THIS LIMITED WARRANTY CONTAINS IMPORTANT INFORMATION
ABOUT YO UR RIGHTS AN D OBLIGATIONS , AS WELL AS
LIMITATIONS A ND EXCLUSION S THAT MAY APPLY TO YOU.

1. WHAT THIS LIMIT ED WARRANT Y COVERS;
PERIOD OF COVERAGE

Nest L abs, Inc. (“Ne st Labs”), 34 00 Hillview Av enue, Palo Alt o,
Calif ornia USA, wa rrants to th e owner of the en closed pro duct
that th e product co ntained in th is box (“Produ ct”) will be f ree
from de fects in ma terials and wo rkmanship f or a period of t wo
(2) year s from the date o f deliver y following th e original re tail
purch ase (the “Warr anty Peri od”). If the Pro duct fails t o conform
to this Li mited Warra nty during th e Warrant y Period, Nes t Labs
will, at i ts sole disc retion, eit her (a) repair o r replace an y defectiv e
Produ ct or compon ent; or (b) acce pt the retur n of the Produc t
and ref und the money a ctually pai d by the origina l purchaser
for the P roduct. Re pair or repla cement may b e made with a
new or re furbished p roduct or co mponents , at Nest Lab s’ sole
discretion. If the Product or a component incorporated within it is
no longe r available, N est Labs may, at N est Labs’ s ole discreti on,
repla ce the Produ ct with a simil ar product o f similar func tion.
This is yo ur sole and excl usive remed y for breach o f this Limite d
Warran ty. Any Produ ct that has ei ther been re paired or re placed
under th is Limited War ranty will b e covered by t he terms of thi s
Limite d Warrant y for the longe r of (a) ninety (9 0) days from the
date of de livery of t he repaire d Product or r eplaceme nt Product ,
or (b) the r emaining Warr anty Perio d. This Limit ed Warrant y is
transferable from the original purchaser to subsequent owners,
but the Wa rranty Pe riod will not b e extende d in duration or
expan ded in covera ge for any such t ransfer.

2. TOTAL SATIS FACTION RET URN POLICY

If you are t he original p urchaser of t he Product a nd you are not
satis fied with this P roduct for a ny reason, yo u may return it i n its
origin al conditio n within thir ty (30) days of th e original pur chase
and rec eive a full re fund.

3. WARRA NTY COND ITIONS; HOW TO G ET SERVICE IF YO U WANT
TO CLA IM UNDER THIS LIM ITED WARRAN TY

Befor e making a cla im under this Lim ited Warran ty, the owner
of the Pr oduct must (a ) notify Ne st Labs of the i ntention to c laim
by visi ting nest.c om/suppor t during the Warr anty Per iod and
provi ding a descrip tion of the all eged failure , and (b) comply wi th
Nest L abs’ return s hipping inst ructions . Nest Labs wi ll have
no warr anty obliga tions with re spect to a re turned Pro duct if it
determines, in its reasonable discretion after examination of
the returned Product, that the Product is an Ineligible Product
(define d below). Nest L abs will bear al l costs of re turn shippin g
to owner a nd will reimbu rse any shippi ng costs inc urred by the
owner, exce pt with resp ect to any Inel igible Prod uct, for whic h
owner wi ll bear all ship ping costs .

4. WHAT THIS L IMITED WARRA NTY DOES N OT COVER

This Lim ited Warran ty does not c over the fol lowing (colle ctively
“Inelig ible Produc ts”): Produ cts marked a s “sample” or “No t for
Sale”, or sol d “AS IS”; or Produc ts that have be en subject t o: (a)
modifications, alterations, tampering, or improper maintenance
or repa irs; (b) handlin g, storage , installa tion, testi ng, or use not in
accor dance with t he User’s Guide , Placemen t Guidelines , or other

instr uctions pr ovided by Nes t Labs; (c) abus e or misuse of the
Product; (d) breakdowns, fluctuations, or interruptions in electric
power or t he telecom munication s network; o r (e) Acts of God,
includ ing but not limi ted to lightn ing, flood, to rnado, ear thquake,
or hurri cane. This Li mited Warra nty does no t cover cons umable
part s, including b atterie s, unless dam age is due to def ects in
mater ials or workm anship of the Pr oduct, or so ftware (ev en if
such co nsumable par ts or sof tware are pa ckaged or so ld with the
produ ct). Nest La bs recomme nds that you us e only author ized
service providers for maintenance or repair. Unauthorized use of
the Pro duct or sof tware can im pair the Prod uct’s perf ormance
and may inv alidate this L imited Warr anty.

5. DISCL AIMER OF WARR ANTIES

EXCEP T AS STATED ABOVE IN THIS L IMITED WARRAN TY,
AND TO THE M AXIMUM EX TENT PERMIT TED BY APPLIC ABLE
LAW, NEST L ABS DISCL AIMS ALL EX PRESS, IMPLIED, A ND
STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT
TO THE PRO DUCT, INCLUDING THE IMP LIED WARRANT IES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
TO THE MA XIMUM EXT ENT PERMITT ED BY APPLICAB LE LAW,
NEST L ABS ALSO LIMI TS THE DURATION O F ANY APPLICA BLE
IMPLIED WAR RANTIES OR CO NDITIONS TO THE D URATION OF
THIS LIMITED WARR ANTY.

6. LIMITATION OF D AMAGES

IN ADDIT ION TO THE ABOVE WA RRANT Y DISCLAIMER S, IN NO
EVEN T WILL NEST LAB S BE LIABLE FOR A NY CONSEQUEN TIAL,
INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING
ANY DAM AGES FOR LOST DATA OR LOS T PROFITS, AR ISING FROM
OR RELATI NG TO THIS LIMITED WAR RANTY O R THE PRODUCT,
AND NEST L ABS’ TOTAL CUMU LATIVE LIA BILITY ARI SING FROM
OR RELATE D TO THIS LIMITED WARR ANTY OR T HE PRODUCT WIL L
NOT EXCEE D THE AMOUNT ACT UALLY PAID FOR THE PRO DUCT BY
THE ORIGINAL PURCHASER.

7. LIMITATION OF LIABILITY

THE NEST L ABS ONLINE SER VICES (“SERVI CES”) PROVIDE Y OU
INFORMATION (“PRODUCT INFORMATION”) REGARDING YOUR
NEST PRODUC TS OR OTHER PERIPHERALS CONNECT ED TO YOUR
PRODUCTS (“PRODUCT PERIPHERALS”). THE TYPE OF PRODUCT
PERIPHER ALS THAT MAY BE CONNEC TED TO YOUR PRODU CT MAY
CHANGE F ROM TIME TO TIME. WI THOUT LIMIT ING THE
GENERA LITY OF THE DI SCLAIMERS A BOVE, ALL PRO DUCT
INFORMATI ON IS PROVIDED FOR YO UR CONVENIENC E,“AS IS”,
AND “AS AVAILA BLE”. NEST LAB S DOES NOT REPRES ENT,

RESULTING FROM YOUR USE OF THE PRODUCT INFORMATION,

Likewis e, some of the li mitations i n this Limited W arranty no t
apply in c ertain st ates, pro vinces or jur isdiction s. The terms
of this Li mited Warra nty will appl y to the exte nt permit ted by
applic able law. For a fu ll descript ion of your lega l rights you
should r efer to the la ws applicabl e in your jurisdi ction and you
may wish t o contact a r elevant con sumer advis ory ser vice.

Industry Canada Regulatory Statement

This dev ice complie s with Industr y Canada lice nse-exempt
RSS st andard(s). Oper ation is subjec t to the followin g two
conditions:

(1) this device m ay not cause int erferenc e, and
(2) this dev ice must acc ept any inter ference, inc luding

interference that may cause undesired operation
