LIMITED WARRANTY:

Limited Warranty

One Hundred and Eighty (180) Day Limited Hardware Warranty: Subject to the additional terms and

conditions set forth below, Mayfonk Athletic, llc dba VERT (“VERT”) provides this Limited Warranty: Only to the
person or entity that originally purchased the G-VERT™ device from VERT or from one of its authorized resellers or
distributors; and Only for a G-VERT™ device purchased and delivered to the end user within the United States.

Limited Warranty:

VERT warrants the G-VERT™ device (“G-VERT”) hardware against defects in materials and

workmanship under normal use for a period of one hundred and eighty (180) days from the date of purchase
(“Warranty Period”). This Limited Warranty is valid only in the United States for products sold in the United

States. A replacement product or part assures the remaining warranty of the original Product or ninety (90) days
from the date of replacement or repair, whichever is longer.

If VERT determines that the G-VERT’s™ hardware is defective, VERT will either repair the unit or replace the unit
with either a new or rebuilt G-VERT™ unit, at its option. If VERT determines the Warranty Period has expired or
is otherwise not applicable (see Scope of Limitation on Warranty below), we will return the G-VERT™ to you.

SOLE OBLIGATION AND YOUR EXCLUSIVE REMEDY IN THE EVENT OF ANY BREACH OF THIS LIMITED WARRANTY.

before seeking warranty service or contact us at [e-mail] attention: warranty service. To return or obtain
warranty service for a G-VERT™ device, you must rst obtain a Return Merchandise Authorization (RMA) number

form a Customer Support Representative (CSR) at VERT. Customer Support contact information can be found by
visiting www.myvert.com. RMA numbers expire thirty (30) days from issuance. VERT may attempt to troubleshoot
a warranty-related problem prior to issuing a RMA number. Please be prepared to provide additional information
upon request. Once a RMA number is obtained, you must ship your G-VERT™ unit, together with proof of pur-

chase and all accessories, in either the original packaging or packaging affording an equal degree of protection,
to the VERT authorized distribution facility identied by the CSR. Failure to return any of the accessories could

result in a delay and/or result in an invoice to you or credit to VERT for missing accessories. It is your responsibility

to backup any data, pictures, or other materials you may have stored or preserved on the Product.

Important: When emailing for a RMA number, please provide the following information with your request:

(a) model number, (b) serial number, (c) detailed problem description and reason for return, (d) date of
purchase, (e) place of purchase (reseller or online place of purchase), and (f) return shipping address (P.O.
boxes are not accepted).

Scope of and Limitation of Warranty: The warranty on the G-VERT™ device is limited to the repair or replace-

ment of defective units as described in the Limited Warranty section above. This warranty does not cover
customer training or education, app installation, set up adjustments, or wireless signal reception problems. This
warranty also does not cover any issue related to the service provided by your cellular Service Provider, including
but not limited to service disruption, changes in service terms, changes in offerings or technical problems. This
warranty does not cover damage due to acts of God, accident, misuse, abuse, negligence, commercial use or

modication of, or to any part of, your G-VERT™ device. This warranty does not cover damage due to improper

operation or maintenance, connection to improper voltage supply or attempted repair by anyone other than
a facility authorized by VERT to service your G-VERT™ device. This Limited Warranty applies only to the Product

manufactured by or for VERT that can be identied by the “G-VERT™” trademark, trade name, or logo afxed to

original box. The Limited Warranty does not apply to any (a) VERT products and services other than the Product,

(b) non-VERT hardware product, (c) software, even if packaged or sold with the Product or embedded in the

Product. Refer to the licenses accompanying the software for details of your rights with respect to its use. VERT
does not warrant the operation of the Product will be uninterrupted or error-free. VERT is not responsible for
damage arising from failure to follow instructions relating to the Product’s use.

Implied Warranties: EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, THIS WARRANTY AND THE

REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND
CONDITIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. VERT DISCLAIMS ALL STATUTORY
AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. INSOFAR AS
ANY WARRANTIES CANNOT BE DISCLAIMED, VERT LIMITS THE DURATION AND REMEDIES OF SUCH WARRAN­TIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT VERT’S OPTION, THE REPAIR OR REPLACEMENT
SERVICES DESCRIBED BELOW.

Limitation of Liability: EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, VERT SHALL NOT BE LIABLE

FOR ANY DIRECT, INCIDENTIAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY
BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY.

Governing Law and Arbitration. This Limited Warranty shall be governed by the laws of the State of Florida

without giving effect to any conict of laws principles that may provide the application of the law of another

jurisdiction. Any claim or dispute in connection with this Limited Warranty shall be resolved in a cost effective
manner through binding non-appearance-based arbitration. The arbitration shall be initiated through an
established alternative dispute resolution provider and the parties must comply with the following rules: a) the

arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specic

manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal
appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment
on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. If the foregoing
arbitration clause does apply for any reason, you agree to submit to the personal jurisdiction of the state courts
located within Broward County of Florida for the purpose of litigating all such claims or disputes, which courts
shall have exclusive jurisdiction of such claims or disputes. Notwithstanding the foregoing, VERT may seek in­junctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.

HOW TO WEAR G-VERT™

Charging your G-VERT™ Integrated VERTbelt

Blue light on

VERT CHARGING

1. Charge your G-VERT™ unit. IMPORTANT: Charge for (2) hours continuous on FIRST charge.

The red light will disappear when fully charged. The blue light will stay on even when it is fully

charged. A typical charge will take around (2) hours.

2. Download the latest version of the VERT® App from the App Store.

If you are using an iPad you can download the app using Safari.

3. Turn on G-VERT™ unit by holding down push button for 2-3 seconds. All interactions for device

settings, etc. will be controlled from the VERT® App.

4. Open the App and follow instructions or go to Settings -> G-VERT™ sensors

5. To sync your G-VERT™ unit, simply tap “connect” and your G-VERT™ unit is synced. Make sure

Bluetooth® is turned on.

6. Personalize your App: Go to settings under “My Prole” and set up your picture, name and

more!

G-VERT™ unit in BEST “core” placement.

Use VERT belt during practice or game performance. Please wear G-VERT™ unit in the front area
near mid-section for (1) safety reasons and (2) accuracy of measurements.

(1) Safety reasons: DO NOT WEAR G-VERT™ on top of hip,

tailbone and/or spine.

(2) Accuracy: G-VERT™ is based around measuring center of body mass or appendage and has
the best accuracy when worn near the waist or appendage of an individual.

• Make sure the G-VERT™ unit is CHARGED.

• Make sure the G-VERT™ unit is ON, conrm by pushing button and viewing status on

VERT app.

• Make sure battery is fully charged (this will be shown on App once it is paired).

• Make sure G-VERT™ unit is near your smart device for pairing. If you are using multiple

G-VERT™ units during multi-appendage mode, push the button on the G-VERT® unit you
want to pair while viewing VERT app. Press connect on VERT app and verify your connection

by pressing the push button and see background of app connection change COLORS every

time you press push button on G-VERT™ unit. Upon pairing, you will have the ability to
assign an appendage.
