Nest Cam IQ Safety

THIS LIMIT ED WARRANT Y CONTAINS IMP ORTANT
INFORMATIO N ABOUT YOUR RIG HTS AND
OBLIGATIONS, AS WELL AS LIMITATIONS AND
EXCLUSI ONS THAT MAY APPLY TO YOU.

1. WHAT THIS LIMITE D WARRANT Y COVERS;
PERIOD OF COVERAGE

Nest Labs, Inc. (“Nest Labs”), 3400 Hillview Avenue,
Palo Alto , Californi a USA, warr ants to the own er of the
enclosed product that the product contained in this
box (“Pro duct”) wil l be free from d efects in m aterials
and work manship for a p eriod of two (2 ) years from t he
date of delivery following the original retail purchase
(the “War ranty Per iod”). If the Pr oduct fail s to confor m
to this Lim ited Warran ty during the W arranty P eriod,
Nest La bs will, at it s sole discre tion, eithe r (a) repair
or replace any defective Product or component; or (b)
accep t the return of t he Produc t and refund the money
actual ly paid by the or iginal pur chaser f or th e Pr oduc t.
Repair or r eplaceme nt may be made wi th a new or
refurb ished pro duct or comp onents, a t Nest Lab s’ sole
discretion. If the Product or a component incorporated
within it i s no longer avail able, Nest L abs may, at
Nest Labs’ sole discretion, replace the Product with
a similar p roduct of sim ilar functi on. This is your s ole
and exclu sive remedy f or breach of th is Limited
Warrant y. Any Produc t that has eit her been rep aired
or repla ced under t his Limited Wa rranty w ill be cover ed
by the ter ms of this Limite d Warrant y for the longer

of (a) ninet y (90) days fro m the date of deli very of
the repaired Product or replacement Product,
or (b) the rema ining Warrant y Period. Thi s Limited
Warranty is transferable from the original purchaser
to subse quent owner s, but the War ranty Per iod will
not be ex tended in dur ation or exp anded in cov erage
for any suc h transfer.

2. TOTAL SATISFAC TION RET URN POLICY

If you are th e original pu rchaser of t he Product a nd you
are not sa tisfied wit h this Produc t for any reas on, you
may retur n it in its orig inal condit ion within thir ty (30)
days of the o riginal pur chase and re ceive a full r efund.

3. WARRA NTY CONDI TIONS; HOW TO GE T SERVICE IF
YOU WANT TO CL AIM UNDER TH IS LIMITED WARR ANTY

Befor e making a claim u nder this Limi ted Warrant y,
the owner o f the Produc t must (a) noti fy Nest La bs of
the intention to claim by visiting nest.com/support
during th e Warranty P eriod and pr oviding a des cription
of the alle ged failure, a nd (b) comply wi th Nest Labs ’
return s hipping inst ructions . Nest Labs wi ll have no
warran ty obligat ions with re spect to a r eturned Pr oduct
if it dete rmines, in it s reasonab le discreti on after
examination of the returned Product, that the Product
is an Inelig ible Produc t (defined bel ow). Nest Labs
will bear a ll costs of r eturn shippi ng to owner and wi ll
reimbur se any shippin g costs incu rred by the own er,

except wi th respec t to any Ineligi ble Product , for
which own er will bear all s hipping cos ts.

4. WHAT THIS LIM ITED WARRA NTY DOES NO T COVER

This Limi ted Warrant y does not c over the foll owing
(collectively “Ineligible Products”): (i) Products marked
as “sampl e” or “Not for Sa le”, or sold “AS IS”; (ii)
Produc ts that have b een subject t o: (a) modificat ions,
alterations, tampering, or improper maintenance or
repair s; (b) handling, s torage, in stallati on, testing , or
use not in a ccordanc e with the Use r’s Guide, Pl acement
Guidelines, or other instructions provided by Nest Labs;
(c) abuse or mi suse of the Pro duct; (d) bre akdowns,
fluctuations, or interruptions in electric power or the
teleco mmunicatio ns network ; or (e) Acts of God,
includin g but not limit ed to lightnin g, flood, torn ado,
earth quake, or hurr icane; or (iii) a ny non-Nest L abs
brande d hardware pr oducts, ev en if packag ed or sold
with Nest Labs hardware. This Limited Warranty does
not cover consumable parts, including batteries, unless
damage is d ue to defec ts in materia ls or workma nship
of the Pro duct, or sof tware (eve n if package d or sold
with the p roduct). Ne st Labs rec ommends tha t you
use only authorized service providers for maintenance
or repair. Un authorize d use of the Pro duct or sof tware
can impai r the Product ’s perform ance and may
invalidate this Limited Warranty.

5. DISCL AIMER OF WARR ANTIES

EXCEPT A S STATED ABOVE IN THIS L IMITED WARRA NTY,
AND TO THE MA XIMUM EX TENT PERMIT TED BY
APPLIC ABLE LAW, NEST L ABS DISCL AIMS ALL
EXPRES S, IMPLIED, AND STATUTO RY WARRANT IES
AND CONDI TIONS WITH RESP ECT TO THE PRODUC T,
INCLUDING THE IMPLIED WARR ANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOS E. TO THE MAXIM UM EXTENT P ERMITTED
BY APPLIC ABLE LAW, NEST L ABS ALSO L IMITS THE
DURATION OF ANY APPLICABLE IMPLIED
WARRAN TIES OR CONDITI ONS TO THE DURATIO N

6. LIMITATION OF DA MAGES

IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS,
IN NO EVEN T WILL NEST LA BS BE LIABLE F OR ANY
CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR
SPECIAL DAMAGES, INCLUDING ANY DAMAGES FOR
LOST DATA OR LOST P ROFITS, ARIS ING FROM OR
RELATING TO T HIS LIMITED WARR ANTY OR THE
PRODUC T, AND NEST LABS’ T OTAL CUMULATIV E
LIABILI TY ARISIN G FROM OR RELATE D TO THIS LIMITED
WARRAN TY OR THE PROD UCT WILL NOT EXCEE D
THE AMOUN T ACTUALLY PAID FOR THE P RODUCT
BY THE ORIGINAL PURCHASER.

7. LIMITATION OF LIABILITY

THE NEST LABS ONL INE SERVICES (“SERVICES”)
PROVIDE YOU INFORMATION (“PRODUCT
INFORMATION”) REGARDING YOUR NEST PRODUCTS
OR OTHER PERIPHERAL S CONNECTED TO YOUR
PRODUCTS (“PRODUCT PERIPHERALS”). THE TYPE
OF PRODUCT PERIPHER ALS THAT MAY BE CONNECTED
TO YOUR PROD UCT MAY CHANGE FR OM TIME TO
TIME. WITHOUT LIMITING THE GENERALITY OF THE
DISCLAIMERS ABOVE, ALL PRODUCT INFORMATION
IS PROVIDE D FOR YOUR CONVE NIENCE,“AS IS”, AND
“AS AVAILABL E”. NEST LABS DO ES NOT REPRESENT,
WARRANT, OR GUARANTEE THAT PRODUCT

1. LO QUE CUBRE E STA GARANT ÍA LIMITADA;
PERÍODO DE COBERTURA

Nest La bs, Inc. (en adel ante, “Nest L abs”), 3400
Hillview Avenue, Palo Alto, California USA, garantiza
al propie tario del p roducto c ontenido en e sta caja qu e
dicho producto (en adelante, el “Producto”) no tendrá
defec tos de materi ales ni de fabr icación dur ante un
períod o de dos (2) años co ntados des de la fecha de
entreg a posterio r a la compra min orista or iginal (el
“Perío do de garantía” ). Si el Produc to no cumple con
esta Ga rantía limi tada duran te el Período d e garantía ,
Nest La bs, ya sea por s u propia cuen ta o por medio
de su distribuidor autorizado, cuya información de
conta cto se pued e encontr ar en el exte rior del emp aque
del Prod ucto, y segú n su exclusivo c riterio: (a) r eparará
o reempl azará cual quier Produ cto o compon ente
defec tuoso; o bien (b) a ceptará l a devolución d el
Produc to y reembol sará el dine ro pagado por s u
compra dor original . La repara ción o el reem plazo se
pueden efectuar con productos o componentes nuevos
o remanufacturados, según el criterio exclusivo de
Nest La bs. Si el Produ cto o un compo nente que es te
conten ga ya no está di sponible, Ne st Labs, se gún su
exclusivo criterio, puede reemplazar el Producto por

uno simil ar que tenga una f unción pare cida. Esta e s
absolu tamente la ú nica soluci ón con la que ust ed
cuent a en caso de incu mplimiento d e esta Garan tía
limita da. Cualquier P roducto qu e haya sido rep arado
o reempl azado en el ma rco de esta G arantía lim itada
contará con cobertura conforme a las condiciones de
esta Ga rantía limi tada durant e el período má s largo
entre (a) n oventa (90) dí as desde la fe cha de entreg a
del Prod ucto repar ado o el Produ cto de reemp lazo, o
(b) el rest o del Períod o de garantía . Esta Garan tía

2. POLÍTICA DE DEVOLUCIÓN
DE SATISFACCIÓN TOTAL

Si usted e s el comprad or original de l Producto y n o
está conforme con él por alguna razón, puede
devolverlo en las condiciones originales dentro de los
treint a (30) días de la com pra origina l y recibirá un
reembolso completo.

3. CONDICIONES DE LA GARANTÍA; CÓMO OBTENER
SERVICIO SI QUIERE HACER UNA RECLAMACIÓN EN
EL MARCO D E ESTA GARAN TÍA LIMITADA

Antes de efectuar una reclamación en el marco de
esta Ga rantía limi tada, el pro pietario de l Producto

debe (a) no tificar a Nes t Labs o a su dist ribuidor
autoriz ado de la inte nción de recl amar a travé s de
nest.com/mx/support durante el Período de garantía
y propor cionar una de scripción d e la supuest a falla, y
(b) cumplir c on las instr ucciones d e envío de Nest
Labs o de s u distribuid or autoriza do. Ni Nest Lab s ni
su distribuidor autorizado tendrán obligación alguna
en el marc o de la garant ía con respe cto a un Produc to
devuelto si determina, según un criterio razonable, y
después de examinar el Producto devuelto, que el
Produc to no es eleg ible (esto se de fine a continu ación).
Nest La bs o su distrib uidor autor izado se harán c argo
de todos l os costos d e envío para la d evolución p or
parte d el propiet ario median te reembol so, salvo que
el Produ cto no sea ele gible, en cu yo caso el pro pietario
deberá h acerse ca rgo de todos lo s costos de e nvío.

4. LO QUE NO C UBRE ESTA GAR ANTÍA LIMITAD A

Esta Ga rantía limi tada no cubre l o siguiente (en
conjunto, “Productos no elegibles”): (i) Productos
identi ficados como “ muestra” o “N o apto para la
venta”, o aqu ellos vendid os “TAL CUAL”; (ii) Produc tos
que hayan s ido objeto de: (a) m odificacio nes,
alteraciones, manipulación o mantenimiento o
reparaciones inadecuados; (b) manipulación,
almacenamiento, instalación, pruebas o uso no acorde
con la Guí a del usuario, l as Pautas de c olocació n
u otras instrucciones proporcionadas por Nest Labs;
(c) maltrat o o uso indebid o del Produc to; (d) averías,

fluctuaciones o interrupciones en el servicio de
energ ía eléctric a o en la red de te lecomunic aciones;
o (e) casos f ortuitos , incluidos , entre otro s, rayos,
inundac iones, torn ados, terr emotos o hura canes; ni
(iii) ning ún otro prod ucto de hardw are cuya marc a no
sea Nes t Labs, aunq ue se incluy a en el mismo emp aque
o se venda c on el hardwar e de Nest Lab s. Esta Ga rantía
limita da no cubre las p iezas consu mibles, incl uidas
las bat erías, a meno s que se hayan dañ ado debido
a defec tos de materi ales o fabric ación del Pr oducto,
ni el sof tware (aunqu e dichas pieza s consumible s
o soft ware vengan e n el empaque del p roducto o se
vendan c on él). Nest La bs le recomie nda que solo
use prov eedores de se rvicios a utorizados p ara el
manteni miento o la re paración . El uso no autor izado
del Prod ucto o el sof tware pu ede afect ar el rendim iento
del Prod ucto e invalid ar esta Gar antía limit ada.

5. EXCLUS IÓN DE GARA NTÍAS

A EXCEPCIÓN DE LO ESTABLECIDO ANTERIORMENTE
EN ESTA GAR ANTÍA LIMITADA , Y EN LA MÁX IMA
MEDIDA PERMIT IDA POR LA LE Y VIGENTE, NE ST LABS
NO SE HARÁ RESPONSABLE DE NINGUNA GARANTÍA
NI CONDICIÓN EXPRESA, IMPLÍCITA NI ESTATUTARIA
CON RESPEC TO AL PRODUC TO, INCLUIDAS L AS
GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD O
APTIT UD PARA UN FIN DE TERMINADO. EN L A MÁXIM A

POR LOS SER VICIOS NO ESTÁ DES TINADA A SER UN
SUSTIT UTO DE LOS MEDIO S DIRECTOS PAR A OBTENER
INFORMACIÓN. POR EJEMPLO, UNA NOTIFICACIÓN
SUMINISTR ADA A TRAVÉS D EL SERVICIO NO ES TÁ
