Zune and Zune Headphones
Hearing Loss
Zune can be loud enough to permanently damage y our hearing. To protect your hearing when using Zune:
Keep the Volume Low
Set the volume loud enough to hear clear ly in quiet surr oundings, and no louder.
Do not increase the volume after you s tart listening. » Your ear s can adapt over time so that high vol ume sounds normal, but the high volume may still damage your hearing.
Do not increase the volume to block out outside noise. » The combination of outside noise and sound from your headphones can damage your hearing. Sealed or noise-canceling headphones can reduce outside noise so that you don’t have to turn up the volume.
If you c an’t under stand someone nearby speaking normally, turn down the vol ume. Sound t hat drowns out normal speech can damage your hearing. Even with sealed or noise-canceling headphones, y ou should be able to hear nearby people speak .
Minimize Your Time Listening to Loud Sound
The more time you spend exposed to loud sound, the more likely you are to damage your hearing. The louder the sound, the l ess time it t akes to damage hearing.
Minimize your time lis tening to loud sound. A t » maximum volume, listening to music on Zune with Zune Headphones can permanently damage your hearing in 15 minutes.
Even l ower volumes can damage hearing if you are » exposed for many hours.
All of the sound that you are exposed to during a day » adds up. If you are exposed to other loud sound, it takes les s time listening to Zune at high vol umes to caus e hearing damage.
To safely use Zune with no t ime limit, keep the volume » low enough that you can c arry on a conversation w ith people nearby.
Replacement Headphones May Be Louder

Other headphones may be louder than Zune Headphones, even if the volume control setting is the same. W hen you change headphones, alway s reset the volume st arting from a low level .
Be Aware of Hearing Loss Symptoms
Stop using Zune and have your hearing checked if:
You experience any hearing l oss. » You hear ringing in your ear s. »
Your speech sounds mufed. » Sound seems dull or at. »
It is a good idea to have your hear ing checked regularly by an audiologist. For more inf ormation, see www.zune.net/health.
Be Aware of Your Surroundings
Do not use Zune Headphones or watch v ideos while driving,
cycling , or walking near t rafc. Avoid adjus ting Zune FM
transmitter control s while driving. It is saf est to adjust the control s while stopped or have a pas senger adjust them.
Always keep the volume low enough to hear people talking
and sounds that might indicate danger, like re alar ms.
Avoid Infections with Zune Headphones
Dirty Zune Headphones can lead to ear infections. Clean your headphones frequently with an antisept ic, such as isopropyl alcohol. If the headphones cause irritation, stop using them. This coul d be a sign of inf ection, or lead to infection.
Zune Device
Battery Safety
The Zune device cont ains a built- in batter y, improper use of w hich may result in explosion. Do not heat, open, puncture, mutilate, or dispose of the produc t in re. Do not le ave Zune in direct sunl ight for an extended period of time, which could cause melting or battery damage.
Boarding Aircraft
Before boarding any aircraf t or packing a Zune w ireless device in luggage that wil l be checked, turn the pr oduct of f.
This w ireless device can transmit radio fre quency (RF)
energy, much like a c ellular telephone, when the w ireless device is turned on. Turn o ff Zune wireless when using the
Zune device in ight. To do this , go to Settings, select
Wireles s, and then select Of f.
Photosensitive Seizures
A very small per centage of people may experience a seizure when ex posed to certain visual images, including
ashing light s or patterns that ma y appear in video games.
Even peopl e who have no history of seizures or epilepsy may have an undiagnosed condition that can c ause these “photosensitive epil eptic seizure s” while watching video games.
Thes e seizures may have a variety of s ymptoms, including lightheadedness, alt ered vision, eye or face twitching, jerk ing or shaking of arms or l egs, disorientation, conf usion, or momentary loss of awareness. Seizures may al so cause loss of consciousness or conv ulsions that can lead to injur y from falling down or str iking near by object s.
Immediately st op playing and consult a doc tor if you experience any of these symptoms. Par ents should watch for or ask their children about the above symptoms— children and teenagers are more likely than adul ts to experience these seizures . The risk of photosensitive epileptic seizure s may be reduced by t aking the f ollowing precautions:
Sit farther from the TV screen. »

Use a smaller TV screen. » Play in a wel l-lit room. » Do not play w hen you are dr owsy or fatigued. »
If you or any of your relatives have a his tory of seizures or epilepsy, consult a doctor before playing.

Do Not Attempt Repairs
Do not attempt to take apart, open, serv ice, or modi fy the product , accessories, or po wer supply. Doing so coul d pres ent the risk of electric shock or o ther hazard. Any evidence of any attempt to open and/or modif y the device, including any peeling, puncturing, or removal of any of the labels, will void the Limited Warr anty.
Refer all servicing to quali ed personnel . Servicing is
required w hen the product has been damaged in any way, such as the AC adapter has been damaged, liquid has been spilled into the product, the product has been exposed to rain or other types of mois ture, the product does not operate normally, or the product has been dropped.
Heed all warnings and follow all instructions.
Do Not Use Near Water
Do not use this product near water. To reduce the risk of re
or shock, do not ex pose this product to rain or other types of moisture.
Cable and Cord Safety
Arrange all cables and cords so that people and pets are not likely to trip over or accidentally pull on them as they move around or wal k through the area. Do not allow children t o play with cables and cords.

To prevent vehicle batter y drain, dis connect the Zune Car Pack ’s FM transmitter/charger from your vehicle’s power outl et when you won’t be using the transmit ter for a long period of time.

LIMITED WARRANTY
The term “Zune Product ” means the Microsof t Zune device,
including (when consider ed as a whole) the Micros oft
sof tware embedded in microproce ssors within the Zune and Zune-compatible hardware manufactured by or for Microsoft, whether included with the Zune device or purchased separately. Us e of the Zune Product const itutes acceptance of t hese terms and conditions. If you choose not to accept these terms and condit ions, return the unused Zune Product in its original packaging within 5 days a fter purchase.
A. WARR ANTIE S.
1 Year Express Warranty. » Subject to the terms
and conditions o f this Limited Warranty, Microsof t
warrants to you only (the or iginal purchaser), that
under normal use and ser vice, the Zune Product will subs tantial ly conform wit h the accompany ing printed user instruction material s for a period of 1 year starting as of the date of your sales r eceipt (the
“Warranty Period”).
Implied Warranty. » You may al so have an implied warrant y and/or condition under the l aws of some jurisdic tions, which is hereby limited to the duration o f the War ranty Period. Some jurisdic tions do not allow limitat ions on how long an implied warranty or condition las ts, so the f oregoing limitation ma y not apply t o you.
As to any defects discovered after the Warrant y » Period, there is no warranty or condition of any k ind.
B. OBTAINING WA RRAN TY SERVICE.

To recei ve instr uctions f or obtaining repair or replacement warranty serv ices you must sign in at www. zune.net/repair.
You must al so:
Submit proof of purch ase in the form of a bona de, » dated bill of sale, receipt, or invoice (or a c opy)
evidencing that your request f or service is made within the War ranty Period.
Foll ow Microsoft’s shipping and other inst ruction s if » it determines that al l or part of your Zune Product requires r eturn for r epair or replacement. To obtain the warrant y service, you must take or deliver the Zune Product in suit able packaging that prov ides an adequate degree of protection against damage during transit to the location specied by Microsoft. Except as otherwise requir ed by legislat ion in your jurisdic tion, cos ts associated with transport ( including
packaging) for warrant y service shall be at your
expense.
Dele te or remove any l es or data you cons ider private » or condential prior to sending the Zune Product to
Microsoft.
Failure to follow the above instructions may result in delays, cause you to incur addi tional charge s, or may void your warranty.
C. EXCLUSI VE REMEDY.
During the Warranty Period and subject to applicable law, Microsoft will , at its option and as your exclusi ve remedy for breach of this Limited Warranty or any implied warranties:
Repair or replac e a defective Zune Pr oduct, or » Foll owing return of your Z une Product, make payment »
to you f or the allowable damages that y ou incur in
reas onable reliance but only up to the amount of the purchase price that you paid for your Zune Pr oduct. This r efund may include a deduct ion for depr eciation based on your actual use.
Any replacement parts or Zune Product will be new » or ref urbished or ser viceably used, comparable in func tion and per formance to the original part or Zune Product , and warranted f or the remainder o f the original Warranty Period or 30 days f rom the date of shipment of the Zune Produc t back to you, whichever is longer.

After the Warrant y Period has expired, Micr osoft ma y » charge you a f ee for its effort s to diagnose and /or service any Zune Produc t-relat ed problems.
Microsoft will us e commercially reasonable effort s to » diagnose and attempt to correct, or suggest solutions for, Zune Product defects that are co vered by this Limited Warran ty. MICROSOFT DOES NOT PROVIDE AN Y WARR ANTIES REGARDING IT S WARRAN TY SERV ICES AND, E XCEPT FOR T HE PRECEDING SEN TENCE,
DISCLA IMS ALL DUTIES (IF ANY ) OF WORKMANLIKE
EFFORT OR OF L ACK OF NEGL IGENCE.
D. NO OTHER WARRA NTIES .
The express warranty stated in Section A is the only express warrant y made to you and is pr ovided in lieu of all
other expres s or implied warranties and conditions (if any)
including any created by any other documentation or packaging. No other warr anties or condi tions are made
with respect to the Zune P roduct or t he warranty services by any per son, including but not limited to Microsoft and its suppliers. No inf ormation (oral or written) or suggestions given by Microsoft, it s agents
or suppliers, or its or their employees, shall create

a warr anty or condition or e xpand the scope of this Limited Warranty. Also, there is no w arranty or condition
of title, quiet enjoyment, or non-infringement in the Z une Product . You may have greater rights exis ting under legisla tion in your juris diction. Where any term of this Limited Warranty is prohibited by such laws, it shall be null and void, but the remainder of the Limited Warrant y shall remain in full force and ef fect.
E. EXCLUSIONS FROM L IMITED WA RRAN TY.
This L imited Warranty shall not apply and Microsof t has no liability under this Limited Warr anty if the Zune Product:
suf fers scratches, crack s, or other cosmetic damage as » a result of normal wear and tear and/or accident
or abuse;
is used with non-Microsoft hardwar e product s or » sof tware not licensed by Microsoft (including but not
limited to adaptors and power supply s ources) or which are other wise not compatible;
is used for commercial purposes (including rental »
or lease); is modied or tampered; »
is damaged by Act s of God, power sur ge, misuse, » abuse, negligence, accident , wear and tear, mishandling, misapplicat ion, intrusion of or exposure to liquids , or other causes unrelated to defec tive
materials or workmanship; serial number is defaced, altered, or removed; » is damaged by programs, data, viruses, or les, or »
during shipments;
is not used in accordance with the accompanying »
documentation and use ins tructions; or is opened, disas sembled, rep aired, modied, or altered »
by other than Microsoft a uthoriz ed repair centers.
This L imited Warranty does not c over your da ta or any separate sof tware or content whether or not packaged or included w ith the Zune Product, or any Zune accessories or peripheral dev ices that are not manufactured by or f or Microsoft.
F. EXCLUSION OF CONSEQUEN TIAL, INCIDEN TAL, AND CER TAIN OTHER DA MAGES and LIMITATION OF LI ABILI TY.
TO THE FULL E XTENT A LLOWED BY LAW, MICROSOFT IS NOT LIA BLE FOR ANY:
(i) CONSEQUEN TIAL OR INCIDENTAL DAMAGES ; (ii) DAMAGES OR LOSS OF ANY NATURE W HATSOEVER
RELATING T O LOST PROFIT S, LOSS OF DATA OR PRIVACY OR CONFIDENTIALI TY, ANY INABILIT Y TO USE ALL OR PART OF THE ZUNE PRODUCT, PERSONA L INJURY, OR ANY FAILURE TO MEE T ANY DUT Y (INCLUDING BU T NOT LIMIT ED TO ANY
LACK OF NEGLIGENCE OR OF WORKMA NLIKE EFFORT ); OR (iii ) INDIRECT, SP ECIAL, OR PUNI TIVE DAMAGES ARISING
OUT OF RELATING IN ANY WAY TO THE ZUNE PRODUC T. THE FOREGOING APPLIES EVEN IF MICROSOF T OR ANY
SUPPLIER OR AGENT HA S BEEN ADVISED OF THE

The soft ware developed for the Zune Produc t is » licensed to you, not sold. You are licen sed to use such sof tware only in your Zune P roduct and you ma y not reverse engineer it , except as expressly permitted by applicable law not withstanding this limitation.
You are solely responsible f or your compliance with »

Your Zune Product and its internal components are » new pursuant to indus try standar ds, unles s otherwise indic ated on the Zune Pr oduct ret ail packaging as “Refurbished”.
You agree to comply with all applicable export l aws » and regulations if you export the Product outside of the United States.

Zune Product. This r efund may include a deduct ion for depreciation b ased on your actual use.
Unless prohibited by law, any replacement parts or repl acement Zune Produc t will be new, refurbished or serviceably used and will be comparabl e in function and performance to the original part or model of Zune Product. The repaired and/or replaced part s or Zune Product w ill be warranted for the remainder of the or iginal Warrant y Period or 30 days f rom the dat e of shipment of the Zune Product back to you, whichever is longer. Where requir ed by applicable law, the original Warrant y Period will be deemed to be extended for the period of time equal to the time which t he Zune Product was in Microsof t’s possession.
YOU AGREE TH AT MICROSOFT IS NOT LI ABLE TO YOU FOR ANY L OSS OF YOUR DATA OR CONTENT RESULTING FROM MICROSOF T’S REPAIR OR REPLA CEMENT OF YOUR ZUNE PRODUCT.

No other warranties or conditions ar e made with r espect to the Zune Product or the warranty s ervices by any person, including but not limited to Microsoft and its supplier s.
