Fujitsu General America, Inc. – Limited Warranty Statement

Variable Refrigerant Flow System – AIRSTAGE V-II

This is a Limited Warranty provided by Fujitsu General America, Inc. (“FGAI”) to the original end-user purchaser and any subsequent end-users
(collectively, “End-user”) of the Fujitsu Airstage V-II System (“System”) in the location where the System is originally installed in the United States, U.S.
Territories and Canada.

1. LIMITED WARRANTY COVERAGE

FGAI warrants for the time periods set forth below that the System will be free of defects in material and workmanship for human thermal comfort
applications under normal use and service. Any repaired or replaced component or part shall be warranted for the remainder of the original limited
warranty period or thirty (30) days after shipment of replacement part, whichever is longer.

PARTS – For a period of one (1) year beginning on the date of installation completion/ start-up date verified by an installer’s invoice or proof of
purchase. FGAI will supply new, or at its option rebuilt replacement Parts. “Parts” are defined as integral components of Fujitsu VRF condenser or
evaporator units and only includes items which are not otherwise covered or excluded under this warranty.

COMPRESSOR – For a period of two (2) years beginning on the date of installation completion/ start-up date verified by an installer’s invoice or proof of
purchase. FGAI will supply a replacement Compressor(s).

CONTROLS AND ACCESSORIES – For a period of ninety (90) days beginning on the date of installation completion/ start-up date verified by an
installer’s invoice or proof of purchase, FGAI will supply new, or at its option rebuilt replacement Controls. Controls include: Wired Remote Control, IR
Receiver, Simple Remote Control, Central Remote Controller, Wireless Remote Control, Network Converters, Group Remote Controller, Touch Panel
Controller, External Switch Controller, Signal Amplifier, External Drain Pump, Remote Sensing Units, USB Network Interface, BAC Net Gateway and any
other Fujitsu Airstage Control or Accessory Components.

SOFTWARE – For a period of ninety (90) days beginning on the date of receipt, FGAI will replace Software media including WIBU Key provided to
End-user in use and connection with the System. This Limited Warranty extends only to the media on which the Software is distributed. End-user's
exclusive remedy for a breach of the Limited Warranty with respect to Software shall be the replacement or repair of the defective Software media if
returned to FGAI within ninety (90) days from the date of receipt, or the return to End-user of the fee paid by End-user to FGAI for the defective Software
under this Agreement, at FGAI’s sole option.

1.1. EXTENDED WARRANTY FOR QUALIFIED SYSTEMS (including outdoor model(s), indoor model(s), and control(s)

A “Qualified System” is defined as a system that is designed and installed by a company(ies) who:

a) Are registered in the Airstage Project Manager database; and
b) (Installers) have passed the required Airstage V-II installation training courses prior to installation; and
c) (Designers) have satisfactorily completed Airstage Design Simulator training prior to design; and
d) Had the system commissioned by a FGAI registered commissioning agent within 120 days of installation; and
e) Have registered the system in the Airstage Project Manager including;

f) Have submitted (within 21 days of completing commissioning) full commissioning report(s) to the Airstage Project Manager online

g) Received approval from FGAI that all reports are complete and without errors and received from FGAI an Extended Warranty Approval

PARTS WARRANTY FOR QUALIFIED SYSTEMS - The Part(s) are warranted for an additional four (4) years from the second (2nd) through the fifth
(5th) year after the date of installation or up to 5 years from the date a model in a qualified system is discontinued whichever occurs first. A list of
discontinued models can be found at www.airstage.fujitsugeneral.com.

COMPRESSOR WARRANTY FOR QUALIFIED SYSTEMS - The Compressor part is warranted for an additional five (5) years from the third (3rd)
through the seventh (7th) year after the date of original installation or up to 7 years from the date a model in a qualified system is discontinued whichever
occurs first. A list of discontinued models can be found at www.airstage.fujitsugeneral.com.

2. TERMS OF WARRANTY
THESE LIMITED WARRANTIES DO NOT INCLUDE LABOR or any other costs incurred during replacement. The owner is solely responsible for all

labor and other costs of troubleshooting, installing, replacing, disconnecting or dismantling the System and does not cover any consumable goods
including: refrigerant, belts, filters, oil, bearings, etc.

a. Model and serial numbers; and
b. Name of registered companies involved in system design and installation; and
c. An email address of where extended warranty shall be mailed when approved; and

including:

a. Upload (as built) Airstage Design Simulator .FGF file(s); and
b. Upload Airstage Service Tool (2-hours of run data) output file(s); and
c. Upload Commissioning .PDF Checklist or complete online; and

Letter.

2.1. THIS LIMITED WARRANTY DOES NOT COVER:

1. A System sold and/or installed outside the United States, U.S. Territories or Canada, or removed from the location where it was originally
installed;

2. A system install by a contractor not holding current government issued licenses (where required) for electrical, mechanical and plumbing that
authorizes the company or companies to service and install heating, ventilation, and air conditioning equipment, in the state where the system
resides;

3. A system not installed in accordance with instructions and guidelines set forth in installation, operation, maintenance, software or engineering
publications made available by FGAI

4. A system not installed in accordance with local and state law; applicable building codes and permits; or good trade practices

5. Any Demo units, system sold AS IS or WITH ALL FAULTS, obsolete or discontinued models.

6. A System that had a serial number or any Part(s) thereof altered, defaced or removed.

7. Any indirect, incidental or consequential damages including, but not limited to, loss of profit, loss of business, charges related to the rental or
purchase of temporary cooling, ventilating, and/or heating equipment or any other “loss of use” charges.

8. Any and all shipping charges to pickup, transport, delivery and/or install the System, any component or part of the System, or any defectives
Parts, and any and all shipping damages

9. Damage and/or failure caused by System misuse, neglect, or from a failure of the Customer to operate the System as specified by the
manufacturer's instruction manuals or perform necessary preventive and routine maintenance as defined in FGAI published documents.
Routine maintenance includes procedures including but not limited to cleaning the condensate drain system, evaporator, and condenser coils,
cleaning and/or replacing of air filters or belts.

10. Damage and/or failure caused by any maintenance or field provided Part(s) or components, supplies, or labor provided by any third party
service provider that are beyond the terms of this Limited Warranty.

11. Damage and/or failure caused by a power surge (caused by lightning and fluctuations in or interruptions of electrical power), or faulty power
supply; including damage caused by or effected by improper wiring or installation.

12. Damage and/or failure caused by fire, water, wind, impact damage from projectiles, earthquake, theft, riot, vandalism, force majeure, acts of
war or any and all acts of God.

13. Damage and/or failure caused by System exposure to extreme environmental conditions and/or corrosive chemical vapors and/or liquids.
Corrosive exposure including, but not limited to: Salt Air, Salt Spray, Chlorinated water or vapor (such as in an enclosed pool area), Fluorine
vapor, etc.

14. Damage and/or failure caused by improper application of the System or any component of the System, including damages caused by
improper sizing or design of the system or any damage caused by locating the system in locations with extreme weather conditions outside of
the recommended installation requirements, as stated in the installation manual.

15. Damage and/or failure caused by modification and/or alteration of the System or any component of the System, including incorporation of
other products.

16. Any unit purchased from an unauthorized dealer or any online retailer.

2.2 THE WARRANTY AND REMEDY STATED ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES
INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME
LAWS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTY, THEREFORE THIS WARRANTY SHALL BE DEEMED MODIFIED TO BE
CONSISTENT WITH SUCH LAWS. Some states do not allow limitation on how long an implied warranty lasts; therefore these limitations or exclusions

may not apply to you. This limited warranty gives you specific legal rights. You may also have other rights that may vary from state to state.

Acceptance, installation, operation or use of the System will constitute acceptance of the terms hereof. No one is authorized by FGAI to modify this
Warranty in any respect or to create for FGAI any other obligation or liability in connection with the System unless done so in a written agreement
bearing the handwritten signature of the President or a Vice President of FGAI.

2-3. DISPUTE RESOLUTION -.The laws of the state of New Jersey govern this Limited Warranty and all of its terms and conditions, without giving
effect to any principles of conflicts of laws. All actions at law or in equity arising out of or relating to these terms and conditions shall be submitted to
confidential arbitration in Fairfield, New Jersey, under the rules then prevailing of the American Arbitration Association. To the fullest extent permitted by
applicable law, no arbitration under this Limited Warranty shall be joined to an arbitration involving any other party subject to this Limited Warranty ,
whether through class arbitration proceedings or otherwise.

Except to the extent prohibited by applicable law, End-user agrees she/he will not bring any action, regardless of form, arising out of or in any way
connected with this Limited Warranty, more than one (1) year after the cause of action has occurred.

2-4. SEVERABILITY - If a part, provision or section of this Limited Warranty, or its application to any person or circumstance is held invalid, void or
unenforceable, such holding shall not affect this Limited Warranty and all other parts, provisions, clauses or applications shall remain, and, to this end,
such other parts, provisions, clauses or applications of the Limited Warranty shall be treated as severable.

2-5. VALIDITY - This Limited Warranty shall apply to all commercial Airstage VRF V-II Systems sold to specified End-users after the effective date at the
top of this warranty. FGAI holds the right to amend the provisions, clauses or applications of this Limited Warranty from time to time without notice. This
Limited Warranty applies to United States, U.S. Territories and Canada.

3. WARRANTY PARTS SERVICE - Contact the licensed, authorized FGAI contractor who installed the System or the nearest licensed, authorized FGAI
