Zune and Zune Headphones
Hearing Loss
Zune can be loud enough to permanently damage your hearing. To protect your hearing when using Zune:
Keep the Volume Low
Set the volume loud enough to hear clearly in quiet surroundings, and no louder.

Do not increase the volume after you start listening. Your ears can adapt over time so that high volume sounds normal, but the high volume may still damage your hearing.
»
Do not increase the volume to bl ock out outside noise. The combination of outside noise and sound from y our headphones can damage your hear ing. Sealed or noise-canceling headphones can reduce outside noise so that you don’t have to turn up the volume.
If you c an’t understand someone nearby s peaking normal ly, turn down the volume. Sound that drowns out normal speech can damage y our hearing. Even with s ealed or noise-canceling headphones, you should be able to hear nearby people speak.
Minimize Your Time Listening to Loud Sound
The more time you spend exposed to loud sound, the more likely you ar e to damage your hearing. T he louder the sound, the less time it takes to damage hearing.

Minimize your time l istening to loud sound. At maximum volume, listening to mus ic on Zune with Zune Headphones can permanently damage your hearing in 15 minutes.
»
Even l ower volumes can damage hearing if you are exposed f or many hours.
»
All of the sound that you are exposed to during a day adds up. If you are exposed to other loud sound, it takes less time listening to Zune at high volumes to cause hearing dam age.

To safely use Zune with no time limit, keep the volume low enough that you can carry on a conversation with people nearby.

Other headphones may be l ouder than Zune Headphones, even if the volume c ontrol setting is the same. When you change headphones, always reset the volume st arting from a low level .
Be Aware of Hearing Loss Symptoms
Stop using Zune and have your hearing checked i f:

Your speech sounds mu fed.

Sound seems dull or  at.

It is a good idea to have your hearing checked regularly by an audiologist. For more information, see ww w.zune.net/health.
Be Aware of Your Surroundings
Do not use Zune Headphones or watch videos while driving,
cycling, or walking near trafc. Avoid adjusting Zune FM
transmit ter contr ols while driv ing. It is sa fest to adjust the controls whil e stopped or have a passenger adjust them.
Always keep the volume l ow enough to hear people talking
and sounds that might indicate danger, like re alarms.
Avoid Infections with Zune Headphones
Dirty Zune Headphones can lead to ear infections. Clean your headphones frequently with an antiseptic, such as isopropy l alcohol . If the headphones cause irritat ion, stop using them. This could be a sign of infection, or lead to infection.
Zune Device
Battery Safety
The Zune dev ice contains a built-in batt ery, improper use of w hich may result in explosion. Do not heat, open, puncture, mutilate, or dispose o f the product in re. Do not leave Zune in dir ect sunlight for an extended period of time, which could cause melting or battery damage.
Boarding Aircraft
Before boarding any air craft or packing a Zune wireless device in luggage that w ill be checked, turn the product of f.
This w ireless device can transmit radio frequency (RF)
energy, much l ike a cellular telephone, w hen the wireles s device is turned on. Turn of f Zune wireless when using the
Zune device in ight. To do this, go to Settings, sel ect
Wireless, and then select Off.
Photosensitive Seizures
A very smal l percentage of people may ex perience a seizure when exposed to cer tain visual images, including
ashing lights or pat terns that may appear in v ideo games .
Even people who have no histor y of seizures or epilep sy may have an undiagnosed condition that can cause these “photosensitive epilep tic seizures” while watching video games.
Thes e seizures may have a variety of sy mptoms, including lightheadedne ss, alter ed vision, eye or f ace twitching, jerk ing or shaking of arms or legs, disorientation, conf usion, or momentar y loss of awareness . Seizures may al so cause loss of consciousness or convul sions tha t can lead to injury from fall ing down or striking ne arby objec ts.
Immediately stop playing and consult a doctor if you experience any o f these symptoms. Parent s should watch for or ask their chil dren about t he above sy mptoms— children and teenagers are more likely than adults to experience these seizures. The risk o f photosensitive epileptic seizures may be reduced by tak ing the following prec autions:
Sit farther from the T V screen.

Play in a well-lit room.

Do not play when you are drowsy or fatigued.

If you or any of your relatives have a history of seizures or epilepsy, consult a doctor before play ing.

Do Not Attempt Repairs
Do not attempt to t ake apart, open, service, or modify t he product, accessor ies, or power supply. Doing so could present the risk o f electric shock or other hazard. Any evidence of any at tempt to open and/or modify the device, including any peeling, puncturing, or removal of any o f the labels, w ill void the Limited Warranty.
Refer all servicing t o qualied pers onnel. Servicing is
required when the product has been damaged in any wa y, such as the AC adapter has been damaged, liquid has been spilled into the product, t he product has been exposed to rain or other t ypes of moisture, the product does not operate normally, or the product has been dropped.

Cable and Cord Safety
Arrange al l cables and cords so that people and pets are not likely to trip over or accidental ly pull on them as they move around or walk through the area. Do not al low children to play with c ables and cords.

To prevent vehicle battery dr ain, disconnect the Zune Car Pack ’s FM transmitter/charger fr om your vehicle’s power outl et when you won’t be using t he transmitter for a long period of time.

The term “Z une Produc t” means the Micr osoft Zune dev ice,
including (when considered as a whole) the Microsoft
sof tware embedded in microprocessors w ithin the Zune and Zune-compatibl e hardware manufactured by or for Microsof t, whether included with the Zune device or purchased separately. Use of the Zune Product const itutes acceptance of these terms and conditions. If you choose not to accept these terms and conditions, return the unused Zune Product in it s original packaging within 5 days after purchase.
A. WARRANTIES.
1 Year Express Warranty. Subject to the terms

and conditions of t his Limited Warr anty, Microsof t
warrants to you only (the original purcha ser), that
under normal use and service, the Zune Product w ill subs tantial ly conform with the accompanying prin ted user instruct ion materials f or a period of 1 year starting as of the date of your sales receipt (the
“Warranty Period”).
Implied War ranty. You may also have an implied

warranty and/or condition under the laws of some jurisdictions, which is hereby limited to the duration of the War ranty Period. Some jurisdictions do not all ow limitations on how long an implied warranty or condition lasts, so the foregoing limitation may not apply t o you.

Foll ow Microsoft ’s shipping and other instructions if it determines that all or part of your Zune Pr oduct requires return for repair or replacement. To obtain the warranty service, you must take or del iver the Zune Product in suitable packaging that provides an adequate degree of protection agains t damage during transit to the location specied by Microsoft. Except as other wise required by legislation in your jurisdiction, costs associated with transport ( including
packaging ) for warranty serv ice shall be at your
expense.

C. EXCLU SIVE RE MEDY.
During the Warranty Period and subject to applicabl e law, Microsof t will, at its option and as your exclusive remedy for breach of this L imited Warrant y or any implied warranties:

Repair or replace a defective Zune Product, or

Foll owing ret urn of your Zune Product, make payment to you f or the allowabl e damages that you incur in
reas onable reliance but only up to the amount of the purchase price that you paid for your Zune Pr oduct. This r efund may include a deduction for depreciation base d on your actual use.
Any replacement parts or Zune Product will be new

or ref urbished or ser viceably used, comparabl e in func tion and per formance to the original part or Zune Product, and warranted for the remainder of the original War ranty Period or 3 0 days from the date of shipment of t he Zune Product back to you, whichever is longer.

After the Warranty Period has ex pired, Microsoft may

Microsof t will use commercially reasonable efforts to

D. NO OTHER WARR ANTIES.
The express warranty st ated in Sec tion A is the only express warranty m ade to you and is prov ided in lieu of all
other express or implied warranties and conditions (if any)
including any created b y any other documen tation or packaging. No other warranties or condi tions are made
with respect to the Zune Product or the warranty services by any person, including but not limited to Microsoft and its suppliers . No inform ation (oral or written) or sugges tions given by Microsoft, its agents
or suppliers, or its or t heir employees , shall create

a warr anty or condition or expand the scope of t his Limi ted Warranty. Also, there is no warranty or condit ion
of title, quiet enjoyment, or non-infringement in the Zune Product. You may have greater r ights existing under legislation in your jurisdiction. Where any term of this Limited War ranty is prohibited b y such laws, it shall be null and void, but t he remainder of the Limited War ranty shall remain in full for ce and eff ect.
E. EXCLUSIONS FROM LIMITED WARRA NTY.
This L imited Warrant y shall not apply and Microsoft has no liabilit y under this Limited War ranty if the Zune Product:
suf fers scratches, cracks, or other cosmetic damage as

a result of normal wear and tear and/or accident
or abus e;
is used with non-Microsof t hardware product s or
»
sof tware not licensed by Microsof t (including but not
limited to adapt ors and power supply sour ces) or which are otherwise not compatible;
is used for commercial purpos es (including rental

or lease); is modied or tampered;
»
is damaged by Acts of God, power surge, misuse,
»
abuse, negl igence, accident, wear and tear, mishandling, misapplication, intrusion of or exposure to liquids, or other causes unrelated to defective
material s or workmanship; serial number is defaced, altered, or removed;
»
is damaged by progr ams, data, viruses, or les, or
»
during shipments;
is not used in accordance with t he accompanying
»
documentation and use instruct ions; or is opened, disassembled, repaired, modied, or altered
»
by other than Microsoft authorized repair centers.
This L imited Warrant y does not cover your data or any separate s oftware or content whether or no t packaged or included with the Zune Product, or any Zune acce ssories or peripheral devices that are not manufactured by or f or Microsof t.
F. EXCLUSION OF CONSEQUENTIAL , INCIDENTAL, AND CERTA IN OTHER DAM AGES and LIMITATION OF LIABILIT Y.
TO THE FULL EXTENT ALLOW ED BY LAW, MICROSOF T IS NOT LIA BLE FOR ANY:
(i) CONSEQUENT IAL OR INCIDENTA L DAMAGES; (ii) DAMAGES OR LOSS OF ANY NATURE WHATSOEVER
RELATING TO LOST PROFITS, LOSS OF DATA OR PRI VACY OR CONFIDENTIALIT Y, ANY INABILITY TO USE ALL OR PART OF THE ZUNE PRODUCT, PERSONAL INJURY, OR AN Y FAILURE TO MEE T ANY DUT Y (INCLUDING BUT NOT LIMITED TO AN Y
LACK OF NEGL IGENCE OR OF WORKM ANLIKE EFFORT); OR (iii ) INDIRECT, SPECIAL, OR PUNIT IVE DAMAGES ARISING
OUT OF RELATING IN ANY WAY TO THE ZUNE PRODUCT. THE FOREGOING APPLIES EVEN IF MICROSOF T OR ANY
SUPPLIER OR AGENT HAS BEEN ADVISED OF THE
POSSIBIL ITY OF SUCH LOSSES OR DAMAGES; E VEN IN THE EVENT OF FAULT, TORT (INCLUDING NEGLIGENCE), STRICT
OR PRODUCT LIABILITY, MISREPRESENTATION OR O THER
REA SON; AND EVEN IF A NY REMEDY FAILS OF ITS

The soft ware developed for the Zune Product is

licensed t o you, not sold. You ar e licensed to use such sof tware only in your Zune Pr oduct and you may no t reverse engineer it, e xcept as ex pressly permitted by applicable law notwith standing this limitation.
You are solely r esponsible for your compliance w ith

Your Zune Product and its internal components are

new pursuant to industry standards, unless otherwise indic ated on the Zune Product retail packaging as “Ref urbished”.
You agree to comply with all applicabl e export laws

This Limited Warranty applies to the original purchaser

only and may not be as signed or transferred. However, some jurisdictions extend the protection of implied warranties to subsequent consumers and theref ore this limitation may not apply to you.

The repaired and/or repl aced parts or Zune Product will be warranted for t he remainder of the original War ranty Period or 30 days from the date of shipment of t he Zune Product back to you, whichever is longer. Where required by applicable law, the original Warrant y Period will be deemed to be extended for the period o f time equal t o the time which the Zune Product was in Micr osoft ’s possession.
YOU AGREE THAT MICRO SOFT IS NOT LIABLE TO YOU FOR ANY L OSS OF YOUR DATA OR CONTENT RE SULTING FROM MICROSOF T’S REPAIR OR REPL ACEMENT OF YOUR ZUNE PRODUCT.
After the Warranty Period has ex pired, Microsoft may charge you a fee for its ef forts to diagnose and/or service any Zune Product-related probl ems.

The express warranty st ated in Sec tion A and the expr ess warranty regarding the Microsoft warranty serv ices in Section C ar e the only expres s warranties made to you, and to the m aximum exten t permitt ed by law Microsoft disclaims all other warranties and conditions, express, statutory, implied or collateral , including any created by any other documentation or packaging. No other warranties or conditions are made wi th respec t to the Zune Product or the warranty services by any person, including but not limited to Microsof t and its suppliers.
No inf ormation (oral or written) or sugges tions given

by Microso ft, its agents or suppliers, or its or their employees, shall create a warranty or condition or expand the scope of this Limi ted Warranty. Also, there
is no warranty or condit ion of titl e, quiet enjoyment, or non­infringement in t he Zune Product. You may have greater rights ex isting under legislation in your jurisdict ion. Where any term of this Limited Warranty is prohibited by such laws, it shall be null and void, but the remainder of the Limited War ranty shall remain in f ull force and ef fect.

This L imited Warrant y shall not apply and Microsoft has no liabilit y under this Limited War ranty if the Zune Product:
