Nest Labs, Inc. (“Nest Labs”), 3400 Hillview Avenue,
Palo Alto , Californi a USA, warra nts to the owne r of
the enclosed product that the product contained in
this box (“P roduct” ) will be free fr om defect s in
materi als and workm anship for a per iod of two (2)
years fr om the date of d elivery f ollowing the or iginal
retail p urchase (th e “Warrant y Period” ). If the Produc t
fails to c onform to thi s Limited Warr anty durin g the
Warrant y Period, N est Labs wi ll, at its sol e discreti on,
either (a) repair or replace any defective Product or
compon ent; or (b) acce pt the retur n of the Produc t
and refu nd the money ac tually paid b y the original
purchaser for the Product. Repair or replacement
may be made w ith a new or ref urbished pr oduct or
compon ents, at Nes t Labs’ sole d iscretion . If the
Produc t or a compone nt incorpo rated withi n it is no
longer av ailable, Nes t Labs may, at Nes t Labs’ sole
discretion, replace the Product with a similar product
of simila r function. T his is your sole a nd exclusive
remed y for breach of t his Limited Wa rranty. Any
Produc t that has eit her been rep aired or repl aced
under thi s Limited Warr anty will be c overed by th e
terms of t his Limited Wa rranty fo r the longer of (a)
ninet y (90) days from t he date of del ivery of t he repair ed
Product or replacement Product, or (b) the remaining
Warranty Period. This Limited Warranty is transferable
from the original purchaser to subsequent owners,
but the War ranty Per iod will not be e xtended i n
duratio n or expande d in covera ge for any such t ransfer.

reason , you may retur n it in its orig inal conditi on

of the alle ged failure, a nd (b) comply wi th Nest Labs ’
return s hipping inst ructions . Nest Labs wi ll have no
warran ty obligati ons with res pect to a ret urned
Product if it determines, in its reasonable discretion
after e xamination o f the return ed Product , that the
Produc t is an Ineligib le Product (de fined below).
Nest Labs will bear all costs of return shipping to
owner and will reimburse any shipping costs incurre d

modifications, alterations, tampering, or improper
maintenance or repairs; (b) handling, storage,
instal lation, tes ting, or use n ot in accord ance with
the User ’s Guide, Plac ement Guide lines, or oth er
instru ctions pro vided by Nes t Labs; (c) abuse o r
misuse of t he Product; (d ) breakdowns,
fluctuations, or interruptions in electric power or
the telecommunications network; or (e) Acts of
God, inc luding but not l imited to ligh tning, flood ,
tornad o, earthqu ake, or hurric ane; or (iii) any
non-Nes t Labs bran ded hardwar e products , even if
packaged or sold with Nest Labs hardware. This
Limite d Warranty d oes not cov er consumab le parts,
includin g batteri es, unless d amage is due to de fects
in materi als or workm anship of the Pr oduct, or
soft ware (even if p ackaged or s old with the pr oduct).
Nest La bs recomm ends that you u se only autho rized
service providers for maintenance or repair.
Unautho rized use of th e Product or s oftware c an
impair th e Product’s p erforma nce and may
invalidate this Limited Warranty.
