INFORMATIO N ABOUT YOUR RIG HTS AND
OBLIGATIONS, AS WELL AS LIMITATIONS AND
EXCLUSI ONS THAT MAY APPLY TO YOU.
1. WHAT THIS LIMITE D WARRANT Y COVERS;
PERIOD OF COVERAGE
Nest Labs, Inc. (“Nest Labs”), 3400 Hillview Avenue,
Palo Alto , Californi a USA, warra nts to the own er of the
enclosed product that the product contained in this
box (“Pro duct”) wil l be free from d efects in m aterials
and work manship for a pe riod of two (2) y ears from th e
date of delivery following the original retail purchase
(the “War ranty Per iod”). If the Pr oduct fail s to conform
to this Lim ited Warran ty during the W arranty P eriod,
Nest La bs will, at it s sole discre tion, eith er (a) repair or
replace any defective Product or component; or (b) accept
the retu rn of the Prod uct and ref und the money a ctually
paid by the o riginal pur chaser for th e Product. R epair
or repla cement may b e made with a new o r refurbish ed
product or components, at Nest Labs’ sole discretion.
If the Pro duct or a comp onent incor porated wi thin it is
no longer a vailable, Ne st Labs may, at Ne st Labs’ so le
discretion, replace the Product with a similar product
of simila r function . This is your s ole and exclus ive remed y
for brea ch of this Limi ted Warrant y. Any Produc t that
has eith er been rep aired or rep laced unde r this Limite d
Warrant y will be cov ered by the ter ms of this Limit ed
Warrant y for the lon ger of (a) ninet y (90) days from t he
date of de livery of t he repaire d Product or r eplacem ent
Produc t, or (b) the rem aining Warran ty Period. T his
Limite d Warranty is t ransfera ble from the or iginal
purchaser to subsequent owners, but the Warranty
Period w ill not be ext ended in dura tion or expan ded
in cover age for any suc h transfer.
2. TOTAL SATISFAC TION RET URN POLICY
If you are th e original pu rchaser of t he Product a nd you
are not sa tisfied wit h this Produc t for any reas on, you
may retur n it in its orig inal condit ion within thir ty (30)
days of the o riginal pur chase and re ceive a full r efund.
3. WARRA NTY CONDI TIONS; HOW TO GE T SERVICE IF
YOU WANT TO CL AIM UNDER TH IS LIMITED WARR ANTY
Befor e making a clai m under this Lim ited Warran ty, the
owner of th e Product mu st (a) notif y Nest Labs o f the
intent ion to claim by v isiting nes t.com/suppo rt during
the Warra nty Perio d and provid ing a descrip tion of th e
alleged f ailure, and (b) c omply with Ne st Labs’ re turn
shipping i nstructi ons. Nest L abs will have no warrant y
obligat ions with res pect to a retu rned Produc t if it
determines, in its reasonable discretion after examination
of the ret urned Pro duct, that t he Product i s an Ineligibl e
Produc t (defined bel ow). Nest Lab s will bear all c osts of
return s hipping to own er and will rei mburse any sh ipping
costs i ncurred by th e owner, except wit h respect t o
any Inelig ible Produc t, for which own er will bear all
shipping costs.
4. WHAT THIS LIM ITED WARRA NTY DOES NO T COVER
This Limi ted Warrant y does not co ver the follow ing
(collectively “Ineligible Products”): (i) Products marked
as “sampl e” or “Not for S ale”, or sold “AS IS”; (ii ) Product s
that have been subject to: (a) modifications, alterations,
tampering, or improper maintenance or repairs;
(b) handlin g, storag e, install ation, tes ting, or use no t in
accor dance with t he User’s Gui de, Placem ent Guidel ines,
or other instructions provided by Nest Labs; (c) abuse or
misuse of the Product; (d) breakdowns, fluctuations, or
interruptions in electric power or the telecommunications
netwo rk; or (e) Acts of G od, including b ut not limited
to lightn ing, flood, to rnado, earthq uake, or hurricane;
or (iii) any non-Nest Labs branded hardware products,
even if pa ckaged or so ld with Nest L abs hardwar e. This
Limite d Warranty do es not cover c onsumable pa rts,
includin g batteri es, unless da mage is due to de fects in
materials or workmanship of the Product, or software
(even if pac kaged or sol d with the prod uct). Nest L abs
recommends that you use only authorized service providers
for maint enance or r epair. Unaut horized us e of the Prod uct
or sof tware can imp air the Produ ct’s perf ormance and
may invalidate this Limited Warranty.
5. DISCL AIMER OF WARR ANTIES
EXCEPT A S STATED ABOVE IN THIS LI MITED WARRA NTY,
AND TO THE MA XIMUM EX TENT PERMITT ED BY
APPLIC ABLE LAW, NEST L ABS DISC LAIMS AL L EXPRESS,
IMPLIED, AND S TATUTORY WARRA NTIES AND C ONDITIONS
WITH RESPE CT TO THE PRODUC T, INCLUDING THE
IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS F OR A PARTICU LAR PURP OSE. TO THE M AXIMUM
EXT ENT PERMITTE D BY APPLICABL E LAW, NEST LA BS
ALSO LIMI TS THE DURATI ON OF ANY APPL ICABLE IMP LIED
WARRAN TIES OR CONDI TIONS TO THE DUR ATION OF THIS

6. LIMITATION OF DA MAGES
IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS,
IN NO EVEN T WILL NEST LAB S BE LIABLE FOR A NY
CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL
DAMAGES, I NCLUDING ANY DA MAGES FOR LOST D ATA
OR LOST PROFITS, ARISING FROM OR RELATING TO THIS
LIMITED WAR RANTY O R THE PRODUC T, AND NEST LABS ’
TOTAL CUMUL ATIVE LIA BILITY A RISING FROM OR R ELATED
TO THIS LIMIT ED WARRANT Y OR THE PRODUC T WILL
NOT EXCEED T HE AMOUNT ACTU ALLY PAID FOR THE
PRODUCT BY THE ORIGINAL PURCHASER.
7. LIMITATION OF LIABILITY
THE NEST LABS ONL INE SERVICES (“SERVICES”)
PROVIDE YOU INFORMATION (“PRODUCT INFORMATION”)
REGARDIN G YOUR NEST PRODU CTS OR OTHER
PERIPHERALS CO NNECTED TO YOUR PRODUCTS
(“PRODUCT PERIPHERALS”). THE TYPE OF PRODUCT
PERIPHERALS TH AT MAY BE CONNECTED TO YOUR
PRODUC T MAY CHANGE FROM T IME TO TIME. WITHO UT
LIMITING THE GENERAL ITY OF THE DISCL AIMERS ABOVE,
ALL PRODUCT INFORMATION IS PROVIDED FOR YOUR
CONVENIE NCE,“AS IS”, AND “AS AVAILABL E”. NEST LAB S
DOES NOT REP RESENT, WARRANT, OR GUA RANTEE

1. LO QUE CUBRE E STA GARANT ÍA LIMITADA;
PERÍODO DE COBERTURA
Nest La bs, Inc. (en ade lante, “Ne st Labs”), 34 00 Hillvie w
Avenue, Palo Alto, California USA, garantiza al propietario
del prod ucto cont enido en est a caja que dich o product o
(en adela nte, el “Produ cto”) no tendr á defecto s de
materi ales ni de fabr icación d urante un pe ríodo de dos (2)
años con tados desd e la fecha de en trega pos terior a
la compr a minorist a original (el “P eríodo de gar antía”).
Si el Prod ucto no cumple c on esta Gar antía limit ada
durante e l Período de ga rantía, Nes t Labs, ya se a por
su propia cuenta o por medio de su distribuidor autorizado,
cuya información de contacto se puede encontrar en el
exter ior del empa que del Produ cto, y según s u exclusivo
criterio: (a) reparará o reemplazará cualquier Producto
o compon ente defe ctuos o; o bien (b) acep tará la d evolució n
del Prod ucto y reemb olsará el din ero pagado p or su
compra dor original . La reparac ión o el reempl azo se
pueden efectuar con productos o componentes nuevos
o remanufacturados, según el criterio exclusivo de
Nest La bs. Si el Produ cto o un compon ente que est e
cont enga ya no es tá disponib le, Nest Lab s, según su
exclusi vo criteri o, puede re emplaza r el Produc to por uno
similar qu e tenga una func ión parecid a. Esta es
absolu tamente l a única solu ción con la q ue usted cu enta
en caso de i ncumplimie nto de esta Ga rantía limi tada.
Cualquier Producto que haya sido reparado o reemplazado
en el marc o de esta Gar antía limit ada contar á con
cober tura conf orme a las co ndiciones d e esta Gara ntía
limita da durante el p eríodo más l argo entre (a ) noventa
(90) días de sde la fech a de entreg a del Produc to repar ado
o el Produ cto de reemp lazo, o (b) el res to del Perío do
de garant ía. Esta Ga rantía limit ada es trans ferible del
comprador original a los propietarios subsiguientes,
pero el Pe ríodo de gar antía no se e xtende rá en durac ión ni

2. POLÍTICA DE DEVOLUCIÓN DE SATISFACCIÓN TOTAL
Si usted e s el comprad or original d el Product o y no está
conforme con él por alguna razón, puede devolverlo en
las con diciones or iginales de ntro de los tr einta (30) días
de la comp ra original y r ecibirá un r eembolso c ompleto.
3. CONDICIONES DE LA GARANTÍA; CÓMO OBTENER
SERVICIO SI QUIERE HACER UNA RECLAMACIÓN EN
EL MARCO D E ESTA GARAN TÍA LIMITADA
Antes de e fectuar un a reclamac ión en el marc o de esta
Garant ía limitada , el propiet ario del Prod ucto debe (a)
notific ar a Nest Lab s o a su distribu idor autor izado de la
intención de reclamar a través de nest.com/mx/support
durante e l Período de gar antía y prop orcionar una
descri pción de la sup uesta fall a, y (b) cumplir co n las
instru cciones de e nvío de Nest L abs o de su dist ribuidor
autoriz ado. Ni Nest L abs ni su distr ibuidor auto rizado
tendrá n obligación al guna en el mar co de la garant ía
con resp ecto a un Pr oducto dev uelto si de termina, se gún
un crite rio razona ble, y despué s de examinar e l Product o
devuel to, que el Prod ucto no es ele gible (esto se d efine
a contin uación). Nes t Labs o su dis tribuidor a utorizad o se
harán ca rgo de todo s los cost os de envío p ara la devo lución
por par te del propi etario me diante ree mbolso, sa lvo que
el Produ cto no sea ele gible, en cuy o caso el prop ietario
deberá h acerse ca rgo de todos lo s costos de e nvío.
4. LO QUE NO C UBRE ESTA GAR ANTÍA LIMITAD A
Esta Ga rantía lim itada no cub re lo siguie nte (en conjun to,
“Productos no elegibles”): (i) Productos identificados
como “mu estra” o “No apt o para la vent a”, o aquellos
vendidos “TAL CUAL”; (ii) Productos que hayan sido objeto
de: (a) modificaciones, alteraciones, manipulación o
mantenimiento o reparaciones inadecuados; (b)
manipulación, almacenamiento, instalación, pruebas o
uso no aco rde con la Guí a del usuario, l as Pautas de
colocación u otras instrucciones proporcionadas por
Nest La bs; (c) maltrato o u so indebido d el Product o;
(d) averías, fluctuaciones o interrupciones en el servicio
de energ ía eléctr ica o en la red de t elecomuni caciones;
o (e) casos f ortuitos , incluidos , entre otro s, rayos,
inundac iones, torn ados, terre motos o hurac anes; ni
(iii) ning ún otro pro ducto de har dware cuya m arca no sea
Nest La bs, aunque se in cluya en el mis mo empaque o
se venda c on el hardwar e de Nest Labs . Esta Gara ntía
limita da no cubre las p iezas cons umibles, inc luidas las
baterí as, a menos q ue se hayan dañ ado debido a d efecto s
de mater iales o fabri cación del P roducto, ni e l softwa re
(aunque dic has pieza s consumibl es o soft ware venga n en
el empaqu e del produc to o se vendan c on él). Nest L abs
le recom ienda que solo u se proveed ores de ser vicios
autoriz ados par a el mantenim iento o la re paració n. El uso
no autor izado del Pr oducto o el s oftwa re puede af ectar el
rendimi ento del Pr oducto e in validar es ta Gara ntía limit ada.
5. EXCLUS IÓN DE GARA NTÍAS
A EXCEPCIÓN DE LO ESTABLECIDO ANTERIORMENTE
