Guarantee Terms for Photovoltaic Modules Series ND and NU
being purchased by end customers from April 1
Dear SHARP customer, the Sharp photovoltaic modules series ND and NU that you purchased have been carefully manufactured and
subjected to a final inspection. Should a module nevertheless within the guarantee period have a manufacturing-related defect in material or workmanship or manufacturing-relate d loss of power output, then you can, in addition to the statutory warranty rights that you have against your seller, bring forth clai ms against S harp Electronics (Europe) GmbH (hereinafter "Sharp") from this guarantee subject to the following terms.
Section A: Scope of Guarantee
This guarantee applies only to modules series ND and NU, which were placed into the market by SHARP in the EU, in Albania, Bosnia and Herzegovina, Croatia, Iceland, Liechtenstein, Macedonia, Montenegro, Norway, Serbia, Switzerland and Turkey and which have been installed in one of these countries. If there is doubt whether this guarantee applies to your modules, please contact SHARP. We provide you with the opportunity to have the modules registered online at www.brandaddedvalue.com, if your SHARP modules have been placed into the market in the countries listed above. Please note: This guarantee does not apply to modules with the type designation SZ-N (...).
Section B: Guarantee Services
SHARP offers two types of guarantee services that you can claim independently of each other: A 10-y ear
product guarantee (1) as well as a 25-year power output guarantee (2). We shall demonstrate under (3) which services are not covered by the guarantees.
1) 10-Year Product Guarantee

Sharp offers you a 10-year product guarantee exclusively on manufacturing-related material and workmanship defects for the photovoltaic modules series ND and NU.
Commencement of the Guarantee Period
The guarantee period begins on the day on which SHARP or the retailer delivered the module to the end customer.
Services in the Product Guarantee Case
If within the 10-year guarantee period a manufacturing-related material and / or workmanship defect occurs in one of your modules, then Sharp shall at its own discretion repair free of charge or replace the defective module with a comparable non-defective module. If the module type under guarantee is no longer manufactured, an actual and technically compatible module shall be delivered as a replacement.
In addition, SHARP shall in the event of exchange refund the end customer costs for removal and installation of the modules as follows: (i) a one-time lump sum of 130 EUR per system as well as (ii) 20 EUR per module exchanged.
2) 25-Year Power Output Guarantee
In addition to the 10-year product guarantee, Sharp offers you a 25-year powe r output guarantee on photovoltaic modules series ND and NU for manufacturing-related power losses of the modules.

Scope of Guarantee
SHARP shall guarantee 96% of the minimum output power during the first year of the guarantee. From the second guarantee year and for each subsequent year, the guaranteed power output is reduced by 0.667% in each case calculated from the initial minimum output power. Determining the Minimum Output Power and the Guaranteed Percentage
100% of minimum output power is calculated from the maximum power indicated on the nameplate minus the tolerance likewise indicated there.
The actual power of the module is determined and tested subject to the following conditions: Cell temperature of 25 degrees Celsius; radiation power 1000 W / m² with AM 1.5 spectrum, on a system calibrated by Sharp (according to IEC 60904).
Services in the Power Output Guarantee Case
If the actual power output of the module is less than the guaranteed power output resulting from the table, then Sharp shall at its own discretion either
repair the respective module or  replace the respective module or  compensate the lack of power output of the module falling short of the guaranteed value for the duration
of the remaining period of the power output guarantee by means of payment. The compen sation payment is calculated as a lump sum as follows: € 0.0007 EUR is calculated as payment for one watt of power loss to the guaranteed performance per day of operation; or
refund the purchase price for the respective module without deductions, where SHARP can choose this
form of compensation without the end customer's consent only if the module is older than 10 years and there are no longer any suitable spare parts available for SHA RP in order to repair or replace the mod ule, or
compensate the lack of power by supplying additional modules, if (1) the end customer agrees to this or
(2) there is enough space for the installation of additional modules, they are electrically compatible with the existing system, they visually blend in and replacement by supply of additional modules is also acceptable for the end customer.
In addition, SHARP shall in the event of exchange refund the end customer his costs for removal and installation of the modules as follows: (i) a one-time lump sum of 130 EUR per system and (ii) 20 EUR per module exchanged as well as (iii) in the event of delivery of additional modules (installation only) 80 EUR per module delivered.

3) Exclusions of the Product and Power Output Guarantee
Sharp shall assume no guarantee for defects that are not caused by material or the manufacturing pro cess of the module, especially by improper use. Improper use is given in particular when you do not comply with SHARP´s requirements for the installation, maintenance and operation of the modules that are listed in the (safety) instructions, the installation instructions, and the specifications. Please note that the modules were not designed for use on mobile units such as ships and other vehicles and therefore the use of the modules on mobile units is improper Costs incurred for dismantling, reinstallation and customer's inspection as well as other indirect costs are borne by SHARP only in the lump amounts as defined in sections B.1) and B.2). Replacement of a lower energy yield or loss of revenue from electricity sales, which are due to the lack of power of a module or to performing guarantee services are not covered by the guara nte e, unless Sharp d ecide s for the option of compensation payment provided in the "Services in the Power Output Guarantee Case" in B.2).
Section C: No Extension of the Guarantee Period
Rendering guarantee performance within the framework of one of these guarantees and the re-sale of the module to the next operator / end customer does not extend the original duration of the guarantees.
Section D: Asserting the Product or Power Output Guarantee
In order to be able to assert the product or power output guarantee, you need to provide us with the delivery note indicating the delivery date, the invoice indicating the model name and serial number of the module (see type plate) and information about the time of discovery of the product defect or loss of power output. You can assert claims due to a defect or loss of power output under this guarantee only in writing to

Claims must be asserted within six months from discovery of the defect or loss of power output. Defects and power output losses that are asserted after this period are no longer covered by the product or power output guarantee.

Section F: Governing Law, Place of Jurisdiction
1) Governing Law: These manufacturer guarantees are governed by German law excluding Private
International Law as well as the United Nations Convention on Contracts for the International Sale of
Goods(CISG).
2) Place of Jurisdiction Exclusive place of jurisdiction for merc hants , legal entities under public law, or special
funds under public law is Hamburg (Germany).

die ab 1. April 2012 vom Endkunden gekauft worden sind.
Sehr geehrte SHARP Kundin, sehr geehrter SHARP Kunde,
die von Ihnen gekauften SHARP-Photovoltaikmodule der ND- und NU-Serie wurden sorgfältig hergestellt und einer Endkontrolle unterzogen. Sollte ein Modul dennoch einmal einen herstellungsbedingten Material- oder Verarbeitungsmangel oder einen herstellungsbedingten Leistungsverlust innerhalb der Garantiezeit aufweisen, können Sie zusätzlich zu den gesetzlichen Gewährleistungsansprüchen, die Ihnen gegen Ihren Verkäufer zustehen, Sharp Electronics (Europe) GmbH (nachfolgend „SHARP“) aus dieser Garantie unter den nachfolgenden Bedingungen in Anspruch nehmen.
Abschnitt A: Geltungsbereich der Garantie
Diese Garantie gilt nur für Module der ND- und NU-Serie, die durch SHARP in der EU, Albanien, Bosnien und Herzegowina, Kroatien, Island, Liechtenstein, Mazedonien, Montenegro, Norwegen, Serbien, Schweiz und Türkei in Verkehr gebracht wurden und die in einem dieser Länder installiert worden sind. Bei Zweifeln, ob diese Garantie für Ihre Module Anwendung findet, wenden Sie sich bitte an SHARP. Wir bieten Ihnen die Möglichkeit, die Module online auf www.markenmehrwert.com registrieren zu lassen, soweit Ihre Module von SHARP in den oben aufgeführten Ländern in den Verkehr gebracht worden sind. Bitte beachten: Diese Garantie gilt nicht für Module mit der Typenbezeichnung SZ-N(…).
Abschnitt B: Garantieleistungen
SHARP bietet Ihnen zwei Arten von Garantieleistungen, die Sie unabhängig voneinander in Anspruch nehmen können: Eine 10-jährige Produktgarantie (1) sowie eine 25-jährige Leistungsgarantie (2). Unter (3) zeigen wir Ihnen auf, welche Leistungen von den Garantien nicht umfasst sind.
1) 10-jährige Produktgarantie
Sharp bietet Ihnen auf die Photovoltaikmodule der ND- und NU-Serie eine 10-jährige Produktgarantie ausschließlich für herstellungsbedingte Material- und Verarbeitungsmängel.
Beginn der Garantiefrist
Die Garantiefrist beginnt mit dem Tag, an dem SHARP oder ein Händler dem Endkunden das Modul geliefert hat.
Die Leistungen im Produktgarantiefall
Sollte innerhalb der 10-jährigen Garantiefrist ein herstellungsbedingter Material- und/oder Verarbeitungsmangel an einem Ihrer Module auftreten, so wird Sharp nach eigener Wahl eine kostenlose Reparatur oder einen Austausch des mangelhaften Moduls gegen ein vergleichbares mangelfreies Modul vornehmen. Wird der Modultyp, der Gegenstand der Garantieleistung ist, nicht mehr hergestellt, wird als Ersatz ein aktuelles und technisch kompatibles Modul geliefert.
Zusätzlich erstattet SHARP im Falle des Austausches die Kosten des Endkunden für Aus- und Einbau der Module wie folgt: (i) einmalige Pauschale von Euro 130 pro Anlage sowie (ii) EUR 20 je ausgetauschtes Modul.
2) 25-jährige Leistungsgarantie
Neben der 10-jährigen Produktgarantie bietet Sharp Ihnen eine 25-jährige Leistungsgarantie auf Photovoltaikmodule der ND- und NU-Serie für herstellungsbedingte Leistungsverluste der Module.
Beginn der Garantiefrist
Die Garantiefrist beginnt mit dem Tag, an dem SHARP oder ein Händler dem Endkunden das Modul geliefert hat.
