MotorolaMobility LLCor itssubsidiaries' warranty obligations are limited tothe terms and conditionssetforth herein.Subject to the exclusions contained below, Motorola MobilityLLC orits subsidiaries (”Motorola”) warrant thisMobilePhone, and any in-box accessorieswhich accompanysuch Mobile Phone (”Product”) against defectsin materials andworkmanship, under normalconsumer use, for a period ofONE (1)YEAR fromthe date ofretailpurchaseby the originalend-user purchaser, orthe period oftime required by the lawsofthe country where the Product is purchased, whichever is longer(”Warranty Period”).Repairs made under this Limited Warranty are covered for the balance of the originalWarrantyPeriod, or 90 days fromthe date of service, whichever is longer. Any upgrade to the original product willbe coveredonly for thedurationofthe original WarrantyPeriod.This Limited Warrantyisonly available in the country where the Product was purchased. Motorolamay provide service outside the country of purchase, to the extent that it is possibleand underthe terms and conditions ofthe country of purchase.ThisLimited Warranty applies onlyto new Products which are a)manufactured by or forMotorola as identified by the “Motorola” trademark,trade name,or logo legally affixed to them;b) purchased byconsumers from an authorized reseller ordistributorof MotorolaProducts;and c)accompanied by this written Limited Warranty.
WhatWill Motorola Do?
Ifacovered defect ordamage arises and a valid warrantyclaim is received within the applicableWarranty Period, Motorola,at its soleoption, unlessotherwise required byapplicable law,will either (1)repair,at no charge, the defect ordamage using new,used orreconditioned/refurbished functionallyequivalentreplacementparts; or (2) exchange the Product with a replacement Product that is new or whichhas been reconditioned/refurbished or otherwise remanufactured fromnew orused parts and isfunctionally equivalent to theoriginal Product;or (3) refund thepurchasepriceof any Productscovered by the terms and conditions ofthis Limited Warranty.
Products, parts and supporting documentation provided toMotorola aspart ofthe warrantyprocess, shall become the propertyof Motorola, and may not be returned. When areplacement or refundisgiven, the Product for which the replacement orrefundisprovided mustbe returned to Motorola and shallbecome the propertyof Motorola.

This warrantydoesnot apply to:

Consumable parts

Damage caused by usewith non-Motorola products.
fromtheuse ofnon-Motorola branded or certified Products,accessories orotherperipheralequipment,including without limitation housings, parts,or software, are excluded fromcoverage.

Damage caused by accident, abuse,misuse,liquid contact, fire, earthquake or other
external causes
the Productoutside theirpermitted or intended uses asdefined byMotorola, including but not limited to asset forth byMotorola in the Products' User Manual, QuickStart Guide, Online Tutorials, and other documentation), improper storage (e.g. subjecting the Product toextreme temperatures), abuse orneglect (e.g. broken/bent/missing clips/fasteners/connectors); impact damage (e.g. dropping the Product) (ii) contact with liquids, water, rain, extreme humidity, heavyperspiration orothermoisture;sand, food,dirt or similarsubstances(except forProducts sold as resistantto such substances, butonly to the extent the damage was not caused by incorrectlysecuring the phone's protective elements or subjecting the Product to conditions beyond its stated specifications or limits); (iii)use ofthe Products for commercial rentalpurposes; or (iv) external causes or acts which are not the fault ofMotorola, including but not limited to flood, fire, earthquake, tornado orother acts ofGod, are excluded fromcoverage.(e)
Unauthorized Serviceor Modification.
testing, adjustment, installation, maintenance, alteration, or modificationin any way,including but not limited totampering with oraltering the software, by someone otherthanMotorola, or itsauthorizedservice centers, are excluded fromcoverage. Notwithstanding the foregoing, any Product whichhas hadits bootloaderunlocked, orwhose operatingsystem has been altered, including any failed attempts to unlock the bootloader oralter such operating system, isnot covered by this warranty, regardless of whether such modifications are authorized, approved, or otherwise sanctioned by Motorola.(f)
A product or part that has beenmodified in anymanner without thewritten
permission ofMotorola.
Motorola from determining whether such Productsare covered under the termsofthisLimited Warranty are excluded fromcoverage. The forgoing shall include but not be limited to (i)serial numbers, date tags or other manufacturer coding that has been removed, altered orobliterated;(ii) mismatched or duplicated serial numbers; or (iii) broken seals or otherevidence of tampering.
