Dystrybutor prowadzący jednostkę handlu detalicznego o powierzchni sprzedaży w rozumieniu art. 2 pkt 19 ustawy z dnia 27 marca 2003 r. o planowaniu i zagospodarowaniu przestrzennym wynoszącej co najmniej 400 m2 poświęconej sprzedaży sprzętu przeznaczonego dla gospodarstw domowych, jest obowiązany do nieodpłatnego przyjęcia w tej jednostce lub w jej bezpośredniej bliskości zużytego sprzętu pochodzącego z gospodarstw domowych, którego żaden z zewnętrznych wymiarów nie przekracza 25 cm, bez konieczności zakupu nowego sprzętu przeznaczonego dla gospodarstw domowych.
