THIS LIMITED WARRANTY CONTAINS IMPORTANT INFORMATION
ABOUT YO UR RIGHTS AND O BLIGATIONS, A S WELL AS
LIMITATIONS A ND EXCLUSION S THAT MAY APPLY TO YOU.

1. WHAT THIS LIMIT ED WARRANT Y COVERS;
PERIOD OF COVERAGE

Nest Labs, Inc. (“Nest Labs”), 3400 Hillview Avenue, Palo
Alto, Ca lifornia USA , warrants t o the owner of the e nclosed
Nest-branded product contained in this box (“Product”) will
be fre e from defec ts in materi als and work manship for a pe riod
of one ye ar (if the Produ ct is a Nest The rmostat E or a N est
Temperat ure Sensor) or t wo (2) years (for a ny other Prod uct)
from th e date of deliv ery follow ing the origin al retail pur chase
(the “War ranty Pe riod”). The War ranty Pe riod is exte nded for an
additi onal two (2) yea rs (if the Pro duct is a Nest T hermost at E)
or an addi tional thre e (3) years (if the P roduct is a Ne st Learnin g
Therm ostat or a Ne st Protec t smoke/CO al arm) sold to you a nd
insta lled by a Nest P ro who, if appli cable, ente rs a valid Nes t Pro
ID during s etup. Notwi thstandin g the foregoin g, the Warrant y
Perio d for a factor y refurbis hed Produc t is one (1) year, even if
insta lled by a Nest Pr o. If the Produc t fails to con form to this
Limite d Warrant y during the War ranty Per iod, Nest L abs will, at i ts
sole discretion, either (a) repair or replace any defective Product
or comp onent; or (b) ac cept the re turn of the Pro duct and ref und
the mon ey actually p aid by the orig inal purchas er for the Pro duct.
Repair o r replacem ent may be made wi th a new or refu rbished
produ ct or compon ents, at Nes t Labs’ sole di scretion, t o the
exte nt that this is p ermitted b y local laws in y our jurisdict ion.
If the Pr oduct or a com ponent inco rporate d within it is no lo nger
availa ble, Nest La bs may, at Nest L abs’ sole disc retion, re place
the Pro duct with a sim ilar produc t of similar f unction. Th is is your
sole and e xclusive re medy for bre ach of this Lim ited Warran ty.
Any Pro duct that ha s either bee n repaired o r replaced u nder this
Limite d Warrant y will be covere d by the terms o f this Limited
Warran ty for the lon ger of (a) ninet y (90) days from th e date
of deli very of the re paired Prod uct or repla cement Prod uct,
or (b) the r emaining Warr anty Perio d. This Limite d Warranty i s
transferable from the original purchaser to subsequent owners,

but the Wa rranty Per iod will not be e xtended in du ration or
expan ded in covera ge for any such tr ansfer.

2. TOTAL SATIS FACTION RET URN POLICY

If you are t he original p urchaser of t he Product an d you are not
satis fi ed w ith this Prod uct for any rea son, you may re turn it in its
origin al conditio n within thir ty (30) days of the o riginal purc hase
and rec eive a full re fund.

3. WARRA NTY COND ITIONS; HOW TO G ET SERVICE IF YO U WANT
TO CLA IM UNDER THIS LIM ITED WARRAN TY

Befor e making a cla im under this Lim ited Warran ty, the owner o f
the Product must (a) visit nest.com/choose-your-country/support
during t he Warranty P eriod to prov ide notice of y our warrant y
claim an d describe t he alleged fa ilure, and (b) co mply with Nes t
Labs’ (or its authorized distributor’s) return shipping instructions.
Nest L abs will have no wa rranty obl igations wit h respect to a
retur ned Produc t if it determin es, in its rea sonable discr etion
afte r examinatio n of the retur ned Produc t, that the Pr oduct is an
Inelig ible Produc t (defi ned below). Ne st Labs will b ear all cost s
of retu rn shipping to o wner and will re imburse any sh ipping cost s
incurr ed by the owner, exc ept with resp ect to any Ineli gible
Produ ct, for which t he owner will be ar all shipping co sts.

4. WHAT THIS L IMITED WARRA NTY DOES N OT COVER

This Lim ited Warran ty does not c over the foll owing (collec tively
“Ineligible Products”): (i) Products marked as “sample” or “Not
for Sal e”, or sold “AS IS ”; (ii) Produc ts that have be en subject to:
(a) modifi c ations, alterations, tampering, or improper maintenance
or repa irs; (b) handlin g, storag e, install ation, tes ting, or use no t in
accor dance with a ny User’s Guid e, Placeme nt Guideline s, or other
instr uctions pr ovided by Nes t Labs; (c) abuse o r misuse of the
Product; (d) breakdowns, fl uctuations, or interruptions in electric
power or t he telecomm unications n etwork; or (e) A cts of God,
includ ing but not limi ted to light ning, fl ood, to rnado, ear thquake,
or hurri cane; or (iii) an y non-Nest L abs branded h ardware
produ cts, even if p ackaged or s old with Nest L abs hardwar e.
This Lim ited Warra nty does no t cover con sumable par ts, inclu ding
batt eries, unle ss damage is due t o defects in m aterials or

workm anship of the Pr oduct, or s oftwar e (even if such c onsumable
part s or soft ware are pack aged or sold wi th the Produc t). Nest
Labs r ecommend s that you use on ly authorize d servic e provide rs
for main tenance or r epair. Unauthor ized use of the P roduct or
sof tware can im pair the Pro duct’s per formanc e and may inval idate
this Limited Warranty.

5. DISCL AIMER OF WARR ANTIES

EXCEPT AS STATED ELSEWHER E IN THIS LIMITED WARR ANTY,
AND TO THE M AXIMUM EX TENT PERMIT TED BY APPLI CABLE LAW,
NEST L ABS DISCL AIMS ALL EXP RESS, IMPLIED, AN D STATUTO RY
WARRA NTIES AND CONDI TIONS WITH RES PECT TO THE PROD UCT,
INCLUDING THE IMPLIED WARR ANTIES OF MERCHANTABIL ITY
AND FITN ESS FOR A PARTICU LAR PURPO SE. TO THE MAX IMUM
EXT ENT PERMITT ED BY APPLICAB LE LAW, NEST LA BS ALSO
LIMITS T HE DURATION OF AN Y APPLICABL E IMPLIED WARRA NTIES
OR CONDI TIONS TO THE DUR ATION OF THIS LIMIT ED WARRANT Y.

6. LIMITATION OF D AMAGES

IN ADDIT ION TO THE WARRAN TY DISCL AIMERS STATED
ELSEW HERE IN THIS LIMITED WAR RANTY, IN NO EV ENT WILL
NEST L ABS BE LIABLE F OR ANY INDIRECT, CON SEQUENTIAL ,
INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING
ANY DAM AGES FOR LOST DATA OR LO ST PROFITS, A RISING FROM
OR RELATI NG TO THIS LIMITED WAR RANTY O R THE PRODUCT,
AND NEST L ABS’ TOTAL CUMU LATIVE LIA BILITY ARI SING FROM
OR RELATE D TO THIS LIMITED WARR ANTY OR T HE PRODUCT WIL L
NOT EXCEE D THE AMOUNT ACT UALLY PAID FOR THE PRO DUCT
BY THE ORIGINAL PURCHASER.

THE NEST L ABS ONLINE SER VICES (“SERVI CES”) PROVIDE YO U
WITH INFORMATION (“PRODUCT INFORMATION”) REGARDING YOUR
NEST PRODUC TS OR OTHER PERIPHERALS CONNEC TED TO YOUR
PRODUCTS (“PRODUCT PERIPHERALS”). THE TYPE OF PRODUCT
PERIPHER ALS THAT MAY BE CONNE CTED TO YOUR PRO DUCT MAY
CHANGE F ROM TIME TO TIME. W ITHOUT LIMI TING THE GENER ALITY
