company does not own any
Copyright to such content produced and/or provided
by third party services and use of unauthorized content
by the User is strictly forbidden. Company makes use
of licensed programmatic access to such Content from
third party providers via Software Development Kit (SDK)
and/or Application Program Interface (API). Company
does not allow download, persistent storage or export of
unauthorized content. Company respects the Copyright,
Intellectual Property Rights, Ownership of such Content
by the owners of the Content and Company claims no
ownership or warranties thereof. User is responsible to

respect and abide by the T&C, Copyright and Intellectual
Property Rights (IPR) of all Content displayed and/or
accessed via the App.

2. Grant of License: User can download Software license
from Company’s Website or through other authorized third
party Websites, digital or retail storefronts. All licenses
to the Software are non-exclusive, non-transferable,
limited license to Use of the copy of the Software and its
associated documents.
The Licensed Software is a private app exclusively
available for use in conjunction with Xtyle Odeon wave
series headsets of the Headset Mnfr. The Licensed
Software may be used to play music which are not DRM
protected. The Licensed Software is mobile handset-

specic and non-transferable. In case of accidental

loss, the End User may reinstall the Licensed Software

a maximum number of three times (including the rst

install) in his/her mobile handset. Any update/upgrade to
the Licensed Software shall be at the sole discretion of
the Company. The Licensed Software shall be available
for download and activation by the End User on or before

31 Dec 2020. No other license other than that specically

granted herein shall accrue to the End User.

For iOS Users: This License Software will be made
available to the End Users through Apple Volume
Purchase Program (VPP) as B2C application. Subject
to Apple VPP Guidelines at https://images.apple.com/
business/docs/VPP_Business_Guide.pdf
the App Activation codes can be redeemed only on the US
iTunes App ID. The distribution of the Licensed Software

shall be in compliance with Apple’s VPP guidelines and
such other terms and conditions as may be applicable.
For Android Users: This Licensed Software will be made
available worldwide to the End Users for app activation
code redemption on the Company Android Store page
and is compatible with Android 5.0 and above.
Activation Code (App Activation Code, App Activation
Process)
Users are advised to use the supplied app activation
code to download the iOS and Android version of the
app from the link www.boom3Dapp.com. Supplied app
activation code will be valid for Licensed version of Boom
(iOS and Android) available for download from the above
link. Supplied app activation code in the activation card is
valid till 31 December 2020.

3. Rights and Limitations: User is not authorized to
rent, lease, sell, sublicense, assign or transfer rights in
the Software. User is not authorized to cause any portion
of the Software to be copied onto another person’s
Mobile handsets. User has no ownership rights in the
Software and its associated documents. The Ownership
in the Software and its associated documents rests at
all times with the Company. Failing to Use the Software
as per EULA User is strictly forbidden. In such case the
Company may terminate the EULA and User must destroy
all copies of the Software Product and all of its associated
documents. Company may, at its sole discretion, initiate
legal action against User for such violations, and User
will be prosecuted to the maximum extent possible, which
may result in severe civil and/or criminal penalties.

4. Terms of Use:

User shall not:
(a) Modify, adapt, translate, decompile, disassemble or
reverse engineer the Software or any portion thereof, in
any manner;
(b) Attempt to break security, access, tamper with or use
any unauthorized portion of the Software;
(c) Remove any Copyright, Trade Mark or other
proprietary rights notices contained in the Software;
(d) Attempt to collect or maintain any information about
other users of the Software or other third parties for
unauthorized purposes;
(e) Transmit or attempt to transmit the Software over any
network or between any devices unauthorizedly, enabling
use of the Software on multiple handsets;
(f) Use the Software for transmission of any viruses,
worms, defects, trojan horses or other malicious code or
items of a destructive nature; or
(g) Use the Software for any unlawful, copyright
infringement, harassing, abusive, criminal or fraudulent
purposes.

5. Update, Upgrade, Maintenance, Data: The Company
may from time to time issue updates or upgrades of the
Software, including on different application platforms
(iOS and Android). As part of necessitating an update/
upgrade and maintenance or fraud detection with regards
to the Software, Company may collect user information
such as User’s System information and/or User related
information. Company undertakes to store such
information securely in an encrypted form and take all
reasonable measures to prevent any unauthorized use

of such information.
All updates and upgrades will be available to the User

at a xed price, subscription or free of cost, and on the

conditions prescribed by the Company. Company keeps
the exclusive rights whether to develop or maintain the
Software further or to withdraw the Software from offering
for download, without any prior notice to the Users.

6. Age Factor: Users below 18 years of age should
receive parental or guardian guidance related to
downloading and using the Software. If User is below
eighteen years of age, Company assumes that User
has obtained necessary permission or guidance before
downloading or using the application and that User’s
parents or guardian have no objection in this regard and
have read and understood the T&C and have accepted
the Terms and Conditions and Terms of Use on behalf
of User. In certain countries, the minimum age for
downloading, installing or using digital Software may vary
subject to local laws and the Company assumes that the
User has made an informed and legal decision.

7. Risk: Boom is intended to be used as a personal utility
tool. Boom enhances the handset audio output volume
by using proprietary algorithms. The volume output,
when synthesized through Boom, increases the handset
audio output to the best possible level and enhances the
audibility of the audiostream. The Software has been
designed and thoroughly tested by the Company to get
the optimum audio output levels which under normal
usage do not cause any damage to the sound hardware of
the handsets or headphones or other audio accessories.

User is solely responsible for all the actions and results
related to the use of this Software.

8. Limited Warranty: The Software is provided “As
Is” without warranty of any kind, express or implied,
including, but not limited to, warranties of performance or

merchantability or tness for a particular purpose. User

bears all risk relating to the use of the Software. If the
Software does not perform substantially in accordance
with the documentation, User’s exclusive remedy will be
limited to, at Company’s sole discretion, correction of the
defect in the Software, if any, or refund of the actual cost
paid by the User for the Software, subject to Clause No.
10 below.

9. Customer Remedies: Company offers online support
for this Software, pre and post sale. The nature of support
can be free or on payment basis and the option of switching
from free or on payment basis may be amended without
prior notice, at the discretion of the Company. Company
will try to resolve the issues arising from this Software.
USER will cooperate with the Company Support team
for investigation of issues. This limited warranty is void if
failure of the Software has resulted from accident, abuse,
misapplication or violating the Terms of Use.

10. Service: While Company makes reasonable efforts
to ensure that its services are available at all times,
Company does not guarantee, represent or warrant that
its services will be uninterrupted or error-free. Company
does not guarantee that users will be able to access or
use all the Company assistance for the Software at all

times.

11. No Liability: In no event shall the Company be
liable to the User for any loss, damages, claims or costs
whatsoever including any special, consequential, indirect

or incidental damages, any lost prots or lost savings,

lost data, loss of privacy, any damages resulting from
business interruption, personal injury or failure to meet
any duty of care, or claims by a third party arising out of
the use or inability or inappropriate use of the Software,
even if the Company has been advised of the possibility
of such loss, damages, claims or costs in advance.

12. Legal Terms and Restrictions:

(a) The Software and its associated documents are
exported from India. This EULA is expressly made subject
to any Laws, regulations, orders, or other restrictions on
the export, of the Software or information about such
Software, which may be imposed from time to time by the
Government of India. User shall not export the Software
and its associated documents or any information thereof
without the written permission from the Company.
(b) EULA shall be governed, construed and implemented

by the laws of India without giving effect to conict of laws

principle. All disputes under the EULA
shall be subject to the exclusive jurisdiction of the courts
in Udupi District, Karnataka State, India
(c) No failure to enforce any clause of this EULA shall
constitute a waiver of such clause.
(d) User shall not assign its obligations hereunder in
whole or in part without the prior written approval of the
Company.

(e) If any part of this EULA is for any reason found to be
invalid, illegal or unenforceable, the validity, legality and
enforceability of the remaining provisions of this EULA
shall not be affected and same shall remain in effect.

13. Complete Agreement: This EULA is to be read
together with the agreement between Company, Headset
manufacturer and the User with respect to the subject
matter, and supersedes and voids any proposal prior or
agreement to this EULA, oral or written, and any other
communications between the Parties.

14. Amendments: Company may, at any time, and at its
sole discretion update/modify the Terms and Conditions
without any notice to the User. The most current version
of the Terms and Conditions shall be applicable.
